Ðto€the€point€that€the€instruction€overshadowed€the€potential€for€intoxication€to€negate€a€mentalÐ $h" Ðelement€of€an€offense.ò ò€ó ó€Additionally,€the€petitioner€contended€that€he€had€signed€an€ð ðaltered€.€.€.€DUIÐ %T # Ðconsent€formðð€concerning€the€taking€of€blood€at€the€hospital.ò ò€ó ó€He€also€averred€that€Officer€RonnieÐ ô%D!$ ÐBledsoe,€who€had€taken€him€to€the€hospital,€had€carried€out€a€round€cardboard€container.ò òó ó€Based€uponÐ ä&4"% Ðhis€purportedly€having€worked€at€a€hospital€in€the€past,€the€petitioner€claimed€to€know€that€the€latterÐ Ð' #& Ðhad€contained€the€blood€sample,€though€he€provided€no€further€information€indicating€that€this€wasÐ ¼( $' Ðthe€case.ò ò€ó óIn€fact,€the€petitioner€at€first€claimed€to€have€heard€Bledsoe€tell€Detective€Louie€Eleas,€theÐ ° Ðprosecuting€officer€for€the€case,€about€the€blood€drawn,€but€later€the€petitioner€admitted€that€he€hadÐ  ð Ðnot€heard€anything€specifically€about€the€blood€sample€mentioned.ò òÐ ŒÜ Ðà  àó óLastly,€the€petitioner€called€his€trial€attorney.€At€the€time€of€the€trial,€this€witness€hadÐ xÈ Ðpracticed€law€for€three€years€and€stated€that€he€had€tried€forty€jury€trials€in€Tennessee€prior€to€theÐ d´ Ðpetitionerððs.ò òó ó€He€stated€that€he€had€prepared€three€jury€instruction€requests,€but,€presumably€becauseÐ P   Ðof€fatigue,€he€had€not€followed€through€on€them.ò òó ó€When€asked€by€the€trial€court€if€there€were€anyÐ < Œ Ðspecial€requests,€counsel€testified€that€he€said,€ð ðno.ððò òó ó€Furthermore,€when€the€trial€court€providedÐ ( x Ðcounsel€with€the€instructions€to€be€given€the€jury,€counsel€voiced€no€objection€to€them.ò òó ó€Nevertheless,Ð  d Ðat€the€post„conviction€hearing,€he€stated€his€opinion€that€the€instruction€given€was€incomprehensibleÐ  P  Ðto€the€jurors.€€€As€a€result€counsel€felt€that€he€had€provided€ineffective€assistance€in€not€objecting€toÐ ì <  Ðthe€instruction€at€trial€and€in€failing€to€raise€the€issue€in€the€petitionerððs€new€trial€motion.Ð Ø(  Ðà  àConcerning€the€test€of€the€first€vial€of€blood€taken€from€the€petitioner,€counsel€testified€thatÐ Ä  Ðhe€had€not€seen€the€test€results€at€the€time€of€trial.€€According€to€this€witness,€the€copy€he€hadÐ °  Ðreceived€of€the€medical€report€through€discovery€had€not€included€the€initial€page€of€the€report.€€HeÐ œì  Ðadded€that€when€he€had€taken€a€handwritten€release€form€bearing€the€petitionerððs€signature€to€theÐ ˆØ  Ðhospital€in€an€attempt€to€get€a€copy€of€the€record,€the€hospital€had€refused€to€provide€it€under€thoseÐ tÄ Ðcircumstances.€ò òó óNevertheless,€he€acknowledged€that€the€record€had€been€sent€to€the€trial€courtÐ `° Ðpursuant€to€a€subpoenaòòóó€and€had€become€Exhibit€70€presented€to€the€jurors.ò ò€ó ó€He€also€asserted€that€theÐ Lœ ÐState€had€improperly€withheld€a€modified€DUI€consent€form€signed€at€the€hospital.ò òó ó€ò òó ó€Among€otherÐ <Œ Ðclaims,€counsel€further€contended€that€the€State€had€presented€inaccurate€testimony€regardingÐ (x Ðwhether€the€petitioner€had€been€ð ðin€custodyðð€while€at€the€hospital.ò òó ó€Before€completing€his€testimony,Ð d Ðthis€former€attorney€admitted€that€he€stands€convicted€of€two€counts€of€theft€over€$60,000;€one€countÐ P Ðof€theft€over€$10,000;€one€count€of€theft€over€$1,000;€one€count€of€theft€over€$500;€and€forgery.