App.1991). `  ` Adefendantwho isanespeciallymitigatedorstandardoffenderconvictedofaClassC,D,orEfelonyispresumedtobeafavorablecandidateforalternativesentencingoptionsintheabsenceofevidencetothecontrary.Tenn.CodeAnn.4035102(6).Oursentencinglawalsoprovidesthat convictedfelonscommittingthemostsevereoffenses,possessingcriminalhistoriesevincingacleardisregardforthelawsandmoralsofsociety,andevincingfailureofpasteffortsatrehabilitation,shallbegivenfirstpriorityregardingsentencesinginvolvingincarceration.Id.Tenn.CodeAnn.4035102(5).Thus,adefendantsentencedto p& eightyearsorlesswhoisnotanoffenderforwhomincarcerationisapriorityispresumedeligibleforalternativesentencingunlesssufficientevidencerebutsthepresumption.However,theactdoesnotprovidethatalloffenderswhomeetthecriteriaareentitledtosuchrelief;rather,itrequiresthatsentencingissuesbedeterminedbythefactsandcircumstancespresentedineachcase.SeeState  0&( v.Taylor,744S.W.2d919,922(Tenn.Crim.App.1987). 2(*  ` Additionally,theprinciplesofsentencingreflectthatthesentenceshouldbenogreaterthanthatdeservedfortheoffensecommittedandshouldbetheleastseveremeasurenecessarytoachievethepurposesforwhichthesentenceisimposed.Tenn.CodeAnn.4035103(3)(4).Thecourtshouldalsoconsider 9p02 thepotentialforrehabilitationortreatmentofthedefendantindeterminingthesentencealternative.Id.Tenn.CodeAnn.4035103(5). P   ` BecausetheDefendantwasastandardoffenderconvictedofaClassCfelony,hewaspresumedtobeafavorablecandidateforanalternativesentencingoption.ThetrialjudgegavetheDefendantthebenefitofthispresumption,sentencinghimtosplitconfinement.Seeid.Tenn.CodeAnn.4035104(c)(5).The   Defendantseeksthemorefavorablealternativeoftotalprobation.Seeid.Tenn.CodeAnn.40   35104(c)(3).Aswehavestated,theDefendanthastheburdenofestablishingsuitabilityforfullprobation,eventhoughheisentitledtothestatutorypresumptionofalternativesentencing.SeeStatev.Bingham,910S.W.2d448, ` 455(Tenn.Crim.App.1995).Thereisno brightlinerulefordeterminingwhenadefendantisentitledtofullprobation.Id.at456.Atrialjudgeisvestedwitha  @ greatdealofdiscretionontheissueofprobation.FactorstobeconsideredarewhetherprobationwillservetheendsofjusticeandthebestinterestofboththepublicandtheDefendant,thenatureandcircumstancesofthecrime,theDefendantspotentialforrehabilitation,whetherfullprobationwouldundulydepreciatetheseriousnessoftheoffense,andwhetherfullprobationwouldservetheneedtoprovideaneffectivedeterrent.SeeBinghamid.,910S.W.2dat456. @,"$  ` ThepresentencereportreflectsthattheDefendantwasalmost19nineteenyearsoldatthetimeoftheoffense.Atthetimeofsentencinghewassingleandlivedwithhismother,forwhomheprovidedsomeassistanceandsupport.HedidnotgraduatefromhighschoolbuthadobtainedhisGED.Hisemploymentrecordwasgood.Hehadnocriminalrecordasanadultandnosignificantjuvenilerecord.Hereportedthathebeganusingalcoholatabouttheageof 9p02 12twelveandhadalsousedmarijuana,cocaine,andLSD.Atthesentencinghearinghetestifiedthatithadbeenover2yearssincehehadusedanyillegaldrugs.Hestatedthathehadnointentionsofkillingthevictimanddidnotknowthathiscodefendantwasgoingtodoso.Hestatedthatbecauseofthisincidenthehadchangedhislifeandhadbecomeaveryreligiouspersonwhowasactiveinhischurch.Hehadsupportfrommembersofhischurch. ` InassessingtheDefendantssentence,thetrialjudgeexpressedhisconcernoverthenatureandcircumstancesoftheoffense,񀄄specifically,thatthiskillingwasrelatedtoadrugtransaction.ItisclearfromtherecordthatthereasontheDdefendantsapproachedthevictimwasbecausetheythoughtthevictimhadsoldthempoorqualityorcounterfeitLSD.Thecourtalsonotedthatadeathwasinvolvedandthatafirearmwasusedtocommitthecrime.ThejudgealsostatedontherecordthathedidnotbelievetheDefendantshowedtrueremorseforwhathehaddone.WeagainpointoutthatthegunusedtocommitthekillinginitiallybelongedtotheDefendant,althoughhetestifiedthatthe triggermanwasbuyingitfromhimandhadactuallyhaditinhispossessioneditfortwoorthreeweeks. ` Trialjudgesaretraditionallyvestedwithbroaddiscretionarypowersinsentencingmatters.Aswehavestated,theDefendanthastheburdenofestablishingsuitabilityforfullprobation,eventhoughheisentitledtothestatutorypresumptionofalternativesentencing.Appellatecourtsshouldnotplacetrialjudgesinajudicialstraightjacketonsentencingmatters,andweshouldbereluctanttointerferewiththeirtraditionaldiscretionarypowers.Motenv.State, 5,. 559S.W.770,773(Tenn.19977).Thetrialcourtisinamuchbetterpositiontoaccssessadefendantscredibility,feelingsofremorse,andpotentialfor 9p02 rehabilitationthananappellatecourtcandeterminefromtherecord.Fromthisrecord,wecannotconcludethatthetrialjudgeerredorabusedhisdiscretioninorderingtheDefendanttoserveaportionofhissentenceinconfinement.Thejudgmentofthetrialcourtisaffirmed. `     h   ____________________________________ `     h   DAVIDH.WELLES,JUDGECONCUR:___________________________________PAULG.SUMMERS,JUDGE___________________________________JOE.G.RILEY,JUDGE
