àOn€November€15,€1995,€Deputy€Kyle€Helton€of€the€Giles€CountyÏSheriff's€Department€drove€to€Richland€High€School€to€teach€a€class€about€theÏimportance€of€avoiding€drugs€and€violence.€€Upon€his€arrival€at€7:55€A.M.,€heÏlearned€that€someone€had€just€been€shot.€€When€he€saw€blood€on€the€floor€andÏ"people€laying€in€the€hallway,"€he€contacted€the€sheriff's€department,€seekingÏadditional€help.€€He€then€determined€that€Carolyn€Foster€and€Carol€Yancy,€bothÏteachers,€had€suffered€gunshot€wounds€to€the€head€area€and€that€a€student,€DianeÏCollins,€had€been€shot€in€the€neck.€€The€weapon€used€was€a€.22€rifle.€€Officer€HeltonÏtook€Jamie€Rouse€into€custody;€the€defendant€was€not€"anywhere€around€...."€€Ì€€Ìà àAgent€Wayne€Wesson,€of€the€Tennessee€Bureau€of€Investigation,Ïinterviewed€the€defendant€twice€on€the€day€of€the€shootings.€€On€each€occasion,€theÏdefendant€provided€a€signed,€written€statement.€€At€about€1:30€P.M.,€the€defendantÏtold€Agent€Wesson€that€he€had€known€Rouse€for€about€one€and€one„half€years€andÐ Ðthat€they€had€been€good€friends.€€He€revealed€that€Rouse€liked€heavy€metal€musicÏand€was€rumored€to€be€a€Satan€worshiper.€€The€defendant€stated€that€Rouse€hadÏcarved€an€inverted€cross€on€his€forehead€once€before,€always€wore€black,€and€hadÏpreviously€shaved€his€head.€€The€defendant€recalled€that€the€evening€before€theÏshootings,€Rouse€had€said€that€he€was€tired€of€school€and€wanted€to€quit.€€He€toldÏAgent€Wesson€that€on€the€day€of€the€shooting,€Rouse€called€the€defendant€andÏinformed€him€he€would€pick€him€up€for€school€early.€€They€arrived€at€school€atÏapproximately€7:55€A.M.€and€Rouse€left€his€truck€armed€with€a€.22€rifle.€€TheÏdefendant€claimed€that€he€called€out€to€Rouse,€who€did€not€respond€but€proceeded€Ïinto€the€school.€€The€defendant€stated€that€Rouse€attempted€to€fire€his€weapon€atÏMs.€Foster,€but€the€safety€was€in€place.€€He€recalled€that€Rouse€lowered€the€gun,Ïdisabled€the€safety,€and€fired€at€Ms.€Foster€again€and€then€fired€at€Ms.€Yancy.€€TheÏdefendant€claimed€that€he€then€left€the€area€and€heard€one€or€two€more€shots.€€HeÏasserted€that€he€knew€nothing€about€Rouse's€intentions€and€had€not€noticed€the€rifleÏin€the€vehicle.ÌÌà àIn€a€second€statement,€provided€at€6:15€P.M.€on€the€day€of€theÏmurders,€the€defendant€revealed€that€he€and€Rouse€wanted€to€quit€school€becauseÏthey€did€not€"fit€in."€€He€acknowledged€that€on€the€night€before€the€shooting,€RouseÏtalked€about€killing€a€trooper€who€had€given€him€a€ticket€and€killing€Tina€Mueller,Ïsomeone€with€whom€he€had€argued.€€He€told€Agent€Wesson€that€when€RouseÏasked€if€he€wanted€to€help,€he€responded,€"I€don't€know."€€The€defendant€alsoÏrecalled€Rouse€saying€"he€was€going€to€take€care€of€Shirey€and€Hobbs."€€WhenÏRouse€asked€if€he€would€help,€the€defendant€"laughed€and€said,€yeah."€€TheÏdefendant€explained€that€he€did€not€really€believe€Rouse€would€follow€through€on€theÏthreats.€€The€defendant€acknowledged€that€he€saw€the€rifle€when€he€got€into€theÏtruck.€€He€recalled€Rouse,€who€had€a€"brick€of€shells,"€said,€"it's€going€to€happenÐ àSeveral€witnesses€testified€for€the€defense.€€Thomas€Ray,€StephenÏRay's€father,€was€a€character€witness€for€the€defendant.€€He€described€theÏdefendant€as€"[e]ven„tempered€...€[an€a]verage€teen„ager€and€a€good€boy."€€RickÏPitts,€the€defendant's€supervisor€at€the€Delta€Express,€described€the€defendant€asÏan€above€average€employee€and€recalled€that€the€defendant€was€very€upset€overÏthe€shootings,€a€"nervous€wreck."