ò ò€ó óÐ ì< ÐAfter€this€witness€the€petitioner€rested€his€case.Ð Ü, Ðà  àThe€State€then€called€Nancy€Harr€and€Detective€Louie€Eleas.€Harr€had€been€one€of€theÐ È Ðprosecutors€involved€in€preparing€and€conducting€the€petitionerððs€trial.€ò ò€ó óIn€this€capacity€she€hadÐ ´ Ðengaged€in€open€file€discovery€with€the€petitionerððs€trial€counsel׃ ×Ý ƒ#ÃÝòòÚ  Ú4Ú  ÚóóÝ  Ý×  ×€and€provided€him€with€copies€ofÐ ¤ô Ðð ðall€discovery€materials.ððò òó ó€Other€than€her€work€product,€Harr€stated,€ð ð[I]f€it€was€in€my€file€[defenseÐ à Ðcounsel]€had€it.ððò òó ó€She€underscored€that€she€had€not€seen€the€petitionerððs€medical€report€until€the€trialÐ |Ì Ðcourt€provided€her€with€a€copy€during€trial.ò ò€ó ó€In€addition,€she€claimed€that€she€had€not€thought€thatÐ h ¸ Ðthere€had€been€another€blood€test,€and€she€indicated€her€belief€that€Detective€Eleas€had€testifiedÐ X!¨ Ðtruthfully.ò òó óÐ D"”  Ðà  àTurning€to€Eleas,€the€detective€asserted€that€he€had€not€received€any€blood€sample€other€thanÐ 0#€! Ðthe€one€taken€from€the€petitioner€at€the€jail.ò òó ó€He€added€that€he€had€neither€requested€nor€had€heÐ $l" Ðbecome€aware€of€the€hospital€sampleððs€existence.€ò òó ó€Eleas€went€on€to€explain€that€when€medicalÐ %X # Ðpersonnel€draw€a€blood€sample€for€law€enforcement,€certain€forms€are€completed€as€an€aid€toÐ ô%D!$ Ðestablish€the€chain€of€custody;€however,€he€noted€that€he€had€not€heard€of€this€procedureððs€beingÐ à&0"% Ðneeded€or€done€in€this€case.ò ò€ó ó€Furthermore,€Eleas€provided€a€different€description€of€the€containersÐ Ì'#& Ðused€to€transport€blood€from€that€given€by€the€petitioner.ò òó ó€He€also€indicated€that€he€had€never€seenÐ ¼( $' Ða€ð ðDUI€type€releaseðð€document€allegedly€signed€by€the€petitioner.ò òó ó€Nevertheless,€though€he€hadÐ ° Ðinitially€claimed€that€the€petitioner€had€not€been€in€custody€while€at€the€hospital,€Eleas€ultimatelyÐ œì Ðadmitted€that€the€petitioner€probably€would€not€have€been€allowed€to€leave€had€the€petitioner€wishedÐ ˆØ Ðto€do€so.ò òó óÐ tÄ Ðà  àThe€trial€court€heard€this€and€other€evidence€before€subsequently€issuing€a€written€orderÐ `° Ðdenying€the€post„conviction€petition.€In€so€doing,€the€trial€court€made€extensive€findings€of€fact.Ð L œ ÐÌÌò òòòÓ  ÓPost„Conviction€Standard€of€ReviewÐ  ` ÐÌó óóóÓÜFÓà  àIn€analyzing€the€issues€raised,€we€first€note€that€a€petitioner€bringing€a€post-convictionÐ è 8  Ðpetition€bears€the€burden€of€proving€the€allegations€asserted€in€the€petition€by€clear€and€convincingÐ Ô$  Ðevidence.€òòSeeóó€Tenn.€Code€Ann.€ðð€40„30„210(f).€€Moreover,€the€trial€court's€findings€of€fact€ð ðareÐ À  Ðconclusive€on€appeal€unless€the€evidence€preponderates€against€the€judgment.ðð€€òòTidwell€v.€Stateóó,€922Ð ¬ü  ÐS.W.2d€497,€500€(Tenn.€1996);€òòseeóó€òòalsoóó€òòCampbell€v.€Stateóó,€904€S.W.2d€594,€596€(Tenn.€1995).Ð ˜è  ÐÌÌÓ  Óò òòòPost„Conviction€Waiveróóó óÐ \¬ ÐÌÓ²IÓà  àWe€further€observe€that€Tennessee€Code€Annotated€Section€40„30„206(g)€provides€theÐ 4„ Ðprovisions€governing€waiver€of€post„conviction€allegations.