L    Inrebuttal,thestateofferedthetestimonyofDr.RokeyaFarooque,whoevaluatedthe $  defendantattheMiddleTennesseeMentalHealthInstitute.AccordingtoDr.Farooque,the   defendanthadahistoryofsubstanceabuse.Shebelievedthatadiagnosisofposttraumaticstress   disorderwaserroneousbecausethedefendantdidnotexhibitalloftheclinicalsymptoms.Itwas   heropinionthatthedefendant,whoreportedneitherflashbacksnorthehearingofvoicesatthetime   ofhisattackuponthevictim,wasnotinadisassociativestateatthetimeoftheoffense.Samuel p Craddock,apsychologistattheTennesseeMentalHealthInstitute,testifiedthatthedefendantindeed \ sufferedfromschizophrenia,butwasneverthelessabletorecognizethewrongfulnessofhisactions. L    Inourview,thosecommentsestablishthatthetrialcourtdidnotrelysolelyontheexistence $  oftheassaultchargesagainstthedefendanttosupporttheapplicationofenhancementfactor(1).   Therecordsuggeststhatthetrialcourtconsideredthefactsandcircumstancesunderlyingthecharges   anddeterminedthattheyconstitutedpriorcriminalbehavioronthepartofthedefendant.Although   thestatedidnotpresentsuchevidenceatthesentencinghearing,ithadbeenintroducedduringthe   courseofotherhearingswhichoccurredeitherbeforethetrialorbeforetheimpositionofsentence. p Thetrialjudgedeclinedtorecitethedetailsoftheevidenceanddefensecounselmadenoobjection \ orrequestforclarification.Theotherhearingswereneitherrecordednortranscribedand,assuch, H arenotpartoftherecord.Thedefendantchosenottofileastatementoftheevidence.SeeTenn. 4 R.App.P.24(c).  p   Whencriticalportionsoftherecordareomitted,thiscourtmustpresumethatthedecision H ofthetrialcourtwascorrect.Statev.Keen,996S.W.2d842(Tenn.Crim.App.1999);Statev. 4 Oody,823S.W.2d554,559(Tenn.Crim.App.1991).Becauseitisthedutyoftheappellantto   supplyanadequaterecordforadeterminationonthemerits,wecannot,underthesecircumstances,   ascribeerrortothetrialcourt.SeeTenn.R.App.P.24;Statev.Coolidge,915S.W.2d820,826  (Tenn.Crim.App.1995),overruledonothergroundsbyStatev.Troutman,979S.W.2d271  (Tenn.1998).Furthermore,otherfactorsintherecordaresufficienttosupporttheapplicationof  enhancementfactor(1).Thepresentencereportreflectsthatthedefendantwasconvictedfor l underagedrinkingin1996.Headmittedprevioususeofillegaldrugs,includingextensiveuseof X  marijuana.Inourview,enhancementfactor(1)wasproperlyapplied. Next,thedefendantcontendsthatthetrialcourterredbyapplyingenhancementfactor(4), #l! thatthevictimoftheoffensewasparticularlyvulnerablebecauseofageorphysicalormental $X" disability.SeeTenn.CodeAnn.4035114(1).Hearguesthatthestatefailedtoproveany $D # particularvulnerabilityonthepartofthevictimorthatthevictimwasunabletoresistasaresult %0!$ thereof.Thestatemaintainsthattheevidenceofthevictimsmentaldisabilitywassufficient,but &"% itconcedesthattherecorddoesnotsupportafindingthatitcausedthevictimtobeparticularly '#& vulnerabletothedefendantsattack. (#'   Thestatebearstheburdenofprovingthatavictimisparticularlyvulnerable.Statev.Poole, |*%) 945S.W.2d93(Tenn.1997);Statev.Adams,864S.W.2d31(Tenn.1993).InStatev.Hayes,899 h+&* S.W.2d175,185(Tenn.Crim.App.1995),thiscourtruledthatevidencethatthevictimwasunable  toresist,unabletosummonhelp,orunabletotestifyagainsttheperpetrator,wouldindicate  particularvulnerability.Findingsoffactmadeinthetrialcourtareconclusiveonthiscourtunless  theevidencepreponderatesotherwise.Gravesv.State,512S.W.2d603,604(Tenn.Crim.App. t 1973).UX!XX\X! `   Atthesentencinghearing,thevictimssisterinlaw,BrendaBrewer,testifiedasfollows 8  regardingthevictimsmentalstatus: $ t 8  [Thevictim]wasinanautomobileaccidentwhenhewasjustayoungboy,about  L  fifteenyearsold.Anditmentally...donesomethingtohim.Becausehewasina  8  comaforsixmonths,....Andhewas...likeachild.Imean,hewasagrownman, $  buthewas...stilllikeachildinsomanyways.    Ms.Breweralsostatedthatthevictimwasunabletokeepajobbecauseofhis mind.She   acknowledgedthatshehadnotknownthevictimpriortotheautomobileaccident.     Inapplyingenhancementfactor(4),thetrialcourtmadethefollowingfindings: \ 8   ` Also,thementalconditionofthevictim,Ididconsiderthat.Fromtheproof, 4 heisamanthathasbeendisabledbecauseof...thementalimpactofaserious  p wreck.Hesbeendisabledallofhislife.Andwasdescribedbyafamilymemberas  \ havingmoreofachildlikementality,whichwouldimpacthisabilitytoappreciate H whatwasgoingonandreactlikeanormalpersonwouldunderthecircumstances.4     Inourview,therecorddoesnotsupporttheapplicationoftheenhancementfactor.Thatthe   victimwas likeachildinsomanywaysprovideslittle,ifany,insightintothevictimsdegreeof  vulnerabilityandfallsshortofestablishingtheexistenceofamentaldisability.Moreover,thereis  noevidencetosuggestthatthevictimsmentalstatuswouldhaverenderedhimunabletoresist,  unabletosummonhelp,orunabletotestifyagainstthedefendant.Theapplicationofenhancement l factor(4)waserroneous. X    #\X!XXUX!wD#Inthisappeal,thestateurgesthiscourttoapplyenhancementfactor(9),thatthedefendant 0"  possessedoremployedadeadlyweaponduringthecommissionoftheoffense.SeeTenn.Code #l!