€€He€remembered€that€the€defendant€was€unableÏto€control€his€emotions€and€had€"held€his€head€down€between€his€hands,€and€stoodÏthere€and€shook."ÌÌà Œ àà ä àJames€Nichols,€an€agricultural€education€instructor€at€Richland€High,Ïtestified€at€the€Juvenile€Transfer€Hearing.€€He€remembered€seeing€Rouse€fire€hisÐ 8¸.4 Ðrifle€toward€Coach€Shirey€and€grabbing€the€barrel€of€the€rifle€in€an€effort€to€take€itÏaway€from€Rouse.€€During€the€struggle,€a€shot€was€accidentally€fired€into€the€ceiling.€ÏWhen€Nichols€ordered€Rouse€to€surrender€the€gun,€Rouse€responded,€"I€can't.€€I'veÏwent€too€far."€€Nichols€and€several€others€were€able€to€take€the€gun€from€Rouse.€€ÌÌà Œ àà ä àThe€defendant,€who€was€seventeen€years€old€when€the€shootingsÏoccurred,€was€a€senior€at€the€school€and€worked€at€Delta€Express.€€He€had€plannedÏto€enlist€in€the€Navy€after€school€and€had€scored€in€the€upper€ten€percent€on€theÏArmed€Service€Vocational€Aptitude€Battery€Test.€€He€testified€that€he€had€befriendedÏRouse€in€his€sophomore€year€and€had€often€heard€Rouse€threaten€to€kill€people€butÏhad€never€before€known€him€to€carry€out€any€of€the€threats€or€violence€againstÏanyone.ÌÌà Œ àà ä àHe€recalled€that€on€the€evening€before€the€shooting,€Rouse,€who€wasÏnot€on€duty€at€the€time,€stopped€by€Delta€Express€to€exchange€a€compact€discÏplayer.€€He€remembered€that€Rouse€had€threatened€to€kill€Tina€Mueller€and€hadÏsought€his€help.€€The€defendant€claimed€that€he€responded,€"I€don't€know"€and€thenÏlaughed€because€he€did€not€think€Rouse€was€serious.€€The€defendantÏacknowledged€telling€Billy€Rogers,€"If€there€is€a€God,€I€hope€it€snows€tomorrow."€ÏWhile€conceding€that€he€had€said€to€Rogers€that€he€was€going€to€lose€a€couple€ofÏfriends,€he€did€not€think€anyone€was€going€to€get€killed€but€only€that€some€type€ofÏfight€would€occur.ÌÌà Œ àà ä àHe€testified€that€on€the€morning€of€the€shooting,€Rouse€had€called€toÏsay€that€he€would€pick€him€up€a€little€early.€€When€he€got€in€Rouse's€truck,€theÏdefendant€saw€the€gun€and€shells€in€the€seat.€€He€testified€that€he€asked€about€theÏweapon€and€Rouse€responded,€"It's€going€to€happen€today."€€Along€the€way,€RouseÐ 8¸.4 Ðstopped€to€purchase€a€drink€and€a€candy€bar€and€then€drove€to€Steve€Ray's€home.€ÏRay€came€to€the€truck€and€asked€about€the€weapon;€Rouse€responded€it€was€forÏ"Hobbs,€and€whoever€gets€in€the€way."€€The€defendant€testified€that€he€agreed€withÏRay,€who€said,€"You're€crazy."€€ÌÌà Œ àà ä àThe€defendant€testified€that€he€then€agreed€to€Rouse's€request€that€heÏdrive.€€He€described€the€request€as€not€unusual€because€he€had€driven€the€truckÏseveral€times€previously.€€He€explained€that€he€agreed€to€drive€because€he€had€notÏdriven€in€a€while,€as€his€own€truck€was€"broke€down."€€The€defendant€recalled€thatÏRouse€placed€the€weapon€in€his€lap€and€said,€"now€he€can€shoot€the€cop€in€front€ofÏthe€school."€€The€defendant€explained€that€he€thought€Rouse€was€joking,€butÏconceded€that€he€was€a€little€worried€about€Rouse's€behavior.€€He€testified€thatÏwhen€he€parked€the€truck,€Rouse€got€out€fast€and€walked€toward€the€school€withoutÏwaiting.€€The€defendant€yelled€three€or€four€times€at€Rouse,€who€did€not€respond.€ÏThe€defendant,€who€had€no€recollection€of€Rouse€loading€the€rifle,€recalled€thatÏRouse€fired€at€Ms.€Foster€and€Ms.€Yancy€and€continued€to€walk€down€the€hall.