€According€to€this€statute:Ð  p ÐÌà8  àA€ground€for€relief€is€waived€if€the€petitioner€personally€or€through€an€attorney€failedÐ øH Ðto€present€it€for€determination€in€any€proceeding€before€a€court€of€competentÐ ä4 Ðjurisdiction€in€which€the€ground€could€have€been€presented€unless:€(1)€The€claim€forÐ Ð  Ðrelief€is€based€upon€a€constitutional€right€not€recognized€as€existing€at€the€time€ofÐ ¼  Ðtrial€if€either€the€federal€or€state€constitution€requires€retroactive€application€of€thatÐ ¨ø Ðright;€or€(2)€The€failure€to€present€the€ground€was€the€result€of€state€action€inÐ ”ä Ðviolation€of€the€federal€or€state€constitution.ЀÐÐ Ð  ÐÌTenn.€Code€Ann.€ðð€40„30„206(g)(1),(2).Ð X ¨ ÐÌÌÓ  Óòòò òJury€Instruction€Improprietyó óóóÐ #l! Ðof€the€lawðð€applicable€to€the€case.€òòPhippsóó,€883€S.W.2d€at€142.€At€this€petitionerððs€trial,€the€courtÐ $X" Ðcharged€the€jurors€that€it€was€their€ð ðduty€to€carefully€consider€each€instruction€equally€in€light€of€andÐ ô$D # Ðin€harmony€with€the€others.ððò òó ó€The€trial€court€went€on€to€explain€that€the€jury€must€find€every€elementÐ à%0!$ Ðof€an€offense€proven€beyond€a€reasonable€doubt€in€order€to€find€the€petitioner€guilty.ò ò€ó ó€Among€thoseÐ Ì&"% Ðelements€listed€for€second€degree€murder€(the€offense€of€which€the€petitioner€was€convicted)€wasÐ ° Ðð ðthat€the€killing€was€knowing.ððò ò€ó óThe€trial€court€defined€ð ðknowingðð€for€the€jury.€ò òó óFurthermore,€the€trialÐ œì Ðcourt€emphasized€that€ð ðthe€State€must€prove€beyond€a€reasonable€doubt€the€required€culpable€mentalÐ ŒÜ Ðstate€of€the€defendant€before€he€can€be€found€guilty€of€any€offense€embraced€in€this€indictment.ððò òó óÐ xÈ ÐAlmost€immediately€thereafter€the€trial€court€admonished€that€the€petitioner€ð ðcan€only€be€foundÐ d´ Ðguilty€of€committing€the€offenses€embraced€in€this€indictment€if€he€acted€intentionally€or€knowingÐ P   Ð[sic],€with€respect€to€each€element€of€the€offense€.€.€.€.€Second€degree€murder€requires€that€the€act€beÐ < Œ Ðcommitted€intentionally€or€knowingly.ðð€ò òó óAfter€detailing€the€mental€elements€for€the€lesser€includedÐ ( x Ðoffenses,€the€trial€court€stated:€ð ðEvidence€as€to€a€defendantððs€diminished€mental€capacity€may€beÐ  d Ðconsidered€by€you€to€show€that€he€was€incapable€of€forming€the€specific€culpable€mental€stateÐ  P  Ðrequired€for€any€particular€criminal€offense.€It€is€a€question€for€the€jury€as€to€whether€such€evidenceÐ ì <  Ðexists€and€as€to€what€weight€it€should€be€given.ððò òó óÐ Ø(  Ðà  àThe€trial€court€next€set€out€numerous€definitions€relative€to€voluntary€and€involuntaryÐ Ä  Ðintoxication.€€First€the€court€explained€that€intoxication€generally€is€ð ðnot€a€defense€to€prosecutionÐ °  Ðfor€an€offenseðð€but€that€involuntary€intoxication€is€a€defense€ð ðif€as€a€result€of€the€involuntaryÐ œì  Ðintoxication,€the€person€lacked€substantial€capacity€either€to€appreciate€the€wrongfulness€of€theÐ ˆØ  Ðpersonððs€conduct€or€to€conform€that€conduct€to€the€requirements€of€the€law€allegedly€violated.ððò òó ó€€AfterÐ tÄ Ðmaking€it€clear€that€a€finding€of€involuntary€intoxication€could€lead€to€an€acquittal,€the€trial€courtÐ `° Ðcharged€the€jury€that€ð ð[i]ntoxication,€whether€voluntary€or€involuntary,€is€relevant€to€the€issue€of€theÐ Lœ Ðessential€element€of€the€defendantððs€culpable€mental€state.