Afterreview,weaffirm. OnJune8,1992,theappellantenteredguiltypleasintheKnoxCountyCriminalCourttoonecountofburglary,threecountsofaggravatedburglary,andonecountofaggravatedassault.Asaresultoftheseconvictions,theappellantreceivedaneffectivetenyearsentenceintheTennesseeDepartmentofCorrection.OnMay8,1997,theappellantfiledtheinstantpetitionforpostconvictionrelief.Thepetitioncollaterallyattackshisconvictionsupongroundsthatthepleasdidnotconstituteanintentionalorvoluntaryrelinquishmentofaknownright.Boykinv.Alabama,395U.S.238,242;89S.Ct.1709,1711(1969);Johnsonv.Zerbst,304U.S.458,464;58S.Ct.1019,1023(1938).Specifically,hecontendsthathewassufferingfrom memoryloss,hallucinationsandtremorsasaresultofcocaineaddictionand,therefore,hisguiltypleaswerenotknowinglyentered.TheappellantiscurrentlyaninmateatthefederalcorrectionalfacilityinManchester,Kentucky.Hechallengesthevalidityofhisstateconvictionswhichwereusedtoenhancehisfederalsentencesforwhichheisnowincarcerated.OnMay16,1997,thepostconvictioncourtdismissedtheappellantspetition,citingthefollowingground: APetitionraisingtheidenticalgroundswasdismissedonApril16,1997astimebarred.Thatorderwasnotappealedandbecamefinal.ThisPetitionisDISMISSED. ,   ׀ Theappellantdoesnotcontestthefactthatthelimitationperiodhadexpiredpriortothefilingofhispetition.Rather,hearguesthatinvalidconvictionscannotorshouldnotbeusedtoenhancesubsequentsentencesandtheimpositionof timelimitsuponsuchchallengesinfringesuponadefendantsdueprocessrights.TheTennesseeSupremeCourthaspreviouslydeterminedthatstatutesoflimitationsareconstitutional.InBurfordv.State,845S.W.2d204,207(Tenn.1992),theCourtopinedthat itisclearthattheStatehasalegitimateinterestinpreventingthelitigationofstaleorfraudulentclaims(citingJimenezv.Weinberger,417U.S.628,636,94S.Ct.2496,2501(1974)).Tofacilitatethisinterest,theCourtfurtherstatedthat astatemayerectreasonableproceduralrequirementsfortriggeringtherighttoanadjudication,suchasstatutesoflimitations,andastatemayterminateaclaimforfailuretocomplywithareasonableproceduralrulewithoutviolatingdueprocessrights.Burford,845S.W.2dat207(citingLoganv.ZimmermanBrushCo.,455U.S.422,437,102S.Ct.1148,1158(1982)).Moreover,inCarterv.State,917S.W.2d417,420(Tenn.1997),theCourtupheldasconstitutionalthenewoneyearstatuteoflimitationsenactedin1995,findingthatthestatuteadequatelyprotectedtherightsofthosewhofilepetitionsforpostconvictionrelief.Thisissueiswithoutmerit.  Atthetimetheappellantsconvictionsbecamefinal,June8,1992,thestatuteoflimitationsapplicabletopostconvictionproceedingswasthreeyears.Tenn.CodeAnn.4030102(repealed1995).In1995,thelegislaturereducedthestatutoryperiodforfilingpostconvictionpetitionsfromthreeyearstooneyear.Tenn.CodeAnn.4030202(a)(1995Supp.).Asaresult,thenewPostConvictionProcedureActgovernsthispetitionandallpetitionsfiledafterMay10,1995.BecausethepreviousthreeyearstatuteoflimitationshadnotexpiredatthetimethenewActwentintoeffect,hisrighttopetitionforpostconvictionreliefsurvivedunderthenewAct.SeeCarterv.State,952S.W.2d417,420(Tenn.1997).Therefore,theappellanthaduntilMay10,1996,oroneyearfromtheeffectivedateofthenewAct,tofileforpostconvictionrelief.CompilersNotes,Tenn.CodeAnn.4030201(1997);seealsoDanielsv.State,No.03C019606CC00244(Tenn.Crim.App.atKnoxville,Feb.27,1997),perm.toappealdenied,(Tenn.Sept.29,1997).Theappellantfiledthispetitionalmostoneyearafterthestatutehadrun.Moreover,thegroundsraisedinthispetitionandonappealdonotfallwithinanyoftheexceptionstothestatuteoflimitationssetoutinTenn.CodeAnn.4030202(b)(1),(2),or(3)(1997).Accordingly,dismissaloftheappellantspetitionwasmandatedundertheprovisionsofthe1995PostConvictionProcedureAct. -    Thejudgmentofthetrialcourtisaffirmed.     ____________________________________     DAVIDG.HAYES,JudgeCONCUR:____________________________________JOHNH.PEAY,Judge____________________________________JOSEPHM.TIPTON,Judge