€€TheÏdefendant,€who€insisted€he€did€not€help€plan€the€shootings€and€had€no€intent€ñÚñœñÚñtoÌharmñÚñ›ñÚñ€anybody,€stated€that€he€left€the€school€grounds€with€Ray.ÌÌà àPerry€Gammons€testified€for€the€state€in€rebuttal.€€He€claimed€that€theÏmorning€of€the€shootings,€he€had€seen€the€defendant€and€Rouse€talk€near€the€frontÏof€Rouse's€truck€and€then€walk€side€by€side€toward€the€school.€Ì€€€€€€€€€€¹Ó àNext,€the€defendant€claims€that€the€juvenile€court€erred€by€transferringÏhim€to€circuit€court€to€be€tried€as€an€adult.€€He€argues€that€he€had€the€ability€andÏpredisposition€to€benefit€from€rehabilitation€and€did€not€require€such€a€transfer.€€ÌÌà Œ àà ä àMuch€of€the€proof€at€the€transfer€hearing€mirrored€the€proof€at€trial.€ÏThe€night€before€the€shootings,€the€defendant€and€Rouse€abruptly€ended€a€privateÏdiscussion€when€co„worker€Rachel€Warren€approached€them.€€The€defendant€toldÏRouse€they€would€discuss€the€matter€later.€€The€defendant€told€the€police€thatÏRouse€had€discussed€shooting€Tina€Mueller,€a€student,€Shirey,€a€teacher,€andÐ þ8ž/5 ÐPrincipal€Hobbs.€€When€asked€if€he€wanted€to€help,€the€defendant€responded€in€theÏaffirmative.€€On€the€day€before€the€shootings,€the€defendant€informed€Billy€RogersÏthat€he€was€about€to€lose€a€couple€of€friends.€€The€defendant€drove€the€truck€toÏschool.€€ÌÌà Œ àà ä à€The€defendant€presented€several€witnesses€on€his€behalf.€€Dr.ÏKenneth€Anchor,€a€clinical€psychologist,€testified€that€he€examined€the€defendantÏand€found€he€"did€not€demonstrate€the€typical€juvenile€delinquent€or€juvenileÏoffender€profile."€€Dr.€Anchorððs€overall€interpretation€of€various€psychological€testsÏ¢£was€as€follows:ÌÒXÒÒä 4ÒÓÓThis€is€a€young€man€who€is€not€confident.€€He€does€notÏenjoy€good€self„esteem.€€He€has€a€great€deal€ofÏproblems€living;€problems€in€relationships.€...€€And€theÏbottom€line,€here€is€this€is€somebody€who€is€very€much€inÏneed€of€¢mental€health£€resources€or€services.ÌÌÒ4ä ÅÒÒX·ÒÓÓÓIt€was€Dr.€Anchor's€opinion€that€the€defendant€would€benefit€greatly€from€treatment:Ï"I€believe€he€has€sufficient€intellect€to€benefit€from€it.€€I€believe€he€would€beÏcooperative€and€motivated€...€to€restore€himself€...€€I€think€the€prognosis€isÏfavorable."ÌÌà Œ àà ä àThe€defendant's€mother,€Donna€Abbott,€testified€that€her€son€hadÏnever€caused€the€family€any€difficulties,€always€having€helped€with€householdÏchores.€€She€testified€that€he€also€helped€financially,€having€worked€the€past€oneÏand€one„half€years.€€Because€the€defendant's€father€was€disabled,€the€family€relied,Ïin€part,€on€the€defendant's€income.€€Ms.€Abbott€described€her€son€as€active€inÏschool.ÌÌà Œ àà ä àThe€defendant's€father,€Don€Abbott,€testified€that€the€defendant€hadÏbeen€working€with€him€and€another€son€to€start€a€pallet€recycling€business.€€HeÐ 8¸.4 Ðstated€that€he€and€his€sons€had€begun€construction€of€a€building,€collected€pallets,Ïand€had€purchased€a€truck€and€office€equipment.€€He€described€the€defendant€asÏhaving€a€strong€interest€and€ability€in€mechanics€and€electronics.€€ÌÌà Œ àà ä àMorris€Mitchell,€a€counselor€at€Richland€High€School,€testified€that€theÏdefendant€scored€well€above€average€on€various€proficiency€tests€and€collegeÏadmission€tests.€€He€stated€that€the€defendant€also€scored€well€on€the€ArmedÏService€Vocational€Aptitude€Battery.ÌÌà Œ àà ä àSection€37„1„134,€Tenn.