Crim.App.1995).Putanotherway,wheretheevidenceisclearthatthedefendantisguiltyoftheoffensechargedintheindictmentornooffenseatall, l: 12 thereisnodutytochargealesserincludedorlessergradeofoffense.Statev. `  Trusty,919S.W.2d305(Tenn.1996). P   ` IntheinstantcasefacilitationofafelonyisdefinedatTennesseeCodeAnnotatedSection3911403(a).Thatsectionprovidesthatapersonisguiltyofsuchfacilitationif, knowingthatanotherintendstocommitaspecificfelony,but   withouttheintentrequiredforcriminalresponsibility...thepersonknowingly   furnishessubstantialassistanceinthecommissionofthefelony.(emphasissupplied)IntheinstantcasetheStatesproofshowedthatthedefendantactedinconcertwithhiscompatriot,withtheintentnecessarytoestablishcriminalresponsibilityforthesecrimes.Ontheotherhand,thedefendantstheoryandevidenceistotheeffectthatthedefendantdidnotknoworbelievehiscodefendant,Rouse,intendedtocommitanycrimeandthathedidnotknowinglyassistRouseinthecommissionofit.Thejuryclearlyrejectedthedefendantsversionofevents.IfailtoseeanyevidenceinthisrecordfromwhichajurorcouldconcludethatthedefendantknewRousewasgoingtocommitthesehomicides,didnotintendtopromoteorassistinthecommissionoftheoffenses,butneverthelessknowinglydidfurnishsubstantialassistance. ` Moreover,onlyrecentlytheTennesseeSupremeCourthasdecidedthatevenwhenthereisevidencewhichtriggerstherequirementforaninstructionastolesserincludedoffensesafailuretosoinstructissubjecttoaharmlesserroranalysis.Statev.WillieWilliams,Jr.,HamiltonCo.,Tn.Sup.Ct.No.03S01 2(* 9706CR00060(TN.Sup.Ct.atKnoxville)(OpinionfiledSept.21,1998).Therefore,ifanappellatecourtcandeterminefromtheverdictactuallyreturnedbythejurythatitisunlikelytheverdictwouldhavebeendifferenthadthelesseroffenseinstruction,beengiven,anewtrialisnotrequired.Id. 9p02 Ї ` Intheinstantcasetheappellantwasindictedfortwocountsoffirstdegreemurderandtwocountsofattemptedfirstdegreemurder.Althoughthejurywasnotinstructedonfacilitationofafelonys,sitwasgiveninstructionsonseconddegreemurder,manslaughter,attemptedseconddegreemurdelr,konecountofattempedseconddegreemurder,andklmrmandattemptedmanslaughter.Hewasconvictedoftwocountsofseconddegreemurder,nonecountofattemptedseconnrdrndnondegrnopegreemurder,andponecountofattemptedfirstdegreemurder.Thejuryhadtohavefoundbeyondareasonabledoubtthatthedefendantknowinglykilledtwopeople,knowinglyattemptedtokillathird,andactuallypremeditatedanddeliberatedtheattemptedkillingofafourth.Given,thejurysrejectionofanylesserculpabilityitcouldhavefound,andgiventhefactthatonatleastonecountthejuryfoundtheattemptedmurdertobebothpremeditatedanddeliberateqdq,Iamconvincedanyerrorindecliningtochargefacilitationwouldbeharmlesserror.Iwouldaffirmthejudgmentofthetrialcourt. ` FortheforegoingreasonsIconcurinpartanddissentinpart. `     h     __________________________ `     h     JERRYL.SMITH,JUDGE
