Thesesentenceswereimposedconcurrentlytoeachotherbutconsecutivelytothesentencesincase  numberII10010.Thus,thedefendantseffectivesentencewasjustshyoftwoyears,withthefirst  60daysbeingservedinconfinement.c N#  2       t    ` Thedefendantcamebeforethecourttofaceallegationsofprobationviolationsin L  bothcasesaftertwodrugscreensrevealedthepresenceofnarcoticsinhisbody.Amonetteadmitted 8  theviolation;thus,theonlyissuebeforethecourtwastheeffectoftheviolationontheprobationary $ t sentencesoriginallyimposed.  `    ` Theevidencepresentedwasasfollows.Thedefendant,byallaccounts,faredwell  8  onprobationfromthetimeofhissentencingonFebruary28,2000,untilhefailedadrugscreenmore $  thanoneyearlateronMay23,2001.Accordingtothedefendantstestimony,hehadcompleted   drugrehabilitationtreatmentduringtheearlierportionofhisprobationarysentencebutlaterrelapsed   whenhewasnolongerattendingfollowupcare.Heclaimedthathevoluntarilysubmittedtoan   evaluationafterthepositivescreen.Hewasunabletoaffordthe30dayinpatienttreatmentprogram   recommendedforhim,soheattendedsomeNarcoticsAnonymousandCocaineAnonymous p meetingsonhisown.Nevertheless,hehadasecondpositivedrugscreenonJuly18,2001.He \ testifiedthathewasnotabletoleavehisfamilybusinessforinpatienttreatmentbecauseakey H employeehadastrokeinJuly2001.Additionally,thedefendantsgrandfatherhadundergoneheart 4 bypasssurgerythepreviousfallandwasunabletoworkinthebusinessasmuchashehadinthe  p past.Thedefendantclaimedtohavechangedthefriendswithwhomheassociatedaspartofhis  \ efforttoremainoffdrugs,buthehadbeenatapartywhensomeoneunexpectedlyhaddrugs.Hewas H enticedtousedrugsandthereafterbeganusingaboutfourtofivegramsofcocaineamonth.He 4 acknowledgedthathehadnotgonetohisprobationofficerorhisgrandfatherforassistancewithhis   drugproblem.Heclaimedthathewastooashamedofhisrelapsetoseekhisgrandfathers   assistance.     ` Thedefendantsgrandfathertestifiedthatthedefendantwasavaluedemployeeofthe  familybusiness,whichthegrandfatherowned.Hecharacterizedtheprospectofthedefendants l absenceas devastatingforthebusiness.Thedefendantsgrandfatherhadnotrealizedearlierthat X  hisgrandsonhadadrugproblem,butheofferedtopayfortreatmentifthecourtwouldallowthe D! defendantanotherchance. 0"     ` Thedefendantsprobationofficertestifiedthatthedefendanthaddoneallthatwas $X" expectedofhimsavepassingthedrugscreens.Shestatedthatshebelievedthedefendantssincerity $D # aboutaddressinghisdrugproblem,andsheadvocatedthatthedefendantbeofferedasecondchance. %0!$    ` Uponreceivingtheevidence,thecourtnotedthedifficultyitfacesindealingwith '#& drugaddictedindividuals.Thecourtnotedfurtherthattwoindividualswhowerepresentinthe (#' courtroomthatdaywouldbethesubjectofsentencinghearingslater,andtheseindividualshaddrug  addictions.ThecourtcommentedthatifitextendedleniencytoAmonetteforviolatingtheterms  ofhisprobationbyusingdrugs,theseothertwoindividualsmightnotbedeterredfromfurtherdrug  useduringanyprobationaryperiodthatmightbeimposedaspartoftheirsentences.Thecourt t furthercommentedthatAmonettehadgivenhiswordtothecourtatsentencingthathewouldabide ` bythetermsofprobation,andhehadbeenwarnedthataviolationwouldresultinrevocation.The L  courtdidnot,however,makeanyfactualfindingsbasedupontheevidencepresented.Forexample, 8  thecourtdidnotmakeanydeterminationsrelativetowitnesscredibility.Thecourtorderedthe $ t probationarysentencesinbothcasesrevoked;thus,thedefendantwasrequiredtoservehissentences  ` inthecountyjail.
