Theevidenceadducedduringthehearingconflictsastoeverymaterialfact,andtheseconflictscannotbereconciled.Thepetitionertestifiedheenteredpleasofguiltypursuanttoapleaagreementbecausehewasafraidhewouldreceiveadeathsentenceifhewenttotrial.Hefurthertestifiedhisretainedcounselcoercedhimtopleadguilty.ThesubmissionhearingrevealstheassistantdistrictattorneygeneraladvisedthetrialcourtthestatedidnothavegroundstoseekadeathsentenceduetorecentdecisionsoftheSupremeCourt.Thepetitionerstrialcounseltestifiedthatthestatenevergavenoticeorindicateditwouldseekadeathsentence;andheemphaticallydeniedhetoldthepetitionerhecouldreceiveadeathsentenceifhewenttotrial.Furthermore,defensecounselstatedthedecisionregardingwhetherthepetitionershouldenterguiltypleaswasmadebythepetitionerandhismother. Counselsmainconcernwastheimpositionofconsecutivesentencing.Anassistantdistrictattorneygeneraltoldcounselthepetitionercouldenterpleasofguiltyandthestatewouldrecommendthesentencesbeservedconcurrently.However,ifthepetitionerwenttotrial,theassistantdistrictattorneygeneralassertedthestatewouldmakeeveryefforttohavethetrialcourtorderthatthesentencesbeservedconsecutively. Whenquestionedabouttheproceedingsduringthesubmissionhearing,thepetitionerstatedhewastherephysicallybutnotmentally;andhecommittedperjuryduringthehearing.Heclaimedhegavetheanswershisattorneysuggested. Thetrialcourtfoundthepetitionerfailedtoprovethegroundsallegedinthepetitionbyapreponderanceoftheevidence.Giventhepreposterousanswershegaveduringhistestimony,itisdoubtfulthetrialcourtbelievedhimoraformercodefendantwhotestifiedinsupportofthepetitionerstheoryofhowthemurderoccurred.
