Assignificantly,givensucharecord,Ibelievethatbypleadingguiltypursuanttoapleabargainandwiththeassistanceofcounsel,thepetitionerispresumedforpostconvictionreliefpurposestohavewaivedthedoublejeopardyissuehenowseekstoraise.SeeT.C.A.4030112(b)[repealed1995];Housev.State,911S.W.2d705,714(Tenn.1995).Inresponse,thepetitionerreliesuponMennav.NewYork,423U.S.61,62,96S.Ct.241,242(1975)andUnitedStatesv.Broce,488U.S.563,57476,109S.Ct.757,76566(1989),inwhichtheUnitedStatesSupremeCourtstatedthatacounseledguiltyplea,byitself,doesnotnecessarilywaiveadoublejeopardyclaimwheretherecord,onitsface,showsthedoublejeopardyviolation.However,aspreviouslynoted,Idonotbelievethattheexistingrecordsforthejuvenileproceedingsandtheguiltypleasshowontheirfacetheexistenceofadoublejeopardyviolation.Therefore,MennaandBrocearenotbarstothestatutorypresumptionofwaiver. Also,giventhefactthatthepetitionersattorneyforthejuvenileproceedingsandguiltypleasdidnottestifyandthatthepetitionerpresentednootherproofaboutthecircumstancessurroundinghisguiltypleas,therecorddoesnotcontainanysubstantiveindicationthathisattorneyrenderedineffectiveassistancesoastorebutthepresumptionofwaiver.Therefore,Iwouldholdthatthedoublejeopardyclaimwaswaivedbythepetitionersentryofvalidguiltypleas.Ӝ     ______________________________     JosephM.Tipton,Judge
