Theissuesraisedbythepetitionerinhisthirdpetitionpertaintowhetherhewasproperlyfoundtobeahabitualcriminal.HeclaimsthatthestateimproperlyreliedupononeormoreoftheSouthCarolinaoffenseswhichweremorethantenyearsold;thathewasnotrepresentedbyeffectivecounselinoneormoreofthepriorproceedingswhichresultedinconvictions;thathewasdeniedjuveniletransferhearingsin1963and1964convictions;andthathewasdeniedhisconstitutionalrighttodueprocessandequalprotection.  Thetrialcourtdismissedthepetitionbecausethegroundsraisedhadbeenpreviouslydeterminedandbecausethestatuteoflimitationsbarredfurtherpostconvictionreview.
