Thevictimwaswalkingdownthestreetwhenthedefendantapproachedhimandaskedformoney.Whenthevictimrefused,thedefendantkickedhim,tookhiswallet,andremovedfortytwodollars($42.00)fromit.Thedefendantalsotookthevictimspocketknife,openedit,andtoldthevictimhewasgoingtocuthisthroat.Thealtercationwiththedefendantbruisedthevictimsarm,shoulder,andhip.Thepolicewerecalled,andthedefendantwasfoundlyingunderabushbehindanearbyhouse.Inthedefendantspocketwasfortytwodollars($42.00)andthevictimspocketknife.Thevictimpositivelyidentifiedthedefendantasthemanwhorobbedhim.  Basedonthisevidence,thejuryfoundthedefendantguiltyofrobbery.Atthesentencinghearing,defensecounseladmittedthedefendantwasaRangeIImultipleoffenderandthathispossiblesentenceforrobbery,aClassCfelony,wassixtotenyears.SeeT.C.A.4035112(b)(3).Thetrialcourtfoundtwoenhancementfactors:thatthedefendanthadapriorcriminalhistoryandthatthedefendanthadexhibitedanunwillingnesstocomplywithconditionsinvolvingreleaseinthecommunity.SeeT.C.A.4035114(1),(8).Thetrialcourtplacedgreatweightonbothofthesefactorsandfoundnomitigatingfactors.Assuch,thetrialcourtgavethedefendantthemaximumsentenceoftenyearsintheDepartmentofCorrection.  Thedefendantfirstarguesthattheevidencewasinsufficienttoconvicthimofrobbery.Whenanaccusedchallengesthesufficiencyoftheconvictingevidence,wemustreviewtheevidenceinthelightmostfavorabletotheprosecutionindeterminingwhether anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyondareasonabledoubt.Jacksonv.Virginia,443U.S.307,319(1979).WedonotreweighorreevaluatetheevidenceandarerequiredtoaffordtheStatethestrongestlegitimateviewoftheproofcontainedintherecordaswellasallreasonableandlegitimateinferenceswhichmaybedrawntherefrom.Statev.Cabbage,571S.W.2d832,835(Tenn.1978).  Contrarytothedefendantssuggestion,thevictimstestimonyneednotbecorroboratedinordertosustainaconvictionforrobbery.Moreover,anyinconsistenciesinthetestimonyofthetrialwitnesseswouldbeleftforthejury,notthisCourt,toresolve.Id.Further,anytestimonybythevictimthathewasnotfearfulofthedefendantisirrelevanttotheconvictioninthiscaseasthedefendantwasindictedandconvictedofrobberybyviolence,notrobberybyplacingthevictiminfear.T.C.A.3913401(a)(definingrobberyas theintentionalorknowingtheftofpropertyfromthepersonofanotherbyviolenceorputtingthepersoninfear)(emphasisadded).Here,theStateprovidedampleevidenceuponwhichthejurycouldconcludethatthedefendantintentionallyorknowinglytookthevictimspropertybyviolence.Assuch,thedefendantsargumentmustfail.  Thedefendantalsoarguesthatthesentenceimposedwasexcessiveconsideringthatthepropertyhestolefromthedefendantwasworthsolittle.Thedefendantdoesnotchallengetheenhancementfactorsfoundbythetrialcourt.Instead,thedefendantarguesthatthetrialcourterredinfailingtoconsidermitigatingfactor(13), anyotherfactorconsistentwiththepurposesofthischapter,seeT.C.A.4035113(13),toconcludethatrobbingavictimoffortytwodollars($42.00)andapocketknife isnotarobberywhichwouldrisetotheneedtoenhancethedefendantssentencetoitsmaximumlimitoftenyears.Thisargumentisakintoaconvictedcrackcocainedealerarguinghissentenceshouldbeshortenedbecausetheamountofcrackcocainehesoldwassmall.SeeStatev.TonyBryant,C.C.A.No.288,BradleyCounty(Tenn.Crim.App.filedApril15,1991,atKnoxville).Thedefendantwasconvictedofrobberybyviolence;thevalueofpropertythevictimhappenedtobecarryingatthetimeisnotastatutorymitigatingfactor.Thisargumentiswithoutmerit.       _________________________________       JOHNH.PEAY,Judge̜CONCUR:̜______________________________̜JOSEPHM.TIPTON,Judge______________________________̜DAVIDG.HAYES,Judge