€ððò òó ó€Though€the€petitioner€complains€thatÐ 8ˆ Ðthe€trial€court€did€not€specifically€define€ð ðculpable€mental€state,ðð€the€court€did€follow€the€latterÐ $t Ðinstruction€with,€ð ð[i]n€this€case,€the€State€must€prove€beyond€a€reasonable€doubt€the€requiredÐ ` Ðculpable€mental€state€of€the€defendant€which€is€if€he€acted€intentionally€or€knowingly,€with€respectÐ üL Ðto€each€element€of€the€offenseðð€in€order€to€sustain€a€second€degree€murder€conviction.€ò òó ó€In€addition,Ð è8 Ðthe€trial€courtò òó ó€specifically€stated:€ð ðIf€you€find€that€the€defendant€was€intoxicated€to€the€extent€thatÐ Ô$ Ðhe€could€not€have€possessed€the€required€culpable€mental€state,€then,€he€cannot€be€guilty€of€theÐ À Ðoffense€charged.ððò òó ó€€€Finally,€the€trial€court€reiterated:€ð ðIf€you€are€not€satisfied€beyond€a€reasonableÐ ¬ü Ðdoubt€that€the€defendant€possessed€the€culpable€mental€state,€then€you€must€find€him€not€guilty.ðð€ò òó óÐ ˜è Ðà  àContrary€to€the€petitionerððs€view,€we€find€that€the€above„outlined€instruction€fairly€andÐ „Ô Ðadequately€apprized€the€jury€of€the€law€in€an€understandable€manner.€The€situation€presented€hereÐ pÀ Ðis€distinguishable€from€òòState€v.€Phippsóó€and€from€òòState€v.€Hallóó,€958€S.W.2d€679€(Tenn.€1997)ð!ðcasesÐ \ ¬ Ðcited€by€the€petitioner.€In€òòPhippsóó,€the€trial€court€particularly€instructed€the€jury:Ð H!˜ ÐÌà8  àThe€defendant€contends€that€he€was€suffering€from€mental€conditions€known€as€postÐ  #p! Ðtraumatic€stress€disorder€[PTSD],€and€major€depression€at€the€time€of€theÐ  $\" Ðcommission€of€the€criminal€offense€giving€rise€to€this€case.€€I€charge€you€that€postÐ ø$H # Ðtraumatic€stress€disorder€and€major€depression€are€not€defenses€to€a€criminal€charge.€Ð ä%4!$ ÐInsanity€may€be€a€defense,€however,€the€defendant€makes€no€claim€that€he€was€insaneÐ Ð& "% Ðat€the€time€of€the€killing€giving€rise€to€this€case.м' #&Ð Ð  ÐÌòòPhippsóó,€883€S.W.2d€at€142.€The€opinion€makes€no€reference€to€instructions€potentially€tying€PTSDÐ ”)ä$( Ðand€the€major€depression€to€Phippsðð€culpable€mental€state;€however,€in€the€instant€case€the€linkÐ €*Ð%) Ðbetween€the€petitionerððs€alleged€diminished€capacity€and/or€intoxication€and€the€culpable€mentalÐ l+¼&* Ðstate€was€articulated€in€the€trial€courtððs€instructions.€Turning€to€òòHallóó,€we€find€it€even€less€applicableÐ ° Ðòòóóbecause€therein€the€supreme€court€did€not€wrestle€with€this€type€of€jury€instruction€issue,€but€ratherÐ œì Ðwith€the€admissibility€of€expert€testimony.€òòHallóó,€958€S.W.2d€at€688„92.€Thus,€though€diminishedÐ ˆØ Ðcapacity€is€discussed€in€connection€with€the€trial€courtððs€refusal€to€admit€particular€testimony,€òòHallóóÐ tÄ Ðis€inapplicable€in€this€case.Ð `° Ðà  àBased€upon€these€findings€and€the€record€presented,€we€conclude€that€counsel€did€not€provideÐ L œ Ðdeficient€performance€in€failing€to€raise€this€issue€previously.€As€such,€the€petitionerððs€ineffectiveÐ 8 ˆ Ðassistance€of€counsel€claim€lacks€merit.Ð $ t ÐÌÌÓ  Óò òòòAlleged€Brady€Violationsóóó óÐ è 8  ÐÌÓ  Óà  àThe€petitioner€next€contends€that€the€State€withheld€from€him€exculpatory€evidenceÐ À  Ðconsisting€of€the€first€page€of€a€medical€report,€a€modified€DUI€consent€form,€and€blood€drawn€atÐ ¬ü  Ðthe€hospital€on€the€night€of€the€murder.