€Code€Ann.,€provides€for€a€transfer€fromÏjuvenile€court€to€circuit€court€under€the€following€circumstances:ÌÒXÒÒä 4ÒÓÓThe€disposition€of€the€child€shall€be€as€if€the€child€wereÏan€adult€if:ÌÌÓ  Ó***ÌÓ±˜ÓÌ(4)€The€court€finds€that€there€are€reasonable€grounds€toÏbelieve€that:ÌÌ(A)€The€child€committed€the€delinquent€act€as€alleged;Ì(B)€The€child€is€not€committable€to€an€institution€for€theÏmentally€retarded€or€mentally€ill;€andÌ(C)€The€interests€of€the€community€require€that€the€childÏbe€put€under€legal€restraint€or€discipline.ÌÌ(b)€In€making€the€determination€required€by€subsectionÏ(a),€the€court€shall€consider,€among€other€matters:ÌÌ(1)€The€extent€and€nature€of€the€child's€prior€delinquencyÏrecords;Ì(2)€The€nature€of€past€treatment€efforts€and€the€nature€ofÏthe€child's€response€thereto;Ì(3)€Whether€the€offense€was€against€person€or€property,Ïwith€greater€weight€in€favor€of€transfer€given€to€offensesÏagainst€the€person;Ì(4)€Whether€the€offense€was€committed€in€an€aggressiveÏand€premeditated€manner;€andÌ(5)€The€possible€rehabilitation€of€the€child€by€use€ofÏprocedures,€services€and€facilities€currently€available€toÏthe€court€in€this€state.ÌÌÒ4ä àThere€is€an€area€here€concerning€Mr.€Abbott€thatÏneeds€looking€into€by€a€jury€of€his€peers.€€I've€listened€asÏopen„mindedly€as€I€can,€with€his€young€man's€wholeÏproblem€in€mind.€€But€I€think€that€there€is€enoughÏinvolvement€here€that€it€should€be€dealt€with€in€a€differentÏsetting.Ìà < àThere€certainly€was€time€to€reflect,€and€to€do€otherÏthings,€than€what€transpired€this€morning€of€this€tragicÏevent.€€And€all€of€the€activities,€leading€up€to€it€that'sÏbeen€testified€to€by€these€other€witnesses,€leave€me€withÏa€real€bad€feeling€about€this€situation€involving€this€youngÏman;€that€he€had€the€opportunity€to€have€disengagedÏhimself€from€this€entire€scenario,€but€he€didn't€do€it.Ìà < àSo€I'm€going€to€transfer€him,€also.ÌÌÒ4ä kÒÒX]ÒÓyÓÌà Œ àà ä àAbout€a€week€later,€the€court€entered€a€written€order€ruling€as€follows:ÌÒXÒÒä 4ÒÓÓà < àThe€juvenile€concerned,€Stephen€John€Abbott,Ïhas€been€charged€with€crimes€involving€the€loss€ofÏhuman€life,€and€the€Court€has€found€that€there€areÏreasonable€grounds€to€believe€that€he€committed€theseÏacts.€€The€evidence€shows€that€the€acts€were€committedÏin€an€aggressive€and€premeditated€manner.€€The€juvenileÏis€17€years€of€age,€and€he€will€be€18€in€a€few€weeks.€€AsÏthis€Court€has€means€of€dealing€with€a€child€only€up€toÏhis€nineteenth€birthday,€the€possibility€of€rehabilitation€inÏa€case€of€this€seriousness€is€not€good.ÌÌÒ4ä $¡ÒÒX¡ÒÓ2¡Óà Œ àà ä àÌà Œ àà ä àAt€the€time€of€the€transfer,€there€were€reasonable€grounds€to€believeÏthe€defendant€had€committed€the€alleged€acts.€€òòSeeóó€Tenn.€Code€Ann.€ðð€37„1„Ð „+$"& Ð134(4).€€The€state€presented€proof€which€would€allow€the€trial€judge€to€conclude€theÏdefendant€discussed€the€shootings€with€Rouse€the€night€before€and€then€drove€theÏtruck€to€the€school€the€next€day€to€execute€the€plan.€€There€is€also€a€reasonableÏbasis€to€believe€the€defendant€is€not€committable€to€an€institution€for€the€mentallyÏretarded€or€mentally€ill.€€òòId.óó€€Finally,€given€the€gravity€of€the€offenses,€there€is€aÐ €4 +0 Ðreasonable€basis€for€concluding€the€defendant€needed€to€be€"put€under€legalÏrestraint."€€òòId.óó€€Ð 8¸.4 Їà Œ àà ä àThat€the€defendant€did€not€have€a€prior€criminal€background€weighs€inÏhis€favor.€€The€offenses€involved,€however,€were€"against€the€person"€and€wereÏ"committed€in€an€aggressive€and€premeditated€manner."€€òòId.