Afterconsiderationoftherecordbeforeus,weaffirmthejudgmentofthetrialcourt.@ Background  OnApril17,1996,ajuryfoundtheappellantguiltyofrape,aclassBfelony.Althoughthefocusofthisappealchallengesthesufficiencyoftherevocationevidence,ourfirsttaskistodeterminethemannerofserviceofthesentenceimposedbythetrialcourtfollowingtheappellantsconvictionforrape. +   ׀Thejudgmentofconviction,datedMay28,1996,reflectsthattheHonorableFrankSlaughterimposedaneightyearsentencetoboththe TDOCandthe CommunityBasedAlternative:JohnR.HayHouse.Thejudgmentfurtherprovides DefendantplacedinHayHouseforevaluation.Casetobereviewedon8/30/96.OnAugust30,1996,thetrialcourtorderedasplitconfinementoftheeightyearsentencewithoneyeartobeservedattheJohnR.Hayhouse.OnSeptember3,1996,thetrialcourttransferredtheappellantssupervisiontotheAlternativeCommunityCorrectionsProgramfortheremainderoftheeightyearsentence.WegleanfromtherecordthattheJohnR.Hayhouse,Inc.,alsoreferredtoastheHayHouse,isaCommunityCorrectionstreatmentcenterlocatedinKingsport.SeeTenn.CodeAnn.4036302(a)(2)(1990);see,e.g.,Statev.Boston,938S.W.2d435,437(Tenn.Crim.App.1996);Statev.Hale,No.03C019411CR00404(Tenn.Crim.App.atKnoxville,Aug.4,1995).Toaddtotheconfusion,attherevocationproceeding,boththeStateanddefensecounselreferredtotheappellantssentencestatusasa probatedsentence. ,    InFebruary1997,priortoresolutionoftheappellantsdirectappealofhisconviction,theappellantmetTiffanyGoff,atwentyyearoldEastTennesseeStateUniversitystudent,atanaerobicsclassheldattheschoolgym.TheappellantandMs.Goffexchangedtelephonenumbersandagreedtomakeplanstoplayracquetball.Ms.Gofflaterdecidedtocancelherplanswiththeappellantafterhisbehaviorhadchangedduringaninitialtelephoneconversation.TheappellantcontinuedtotelephoneMs.Goff.Ononeoccasion,shereturnedthephonecall,buttheappellantwasnotathome.Ms.Gofftestifiedthatduringtheseinitialconversationswiththeappellant,shecommentedthatshewashavingproblemswithherboyfriend,towhichtheappellantaskedherifher boyfriendwantedtoomuchsex.Afterthisincident,theappellantcontinuedhisvisitstotheaerobicsclass,butdidnotparticipateintheexercise.Rather,theappellantwouldtalkwithMs.Goffpriortoclass.Duringoneoftheirconversations,theappellantstated, ifitseemslikeImflirtingwithyou,Iam.TheappellantalsoshowedupatthegymwhenMs.GoffhadplannedtoplayracquetballwithAngie A.C.Carraway,theaerobicsinstructor.Whilethetwoattemptedtoplayracquetball,theappellant keptlookinginthewindows despitetheirattemptstomakehim goaway.Theappellantthenwalkedontothecourtwhereheand A.C.gotinvolvedinanargument.TheappellantcontinuedtotelephoneMs.Goff,approximatelytwentyphonecallsaweek.Thisbehaviorcontinuedforthreemonths.Ms.Gofftestifiedthattheappellantsbehaviorcausedhertofearforherownsafety.Specifically,sheexplainedthat hekeptactingweird,likewhenhedgetmadifyouwouldntdoanythingwithhim....hejustseemedrealaggressivewhenyoudsaynotohim.Theappellantsbehaviorwasreportedtothepoliceandhewassubsequentlyarrestedonachargeofstalking.̀  OnMay6,1997,CommunityCorrectionscaseofficerBrianBrummettfiledanaffidavitofviolationofCommunityCorrectionssupervisionallegingthattheappellanthadviolated Rule#1oftheCommunityCorrectionsorderbycommittingtheoffenseofstalking. -   ׀ArevocationhearingwasheldonJuly14,1997,atwhichtimetheappellantenteredapleaofnotguiltytotheoffenseofstalking.OnJuly25,1997,thetrialcourtfoundthattheproofsupportedtheallegedviolationbyapreponderanceoftheevidenceandorderedthattheappellantservetheremainderofhiseightyearsentenceintheDepartmentofCorrection.TheappellantfiledhisnoticeofappealofthisrevocationonAugust21,1997.