FACTS    Theappellantwasarrestedforsellingmarijuana.Thearrestingofficerconfiscated$667.31fromtheappellantpursuanttoTenn.CodeAnn.5311451.Theappellantwasinformedthathehadarighttoahearingtochallengetheseizure.However,theappellantneverexercisedthisright.The$667.31was,therefore,summarilyforfeitedtotheTennesseeDepartmentofSafety.   ANALYSIS    Theappellantconcedesthathewasprovidednoticeoftherighttochallengetheforfeiture.He,however,electedtoneitherfileaclaimnorenteranappearancetocontesttheforfeiture.Itiswellsettledthatapartyassertingdoublejeopardymusthavebeenapartytoapriorproceeding.UnitedStatesv.Schinnell,80F.3d1064,1068(5thCir.1996);UnitedStatesv.Torres,28F.3d1463,1465(7thCir1994).Toattainpartystatusinacivilforfeiture,onemust,attheveryleast,fileaclaiminresponsetothenoticeofseizure.SeeUnitedStatesv.Walsh,873F.Supp.334,33637(D.Ariz.1994)(citingTorresforthepropositionthatjeopardydidnotattachtoaforfeiturewheredefendantdidnotmakeanyclaimincivilforfeitureproceeding).