óó€€While€the€defendantÐ ø ˜ Ðoffered€persuasive€evidence€that€the€acts€were€out€of€character€and€that€he€couldÏbenefit€from€psychological€treatment,€the€transfer,€in€our€view,€was€appropriate.ÌÌÓ  Ó(5)à @Œ àÌÓn¨Óà Œ àà ä àThe€defendant€also€claims€the€juvenile€court€erred€in€consolidating€hisÏtransfer€hearing€with€that€of€his€co„defendant€Rouse.€€He€asserts€that€the€"veryÏnature€of€a€transfer€hearing€[requires]€individual€attention"€and€complains€that€theÏconsolidation€of€his€transfer€hearing€with€Rouse€violated€due€process€principles.€ÏThe€state€argues€that€the€defendant€has€failed€to€show€prejudice€by€virtue€ofÏconsolidation€of€the€cases.€€ÌÌà Œ àà ä àWe€agree€with€the€state.€€The€defendant€has€not€explained€how€hisÏdue€process€rights€have€been€violated,€other€than€the€complaint€that€he€has€notÏreceived€individualized€treatment.€€Yet€the€record€does€not€support€his€claim€that€heÏwas€deprived€of€individual€attention.€€The€orders€indicate€consideration€of€theÏcircumstances€of€each€juvenile.€€Both€were€afforded€the€opportunity€to€cross„¼examine€the€state's€witnesses€and€to€put€on€their€own€evidence.€€Rule€1(d),€Tenn.€R.ÏJuv.€P.,€provides€that€where€"no€specific€procedure€is€prescribed€by€the€rules,€theÏcourt€may€proceed€in€any€lawful€manner,€in€accordance€with€written€local€rules€ofÏcourt,€which€shall€not€be€inconsistent€with€these€rules€or€with€any€other€applicableÏlaw."€€Obviously€the€trial€judge€complied€with€the€statutory€requirement€that€theÏdefendant€be€afforded€a€hearing€to€determine€the€appropriateness€of€the€transfer.€ÏòòSeeóó€Tenn.€Code€Ann.€ðð€37„1„134.€€A€consolidation,€when€the€crimes€and€the€factsÐ L6ì,2 Ðand€circumstances€arise€out€of€the€same€incident,€is€not€"inconsistent"€with€theÐ 8¸.4 Ðstatute.Ì€€ÌÓ  Ó(6)à @Œ àÌÓÑ®Óà Œ àà ä àThe€defendant€also€claims€the€trial€court€erred€by€overruling€his€motionÏto€suppress€a€statement€he€gave€while€in€custody€because€he€had€not€been€advisedÏof€his€òòMirandaóó€rights.€€On€the€date€of€the€shootings,€the€defendant€provided€twoÐ \ü  Ðsigned€statements€which€were€admitted€into€evidence€through€the€testimony€ofÏOfficer€Chapman;€neither€has€been€challenged€in€this€appeal.€€The€following€day,ÏOfficer€Chapman€asked€the€defendant€if€he€knew€about€Rouse's€plan€to€shoot€theÏofficer€who€directed€traffic€in€the€front€of€the€school.€€The€defendant€responded€thatÏhe€learned€about€the€plan€only€after€he€undertook€to€drive€the€truck€to€school.€ÏBased€on€this€response,€Officer€Chapman€provided€òòMirandaóó€warnings€and€turned€onÐ $Ä Ðthe€tape€recorder.€€The€defendant€then€gave€a€fourth€lengthy€statement.€€The€trialÏcourt€suppressed€the€fourth€statement€because€the€defendant€requested€anÏattorney€after€the€warning€was€given€but€officers€continued€to€take€the€statement.€ÏThe€statement€at€issue€is€the€third€statement€the€defendant€made€before€anyÏòòMirandaóó€warnings€were€given.€€€€Ð  &À  ÐÌà Œ àà ä àOfficer€Chapman€testified€that€after€the€shootings,€he€learned€fromÏother€sources€that€the€defendant€drove€the€truck€to€the€school€and€that€there€hadÏbeen€a€plan€to€shoot€the€officer€who€worked€in€front€of€the€school.€€The€day€after€theÏshootings,€he€called€the€defendant's€mother€and€told€her€he€had€"two€questions"€heÏwanted€to€ask.€€When€the€defendant's€parents€brought€him€to€the€station,€OfficerÏChapman€did€not€give€any€òòMirandaóó€warnings.