Arnold, appeals the dismissal of his petition forpostconviction relief. On August 21, 1995, the appellant pled guilty to onecount of aggravated sexual battery. He filed a petition for postconviction reliefon March 25, 1997, and on May 12, 1997, the trial court conducted a hearing onthe petition. On October 27, 1997, the trial court dismissed the petition, statingthat the petition was not timely filed. @}ܶA:ܶ$The appellants primary issue for review then is whether the trial courtproperly dismissed his petition for postconviction relief. We affirm.C:pܶDpܶ   Helvetica     Helvetica  ͷ$   Helvetica The appellant contends that the postconviction court erred by dismissinghis petition for postconviction relief. He argues that he entered a guilty pleabased upon his attorneys advice that he would be out of jail in one year andtwo months. He contends that had he been given correct advice, he wouldhave asked for a jury trial. Therefore, he asserts that because his attorney gaveincorrect advice regarding his parole eligibility, his petition is governed by Burford v. State, 845    S.W.2d    204 (Tenn. 1992).JKH -KH $Jܶ   Helvetica     Helvetica  ͷ$   Helvetica  Helvetica ͿLXsܶ$The state argues that the postconviction court properly dismissed theappellants petition. The state contends that because the appellants convictionbecame final on August 21, 1995, his filing of a postconviction petition onMarch 25, 1997, was time barred. The state asserts that the appellantschallenge to his parole eligibility  is not based on a new constitutional right,new scientific evidence, or an enhanced sentence due to an invalid conviction. Therefore, Burford is not applicable.Ss0ܶT0Kܶ$The trial court properly dismissed the appellants petition for relief. Weagree with the courts determination that the appellants petition was timebarred. Also, Burford is not applicable in this case.
