Subsequently,PetitionerfiledapetitionforhabeascorpuswhichwasalsodismissedinthetrialcourtwhichthiscourtaffirmedinArthurL.Armstrongv.State,No.01C019311CR00403,DavidsonCounty(Tenn.Crim.App.,Nashville,Dec.8,1994).Inthatopinion,ourcourtnotedthatforthefirsttimeonappeal,thePetitionerraisedtheissueofapossibleviolationoftherulesetforthinBradyv.Maryland,373U.S.83(1963).SpecificallyinvolvedwereallegationsofintentionalwithholdingofexculpatorymaterialbytheStateduringandfollowinghistrialin1978.OurcourtaffirmedthedismissalofthepetitionforwritofhabeascorpusandrefusedtoheartheBradyissue.However,ourcourtnotedthatAppellantcouldfileapetitionforpostconvictionreliefundertheauthorityofBurfordv.State,845S.W.2d204(Tenn.1992)eventhoughthestatuteoflimitationswouldnormallyhaveexpiredforpostconvictionrelief. Petitionerthenfiledapleadingentitled AmendedPetitionforPostConvictionReliefassertingthatthecasehadbeenremandedbyourcourttothetrialcourt.EventhoughPetitionerismistakenaboutaremand,anevidentiaryhearingwasheld.Followingthehearing,thetrialcourtentereditsfindingsoffactandconclusionsoflawanddismissedthepetition.Weaffirmthejudgmentofthetrialcourt. TheissueregardingBradymaterialinvolvedtwo(2)policereportswhichPetitionerclaimedwereexculpatoryandwerenotprovidedtohimbytheState.ItisapparentfromtherecordthatPetitionerstwoattorneysattheoriginaltrialwerebothdeceasedbythetimethepresentpetitionwasheardinthetrialcourt.However,anattorneyinNashvillewhoformerlywasanAssistantDistrictAttorneyinDavidsonCountyandwhoprosecutedthePetitionerscasetestifiedatthismostrecenthearing.Hestatedthereportswereprovidedtodefensecounselpriortotrial.Thetrialcourtspecificallyaccreditedthetestimonyoftheformerprosecutor,andfoundthatthepolicereportswereindeedprovidedtoPetitionersattorneyspriortohistrialin1978. Attheevidentiaryhearing,thePetitioneralsoallegedthathistrialcounselwasineffectivefornotattackingthecredibilityofthevictim,notappealingtheapparentBradyviolation,andnotprovidingthepolicereportstothePetitioner.Thetrialcourtfoundthatalloftheseissueswereeitherpreviouslyraisedinapriorpostconvictionhearing,hadnomeritbecausenoBradyviolationwasfound,orfailedtoshowprejudicetoPetitionerbyanyallegedineffectiveactsofhistrialcounsel. Thefactualfindingsofthetrialcourtinapostconvictionhearing areconclusiveonappealunlesstheevidencepreponderatesagainstthejudgment.Statev.Buford,666S.W.2d473,475(Tenn.Crim.App.1983).Also,inapostconvictionreliefproceeding,thePetitionerhastheburdenofprovingtheallegationsinhispetitionbyapreponderanceoftheevidence.McBeev.State,655S.W.2d191,195(Tenn.Crim.App.1983).
