Theappellantwasoriginallyconvictedbyajuryofrapeandattemptingtobribeawitnessandwassentencedtoaconsecutivetermoffifteen(15)years.Inhisdirectappeal,thisCourtaffirmedappellantsconvictions,butvacatedthesentencesforfurtherproceedings.SeeStatev.MohamedF.Ali,No.03C019405CR00171(Tenn.Crim.App.atKnoxville,Sept.26,1996),perm.app.denied(Tenn.June2,1997).Weremandedthecasetothetrialcourtforadeterminationofwhethertheappellanthadaffirmativelywaivedhisrighttocounselintheposttrialproceedings.Ifnosuchfindingcouldbemadefromtherecord,thenanewsentencinghearingwastobeconducted.Seeseparateop.at56. Thereafter,theappellantfiledanapplicationforpermissiontoappealinourstatesupremecourt.ThatapplicationwasstillpendingonMarch7,1997,whenappellantfiledhisprosepetitionforawritofhabeascorpus.Appellantcontendedthathewasentitledtohabeascorpusreliefbasedupontwogrounds:(1)hissentenceshadexpiredpursuanttothisCourtsdecisionondirectappeal;and(2)hisconvictionsandsentenceswerevoidasaresultoftheallegeddenialofhisrighttocounselatthesentencinghearing.Thetrialcourtsummarilydismissedappellantspetitionuponfindingthathisapplicationforpermissiontoappealwasstillpendingbeforethesupremecourtandthatanydenialofhisrighttocounselwasnotacognizableclaimforhabeascorpus. Onappeal,theappellantchallengesthetrialcourtsdismissalofhispetitionandreassertstheabovegroundsforrelief.Hefurthercontendsthathabeascorpusisappropriateduetotheallegeddenialofhisrighttocounselatthehearingonhismotionforanewtrial. Initially,wenotethattheappellantwasseekingpermissiontoappealinoursupremecourtwhenhefiledhishabeascorpuspetition.ItiswellestablishedthatapetitionforawritofhabeascorpusorapetitionunderthePostConvictionProcedureAct,complainingofaconvictionandsentence,cannotbemaintainedwhileadirectappealofthesameconvictionandsentenceisbeingprosecuted.SeeCrainv.State,451S.W.2d695,696(Tenn.Crim.App.1969),perm.app.denied(Tenn.1970);Hunterv.State,443S.W.2d532(Tenn.Crim.App.1969),perm.app.denied(Tenn.1969).Habeascorpusmaynotbeusedasasubstituteforortoservethepurposeofanappeal.SeeStateexrel.Dawsonv.Bomar,354S.W.2d763,766(Tenn.1962),cert.denied.370U.S.962(1962). Inboththehabeascorpuspetitionandtheapplicationforpermissiontoappeal,theappellantallegedthathewasdeniedtherighttocounselduringtheposttrialhearings.Thatsimultaneouspursuitofrelieffromthesameconvictionsandsentenceswasimproperandthehabeascorpuspetitionwasproperlydismissed. Nevertheless,evenifaddressedonthemerits,appellantspetitionforawritofhabeascorpusmustfail.Acriminaldefendantisnotentitledtoawritofhabeascorpusunlessheorsheprovesbyapreponderanceoftheevidencethatthejudgmentisvoidorthetermofimprisonmenthasexpired.SeeStateexrel.Jordanv.ϜBomar,398S.W.2d724,726(Tenn.1965);Stateexrel.Kuntzv.Bomar,381S.W.2d290,291(Tenn.1964).Trialcourtsmaysummarilydismissapetitionforawritofhabeascorpusifthepetitionfailstostateacognizableclaimonitsface.SeeTenn.CodeAnn.2921109(Supp.1994). Inthiscase,appellantcontendedthathissentenceshadexpiredpursuanttothisCourtsopinioninthedirectappealandthathissentenceswerevoidfromtheallegeddenialofhisrighttocounselatthesentencinghearing.Thetrialcourtdismissedappellantspetitionuponfindingthatthe causefailstostateaclaimuponwhichreliefcanbegranted.Wefindnothingtodisturbthetrialcourtsdecision.Therecordreflectsthatappellantsapplicationforpermissiontoappealwaspendingwhenhefiledhishabeascorpuspetition.Therefore,atthattime,thisCourtsdecisioninthedirectappealwasstayedpendingfinaldispositionbythehighcourt.Tenn.R.App.P.42(b).Appellantssentenceswerenotexpired. /    Moreover,thetrialcourtcorrectlyruledthatanyinfringementofappellantsrighttocounselwasnotcognizablebyhabeascorpus.ThisCourthaspreviouslyheldthataclaimallegingineffectiveassistanceofcounselmayrenderajudgmentvoidable,butnotvoid,unlessthefaceoftherecordestablishesthatthetrialcourtdidnothavejurisdictionofthedefendant,theconvictedoffense,ortheauthoritytorenderthejudgment.SeePassarellav.State,891S.W.2d619,626(Tenn.Crim.App.1994),perm.app.denied(Tenn.1994).Similarly,adenialoftherighttocounselundertheSixthAmendmenttotheUnitedStatesConstitutionandArticleI,section9ofourstateconstitutionwouldmakethejudgmentvoidable,notvoid.