@ Analysis  Inhisonlyissuepresentedforourreview,theappellantcontendsthatthetrialcourterroneouslyfoundtheproofsufficienttosupportafindingthattheappellantviolatedaconditionofhisCommunityCorrectionssentence.Specifically,heassertsthattheevidencefailedtoestablishthattheappellantsactionscausedMs.Gofftoreasonablyfearassaultorbodilyinjuryorthattheappellant followedMs.Goffasdefinedbythestatute. Apersoncommitstheoffenseofstalkingwhointentionallyandrepeatedlyfollowsorharassesanotherpersoninsuchamanneraswouldcausethatpersontobeinreasonablefearofbeingassaulted,sufferingbodilyinjuryordeath.Tenn.CodeAnn.3917315(1997).Theoffensefurtherdefinestheterm"followstomean maintainingavisualorphysicalproximityoveraperiodoftimetoaspecificpersoninsuchamanneraswouldcauseareasonablepersontohaveafearofanassault,bodilyinjury,ordeath.Tenn.CodeAnn.3917315(a)(2)(A). Inarevocationproceeding,theStatebearstheburdenofestablishingtheviolationallegedinthenoticebyapreponderanceoftheevidence.Statev.Harkins,811S.W.2d79,82(Tenn.1991).Thetrialcourtretainsthediscretion,includingresolvingconflictsintheevidenceandjudgingthecredibilityofthewitnesses,todeterminewhethertheaccusedhasviolatedtheconditionsoftheCommunityCorrectionssentence.Harkins,811S.W.2dat82;Statev.Mitchell,810S.W.2d733,735(Tenn.Crim.App.1991).Iftheevidenceissufficienttosupportaviolationoftheconditionandthetrialcourt,exercisingitsdiscretion,decidestorevoketheCommunityCorrectionssentence,thecourtmustplaceitsfindingsoffactandthereasonsfortherevocationontherecord.SeeStatev.Hardy,No.02C019503CC00074(Tenn.Crim.App.atJackson,Feb.7,1996).Onappeal,thereviewingcourtmustaffirmthetrialcourtsdecisionunless therecordcontainsnosubstantialevidencetosupporttheconclusionofthetrial[court]thataviolationofthecondition...hasoccurred.Harkins,811S.W.2dat82. Inthepresentcase,weconcludethattherecordcontainssufficientevidencetosupportthetrialcourtsconclusion.ThetrialcourtproperlyaccreditedthetestimonyofMs.GoffandAngie A.C.Carrawayandrejectedtheappellantsversionoftheevents.Thecourtfound:8 TheCourt,therefore,isoftheopinionthatareasonablepersoncouldfearthatwhichisrequiredbythestatute.Theyoungladywas,althoughyoung,wasacollegestudent.Theactionsweregreat.TheCourtfirstthoughtthepartiesitstartedout,theyweremoreorlessfriendly...wheretheydostartoutfriendly,thentheygetitbecomesanoverbearingtyperelationship.8 ...8 ...[T]heCourtsoftheopinion[that]theStatehasmadeout[bya]preponderance[that]theDefendanthasviolatedthetermsandconditionsofhisprobation.Hellberequiredtoservehissentence.Weagreethattheappellantsactionsconstituted followingwithinthedefinitionprescribedbythestatute.Moreover,areasonablepersoninMs.Goffspositionwouldhavebeenfearfulorapprehensiveofbodilyharmorinjurytotheirpersonconsideringtheappellantsbehavior.Weconcludethattherecordcontainsampleevidencetosupportthetrialcourt'sfindingthattheappellantviolatedRule#1oftheCommunityCorrectionsorder.Therecordreflectsthatthetrialcourtmadeaconscientiousdecisioninrevokingthesentenceandthecourtplaceditsfindingsandconclusionsontherecord.Becausewefindnoabuseofdiscretion,thejudgmentofthetrialcourtisaffirmed.     ____________________________________     DAVIDG.HAYES,JudgeCONCUR:__________________________________JOHNH.PEAY,Judge__________________________________JOSEPHM.TIPTON,Judge