€€Instead,€explained€that€he€wanted€toÐ ´2T). Ðtalk€about€two€issues:€first,€whether€there€was€a€plan€to€shoot€the€police€officer€thatÏworks€in€front€of€the€school;€and,€second,€whether€the€defendant€was€driving.€€TheÏdefendant€responded€by€saying€he€did€not€learn€about€the€plan€to€shoot€the€officerÐ 8¸.4 Ðuntil€after€he€took€the€steering€wheel€of€Rouse's€truck.€€It€was€at€this€point€that€theÏofficer€turned€on€the€tape€recorder€and€gave€òòMirandaóó€warnings.€€Ð , Ì ÐÌà Œ àà ä àThe€officer€insisted€that€the€defendant€was€not€in€custody€at€that€time,Ïwas€not€under€any€restraint,€and€had€been€brought€to€the€station€by€his€parents€on€aÏvoluntary€basis.€€When€asked€whether€the€officer€intended€to€let€the€defendantÏleave,€the€officer€answered,€"After€these€statements€were€completed,€I€had€to€callÏthe€District€Attorney's€office€to€see€where€we€were€as€far€as€any€kind€of€charges.€ÏThat€took€some€time.€€It€was€my€intention€that€they€be€allowed€to€go....€€The€SheriffÏoverruled€that."€€When€asked€whether€he€told€the€defendant€and€his€parents€theyÏwere€free€to€leave,€the€officer€responded,€"Yes.€€I€told€them€they€could€go.€€TheyÏwanted€to€stay€until€they€heard€the€results€of€what€the€District€Attorney's€officeÏdecided,€as€to€whether€there€would€be€any€criminal€charges€or€not."€€ÌÌà Œ àà ä àThe€trial€court€denied€the€motion€to€suppress,€ruling€as€follows:ÌÒXÒÒä 4ÒÓÓà < àTo€take€òòMirandaóó€to€the€extreme,€everybody€whoÐ T$ô Ðwas€interrogated€would€have€to€be€mirandized.Ìà < àThe€question€„„€and€it€is€a€thin„line€question,€here€„¼„€is€whether€or€not€Mr.€Abbott€had€become€the€focus€ofÏthe€investigation.€...Ìà < àAt€what€point€did€he€independently€become€theÏfocus€of€a€criminal€investigation€involving€him?€€That€isÏthe€question€that€has€to€be€answered€in€order€to€make€aÏdetermination€of€whether€statement€number€three,€...Ïwhich€is€the€oral€statement€immediately€preceding€theÏtaped€statement,€is€to€be€suppressed.Ìà Ð928€S.W.2d€18,€22€(Tenn.€1996).€€In€this€instance,€however,€the€trial€court's€findingÏand€ruling€focused€on€whether€the€investigation€had€moved€to€the€accusatory€stage;Ïthe€trial€court€did€not€address€whether,€"under€the€circumstances,€a€reasonableÏperson"€would€have€"considered€himself€...€deprived€of€freedom€of€movement€to€aÏdegree€associated€with€a€formal€arrest."€€òòAndersonóó,€937€S.W.2d€at€855.€€BecauseÐ ì'Œ" ÐòòAndersonóó€was€filed€several€months€after€the€suppression€hearing€in€this€case,€theÐ ¸)X $ Ðtrial€court€did€not€have€the€benefit€of€the€opinion€at€the€time€of€the€ruling.€€For€aÏdifferent€reason€than€that€articulated€by€the€trial€court,€we€conclude€the€defendantÏwas€not€in€custody€and€thus€not€entitled€to€òòMirandaóó€warnings.€€Ð /¼%* ÐÌà Œ àà ä àThe€questioning€occurred€at€the€police€station,€but€was€brief.€€There€isÏno€indication€that€the€method€of€inquiry€was€overly€confrontational.€€There€is€noÏproof€as€to€the€officer's€tone€of€voice€or€his€general€demeanor.€€The€defendant€andÏhis€parents€voluntarily€traveled€to€the€station.€€There€were€few€officers€present,€noÐ 8¸.4 Ðrestraint€on€the€defendant's€movement€during€questioning,€and,€most€significantly,Ïthe€defendant€and€his€parents€were€informed€that€they€were€free€to€leave.€€TheÏdefendant's€parents€chose€to€stay€to€learn€whether€the€District€Attorney's€officeÏintended€to€prosecute.€€In€our€assessment,€the€trial€court€did€not€err€by€overrulingÏthe€motion€to€suppress.ÌÌÓ  Ó(7)à @Œ àÌÓhÑÓà Œ àà ä àThe€defendant€argues€the€trial€court€erred€by€refusing€to€strike€certain€Ïprospective€jurors€for€cause.