InOctober1989,theappellantpledguiltytorobberywithadeadlyweapon.TheoffenseoccurredinApril1982.HewassentencedtotenyearsintheDepartmentofCorrection.Theappellantalsopledguiltytoaidingandabettingseconddegreemurder.Hewassentencedtotenyears,torunconcurrentlywithhissentenceforrobberywithadeadlyweapon.TheappellantbeganservinghissentenceinApril1990.HeescapedfromcustodyinSeptember1991.HewasreturnedtocustodyinApril1994.Theappellantwassentencedtooneyearforescape,torunconsecutivelytohistwotenyearsentences. InJanuary1997,theappellantfiledapetitionforhabeascorpusrelief,allegingthathissentenceshadexpired.Theappellantarguedthatbothofhistenyearsentencesexpiredatthesametimebecausethecourtorderedthesentencestorunconcurrently.Theappellantalsoarguedthathethoughtthathewaspleadingguiltytothelesserincludedoffenseofarmedrobbery,notrobberywithadeadlyweapon.Hefurtherallegedthatwhenhepledguilty,hewasunawarethatarmedrobberywasaClassXfelony. Afterahearing,thecourtdismissedthepetition.Thecourtfoundthattheappellantssentenceforaidingandabettingseconddegreemurderhadexpiredbecauseofsentencingcredits.ThecourtfoundthattheappellantsconvictionofrobberycommittedwithadeadlyweaponwasaClassXfelony.ThecourtfoundthattheapplicablelawrequiredadefendantwhowasconvictedofaClassXfelonytoservehissentencedayforday.Thecourtfurtherfoundthatsincetheappellantpledguiltyin1989,histenyearsentencehadnotexpired.Withregardtotheappellantsclaimthathethoughtthathewaspleadingguiltytosomethingotherthanrobberywithadeadlyweapon,thecourtheldthatthevoluntarinessoftheappellantsguiltypleawasnotacognizablehabeascorpusclaim.Weaffirmthejudgmentofthetrialcourtinallrespects. Habeascorpusreliefisavailableonlywhenitappearsuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentisrenderedthataconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendant'ssentenceofimprisonmentorotherrestrainthasexpired.Archerv.State,851S.W.2d157,164(Tenn.1993). TheappellantcommittedrobberywithadeadlyweaponinApril1982.Underthestatutesineffectatthetimeoftheoffense,robberywithadeadlyweaponwasaClassXfelony.Tenn.CodeAnn.393901(c)(Supp.1981).AsentenceforaClassXfelonyisnotsubjecttoreductionforanytypeofsentencingcredit.Tenn.CodeAnn.395403(2)(Supp.1981).Thesentenceisnotsubjecttoearlyrelease.Thesentenceexpiresonlyafterserviceoftheentiresentencedayforday.Tenn.CodeAnn.395403(3). Asthestateargues,theappellantssentenceforrobberycommittedwithadeadlyweapondoesnotexpirewithhistenyearsentenceforaidingandabettingseconddegreemurderbecausetherobberysentencemustbeserveddayforday.Theappellantpledguiltytoarmedrobberyin1989.Fromthefaceoftheconviction,tenyearshadnotelapsedwhenhefiledhispetitionin1997.Hissentencehadnotexpired.Moreover,theappellantescapedforovertwoandonehalfyears. Whethertheappellantvoluntarilypledguiltytorobberycommittedwithadeadlyweaponisnotacognizablehabeascorpusclaim.Archer,851S.W.2dat16264. Theappellantisproceedingproseonappeal.Wehavecarefullyconsideredhisappellatebrief.Wefindnomerittotheappellantsclaimthathisrightsagainstexpostfactolawshavebeenviolated.Inthiscase,suchaclaimisnotacognizablehabeascorpusclaim,norishisclaimthattheDepartmentofCorrectionmiscalculatedhissentenceinviolationofthelaw.
