P  Ashby,823S.W.2dat169. 0  @, C.  `   ` Thetrialcourtfoundthatasuspendedsentencewoulddepreciatetheseriousnessoftheoffenses.Inmakingthisdetermination,thecourtobservedthattherobberywascommittedwithadeadlyweapon.However,wemustnotethatthedefendantpledguiltytosimplerobbery.Althoughsheconcededthatsheknewthecodefendantalwayscarriedaweapon,shedeniedknowingthatheintendedtouseittoaccomplishtherobbery.Itwasnotastipulatedfactthatsheknewaweaponwouldbeused. ` Werecognizethatthetrialcourtmaylookbehindapleaagreementandconsiderthetruenatureoftheoffensecommitted.SeeStatev.Hollingsworth,647 @ S.W.2d937,939(Tenn.1983);Statev.Biggs,769S.W.2d506,507(Tenn.Crim.   App.1988).However,underthesecircumstances,defendantinessencepledguiltytosimplerobberybaseduponcriminalresponsibilityfortheconductofhercodefendant(aiderandabettor).Thismitigatesagainsttheseriousnessoftheoffensefactorconsideredbythetrialcourt. ` Thetrialcourtfurtherfoundtheneedforgeneraldeterrence.However,therewasnoproofastothisfactor.SeeStatev.Davis,940S.W.2d558,560(Tenn. ,`'* 1997);Statev.Ashby,823S.W.2dat170. -@),  ` Thetrialcourtinitiallyquestioneddefendantscredibilityandnotedsheandthecodefendantwereinhiscar,andfour(4)purseswereseizedfromthetrunk.Theevidenceatthehearingshowedthatthecarbelongedtodefendantsmotherandthepurseswerehers.Thesefactswerebroughttothecourtsattentionjustpriortothetrialcourtsannouncingthedenialofprobation. ` Tothedefendantscredit,thetrialcourtfoundthatthecodefendantwasthe 0948  movingpartyintheseoffenses.Thetrialcourtfurthernotedthatdefendanthadnopriorcriminalhistoryandherpresentconditionandsocialhistorywerepositivefactors. ` Insummary,thedefendantwasatwentyone(21)yearoldhighschoolgraduatewithone(1)yearofcollege.Shewasgainfullyemployedandhadnopriorconvictionsorarrests.Hersocialhistoryandpresentconditionfavoredthegrantingofsomeformofalternativesentencing.Shewasnottheleaderbutaidedintherobberyoffense;however,shewasactivelyinvolvedinthefraudulentuseofthecreditcard.TheonlyincarcerationfactorsetforthinTenn.CodeAnn.4035103(1)thathaslimitedapplicationistheseriousnessoftheoffense.Defendantispresumedtobeafavorablecandidateforalternativesentencing.Tenn.CodeAnn.4035102(6).Thereisnoevidencetoindicatenegativerehabilitationpotential.Thestatehasfailedtorebutthepresumptionforsomeformofalternativesentencingshortofincarcerationforthefullthree(3)yearterm. ` Weare,therefore,constrainedtoagreewiththestatespositionattheprobationhearing;namely,thedefendantisa candidateforprobationaftersheservesalimitedtimeofincarceration.@xx( CONCLUSION  p&!$  ` Afteracarefulreviewoftherecord,weagreewiththestatespositiionpositionattheprobationhearing.Weaffirmthedenialoftotalprobationbutmodifythesentencetorequirethedefendanttoserveatotalof120daysoneachcasefollowedbyconcurrentthree(3)yearsandone(1)yewarartemrmsofsupervisedprobation. `     h      p 򀀀  p504  `     h      p JOEG.RILEY,JUDGE  :p59 CONCUR:򀀀 P  PAULG.SUMMERS,JUDGE򀀀 0  DAVIDG.HAYES,JUDGE