€€He€specifically€complains€about€prospective€jurorsÏThomas€Gatlin,€Lisa€Edwards,€and€William€Davis.€€€€ÌÌà Œ àà ä àThe€defendant€complains€that€prospective€juror€Thomas€Gatlin€shouldÏhave€been€excused€for€cause€because€he€indicated€he€would€like€to€see€theÏdefendant€testify.€€Gatlin€indicated€that€he€had€heard€about€the€case€and€"had€anÏopinion."€€The€trial€court€asked€if€he€could€"overcome€that€opinion€and€follow€theÏcharge€of€the€judge€and€follow€the€evidence€in€the€case."€€Gatlin€respondedÏaffirmatively.€€Defense€counsel€asked€if€it€would€be€necessary€for€the€defendant€toÏtestify€in€order€for€him€"to€decide€this€case."€€Gatlin€responded,€"After€hearing€whatÏthey€say,€yes,€I€would€have€to€hear€it";€but€he€also€indicated€that€if€the€defendant€didÏnot€testify,€he€would€not€hold€it€"against€him."€€When€defense€counsel€moved€toÏstrike€Gatlin€for€cause,€the€trial€court€responded€as€follows:ÌÒXÒÒä 4ÒÓÓCounsel,€you€are€assuming€that€the€prospective€jurorÏknows€the€law€in€phrasing€the€question€that€way.€€AÏdefendant€does€not€have€to€testify,€as€a€matter€of€law.€ÏHe€has€a€perfectly€valid€right€not€to€testify,€and€the€CourtÏwill€instruct€you€in€the€law€that€if€he€does€choose€not€toÏtestify,€neither€the€Judge€nor€the€jury€can€draw€anyÏinference€against€him€simply€because€he€did€not€testify.€ÏNow,€that€is€not€a€matter€of€fact.€€That€is€...€a€matter€ofÏlaw,€which€the€court€will€charge€to€you€at€the€end€of€theÏcase.€€Challenge€for€cause€is€denied.ÌÌÒ4ä àThe€defendant€claimed€that€the€first€time€Rouse€asked€for€his€help,€heÏprovided€an€equivocal€answer.€€He€stated€that€on€the€second€occasion€Rouse€askedÏfor€help,€he€responded,€"Yeah,"€and€laughed„„implying€that€he€did€not€take€theÏquestion€seriously.€€That€the€defendant€responded€"yeah"€and€laughed€could€meanÏhe€earnestly€desired€to€assist€in€the€crimes.€€It€could€be€interpreted€as€a€refusal€toÏaccept€the€request€as€seriously€made.€€The€jury€must€be€given€the€option€ofÏdetermining€which€interpretation€to€attach.€€The€first€interpretation€would€support€theÏconvictions.€€The€second€would€have€supported€an€instruction€on€the€lesser€offense.€ÌÐ àJudy€McKenna€testified€for€the€defendant€that€she€was€a€family€friendÏof€the€Abbott's.€€The€defendant€worked€for€a€time€with€her€husband€at€a€truck€stopÏand€was€never€paid€for€his€help.€€The€defendant€was€trustworthy,€polite,€and€a€hardÏworker.€€E.N.€Bentley€testified€that€he€was€the€manager€at€the€Delta€Express€whenÏthe€defendant€worked€there.€€He€was€an€above€average€worker€and€always€receivedÏa€very€positive€rating€on€his€performance€appraisal.€€ÌÌà Œ àà ä àDonna€Abbott,€the€defendant's€mother,€testified€that€the€defendant€wasÏin€his€senior€year€of€high€school€when€the€shootings€occurred.€€Because€herÏhusband€is€disabled,€the€family€is€on€a€limited€income.€€The€defendant€helped€"makeÏends€meet"€by€contributing€financially€to€the€family.€€The€defendant€also€helped€outÏaround€the€home.€€The€defendant€is€very€close€to€his€brothers€and€they€had€all€beenÏworking€together€to€start€a€pallet€business.€€ÌÌà Œ àà ä àThe€defendant€testified€that€he€was€sorry€the€shootings€had€occurred.€ÏHe€contended€that€if€he€had€believed€Rouse,€he€would€have€"stopped€himÏsomehow."€€ÌÌà Œ àà ä àThe€testimony€at€the€juvenile€transfer€hearing€concerning€theÏdefendant's€above€average€academic€record€and€his€potential€for€rehabilitationÏthrough€psychological€treatment€was€entered€into€evidence€at€the€sentencingÏhearing.