€Nevertheless,€again€the€petitioner€failed€to€raise€these€mattersÐ ˜è  Ðon€direct€appeal€and€does€not€prove€that€either€of€the€exceptions€forestalling€waiver€apply€in€thisÐ „Ô  Ðsituation.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„30„206(g).׃ ×Ý ƒ#ÃÝòòÚ  Ú6Ú  ÚóóÝ  Ý×  ×€We€therefore€conclude€that€he€has€waived€these€Ð pÀ Ðcontentions.Ð \¬ Ðà  àFurthermore,€we€observe€that€even€if€the€petitioner€had€not€waived€these€concerns,€he€failedÐ H˜ ÚóóÝ  Ý×  ×€we€find€insufficient€proof€establishing€that€theÐ ° Ðâ âState€ever€had€any€of€these€items€in€its€possession€or€that€the€State€attempted€to€prevent€the€petitionerÐ œì Ðfrom€acquiring€them.€Concerning€the€medical€report,€the€petitioner€was€aware€that€he€had€been€toÐ ˆØ Ðthe€hospital;ò òó ó€he€had€informed€his€attorney€of€that€fact;ò òó ó€the€report€was€the€petitionerððs€own;ò òó ó€the€fullÐ tÄ Ðreport€was€submitted€to€the€jury€at€trial€after€defense€counsel€had€subpoenaed€the€record€to€court;€ò òÐ `° Ðó óthe€hospitalððs€medical€records€keeper€testified€that€the€report€had€been€provided€to€the€publicÐ P   Ðdefender;ò òó ó€this€witness€further€stated€that€she€saw€no€indication€that€the€State€had€requested€or€beenÐ < Œ Ðprovided€these€documents;ò òó ó€and€former€Assistant€District€Attorney€Harr€related€that€she€had€firstÐ ( x Ðencountered€the€records€at€trial.ò òó ó€With€respect€to€the€alleged€modified€DUI€consent€form,€the€onlyÐ  d Ðproof€offered€to€support€its€existence€was€the€petitionerððs€testimony.€ò òó óFinally,€regarding€the€bloodÐ  P  Ðsample€itself,€proof€was€presented€showing€that€a€sample€had€been€ordered€andò òó ó€€that€the€hospital€hadÐ ì <  Ðtested€it;ò òó ó€however,€there€was€no€proof€that€this€sample€had€at€any€point€come€under€the€StateððsÐ Ø(  Ðcontrol.€€Faced€with€these€facts€and€for€the€aforementioned€reasons,€we€conclude€that€this€issue€doesÐ Ä  Ðnot€entitle€the€petitioner€to€relief.Ð °  ÐÌÌò òòòÓ  ÓPerjured€Statementsóóó óÐ tÄ ÐÌÓÔˆÓà  àLastly,€the€petitioner€contends€that€Detective€Louie€Eleas€lied€under€oath€during€the€trial.€Ð Lœ ÐWhile€a€portion€of€his€accusation€is€unclear,€the€petitioner€seems€to€contend€that€Eleas€testifiedÐ 8ˆ Ðfalsely€about€receiving€the€objects€discussed€in€the€previous€issue.€The€petitioner€also€avers€that€theÐ $t Ðdetective€lied€about€when€the€petitioner€came€into€custody.Ð ` Ðà  àOnce€more,€we€find€that€the€petitioner€has€waived€both€of€these€matters€by€failing€toÐ üL Ðpreviously€raise€them€or€provide€the€court€with€proof€of€one€of€the€exceptions€to€the€post„convictionÐ è8 Ðwaiver€provisions.€òòSeeóó€Tenn.€Code€Ann€ðð€40„30„206(g).€Additionally,€regarding€the€blood€test€items,Ð Ô$ Ða€review€of€the€analysis€in€the€previous€issue€reveals€that€the€petitioner€has€failed€to€provide€clearÐ À Ðand€convincing€evidence€that€these€items€were€ever€in€the€Stateððs€possession€before€trial,€much€lessÐ ¬ü Ðthat€Eleas€perjured€himself€concerning€the€items.€€Finally,€although€Eleasðð€trial€testimony€reveals€thatÐ ˜è Ðhe€stated€petitioner€was€not€in€custody€during€the€hospital€visit,€and€Eleasðð€post„conviction€testimonyÐ „Ô Ðreveals€that€petitioner€was€in€custody,€the€discrepancy€appears€to€result€from€EleasððÐ pÀ Ðmisunderstanding€concerning€when€an€individual€is€legally€ð ðin€custody,ðð€rather€than€from€perjury.€Ð \ ¬