€€€€€€€€ÌÌà Œ àà ä àThe€trial€court€applied€the€following€enhancement€factors:€€ÌÒXÒÒä Ðrejected€all€of€these.€€The€latter€three€mitigating€factors€were€offered€under€Tenn.ÏCode€Ann.€ðð€40„35„113(13),€which€allows€consideration€of€any€"factor€consistentÏwith€the€purposes€of€this€chapter."€€The€trial€court€found€they€were€not€mitigatingÏcircumstances.€€€€ÌÌà Œ àà ä àIn€our€view,€the€trial€court€correctly€ruled€that€there€is€no€proof€that€theÏdefendant€acted€under€strong€provocation.€€We€also€agree€there€was€no€proof€theÏdefendant€played€a€"minor€role."€€If€the€defendant€drove€Rouse€to€school€to€assist€inÏthe€shootings,€that€conduct€would€not€qualify€as€a€minor€role.€€The€trial€court€ruledÏthat€there€was€no€proof€that€the€defendant€lacked€substantial€judgment€due€to€hisÏyouth.€€While€seventeen€years€of€age,€the€defendant€qualifies€as€youthful,€but€thereÏwas€much€positive€testimony€about€his€level€of€maturity€and€his€degree€ofÏresponsibility.€€There€was€no€proof€he€lacked€substantial€judgment.€€We€furtherÏagree€that€there€was€no€proof€that€the€defendant€did€not€possess€a€sustained€intentÏto€violate€the€law.€€The€crimes€were€discussed€the€night€before.€€The€next€day€theyÏwere€executed.€€These€facts€suggest€a€sustained€intent€to€violate€the€law.€€ThereÏwas€also€no€proof€that€the€defendant€acted€under€the€duress€or€domination€ofÐ 8¸.4 Ðanother€person.€€While€there€was€proof€that€Rouse€developed€the€plan,€there€is€noÏevidence€he€coerced€the€participation€of€the€defendant.ÌÌà Œ àà ä àIn€our€view,€the€three€nonstatutory€mitigating€circumstances€areÏentitled€to€some€weight.€€Balanced€against€the€weight€of€the€enhancement€factors,Ïhowever,€the€sentences€imposed€by€the€trial€would€remain€unchanged.€€TheÏsentences€are€appropriate,€given€the€weight€of€the€enhancement€factors.€€TheÏsentence€for€attempted€second€degree€murder€was€enhanced€by€two€years.€€In€ourÏview,€however,€the€enhancement€was€warranted,€if€for€no€other€reason,€because€theÏcrime€was€committed€on€school€property.ÌÌ€à Œ àà ä àWe€now€turn€to€the€appropriateness€of€ordering€two€of€the€twenty„yearÐ $Ä Ðsentences€to€be€served€consecutively€for€an€effective€forty„year€term.€€Prior€to€theÏenactment€of€the€Criminal€Sentencing€Reform€Act€of€1989,€the€limited€classificationsÏfor€the€imposition€of€consecutive€sentences€were€set€out€in€òòGray€v.€Stateóó,€538Ð ˆ"( ÐS.W.2d€391,€393€(Tenn.€1976).€€In€that€case€our€supreme€court€ruled€thatÏaggravating€circumstances€must€be€present€before€placement€in€any€one€of€theÏclassifications.€€Later,€in€òòState€v.€Tayloróó,€739€S.W.2d€227€(Tenn.€1987),€the€courtÐ ì'Œ" Ðestablished€an€additional€category€for€those€defendants€convicted€of€two€or€moreÏstatutory€offenses€involving€sexual€abuse€of€minors.€€There€were,€however,Ïadditional€words€of€caution:€€"[C]onsecutive€sentences€should€not€routinely€beÏimposed€.€.€.€and€.€.€.€the€aggregate€maximum€of€consecutive€terms€must€beÏreasonably€related€to€the€severity€of€the€offenses€involved."€€òòTayloróó,€739€S.W.2d€atÐ è0ˆ', Ð230.€€The€Sentencing€Commission€Comments€adopted€the€cautionary€language.€ÏTenn.€Code€Ann.€ðð€40„35„115.€€The€1989€Act€is,€in€essence,€the€codification€of€theÏholdings€in€òòGrayóó€and€òòTayloróó;€consecutive€sentences€may€be€imposed€in€theÐ ô”  Ðfactual€guidelines€for€consecutive€sentencing€adopted€in€òòState€v.€Woodsóó,€814Ð À`
