(    OnAugust14,1997,thepetitionerwaschargedwithaggravated ` sexualbattery.Oneandonehalfmonthslater,thepetitionerenteredanagreement , wherebyhepledguiltytoattemptedaggravatedsexualbattery.Thetrialcourt X imposedaRangeI,fouryearsentencetobeservedinacommunitycorrections $ program.Afterward,thestateissuedawarrantforthepetitioner,allegingthathe  hadviolatedthetermsofhisrelease.InFebruaryof1998,thetrialcourtordered  \ thesentencetobeservedintheDepartmentofCorrection.Approximatelyone "( monthlater,thepetitionerfiledthispetitionforpostconvictionreliefallegingnewly T$ discoveredevidence,ineffectiveassistanceofcounsel,andothergrounds.  &  Afterward,counselwasappointedforthepetitionerandanamendedpetitionwas '" filedwhereinthepetitionerclaimedthathispleawasneitherknowinglynor )X $ voluntarilyentered.Morespecifically,thepetitionercomplainedthatatthetimeof +$"& theplea,"hewasnotreceivingnecessarymedicationforhismentalproblems."The P-#( petitioneralsoallegedthathe"incorrectlybelievedthatifhepledguilty,hewouldbe /%* abletogetoutofjail,investigatehiscase,andpresenthiscasetothecourt." 0',   Attheevidentiaryhearing,thepetitionertestifiedthatjustpriortohis 4 +0 arrest,hehadbeenhospitalizedforthirtydaysinHenderson,Nevada,fortreatment L6,2 ofdepressionandabipolardisorder.HewasprescribedProzac,Trazodone,and 8.4 Trilafon.ThepetitionertestifiedthatfromthetimeofhisarrestonAugust14,1997, `  untilhispleaofguiltoneandonehalfmonthslater,hedidnotreceiveanyofhis ,  prescribedmedications.Heclaimedthathewasnotawareoftheelementsofthe   offenseofattemptedaggravatedsexualbatteryanddidnotrealizethatthestate d hadtheburdentoprovehisguilt.Hemaintainedthathewasuncertainasto 0 whetherthechargewasamisdemeanororafelony.Hestatedthathewasunable \  tomakebailandthathepledguilty"justtogetout."Hecontendedthathedidnot (  recallanythingabouttheguiltypleaproceeding.Whenaskedifhewouldhavepled   guiltyhadhebeentakinghisprescriptionmedicationatthetime,thepetitioner ` answered,"Probablynot." ,   Oncrossexamination,thepetitionerconcededthathehadbeen"in $ andoutofjailfortwentytwoyears....Heacknowledgedthathehadpledguiltyon  otheroccasionsandunderstoodthatwhenhedidso,hewouldreceiveasentence.  \ Heexplained,however,thathe"thoughtitwasabunchofb.s.tobehonestwith "( you...."Thepetitioneracknowledgedthatheenteredaninformationagreement, T$ admittinghisguilt,withinsevendaysofhisarrest.Thepetitioneracknowledgedthat  &  hesignedaguiltypleapetitionfreelyandvoluntarilyandhadplentyoftimeto '" discussitscontentwithhisattorney. )X $   Thepetitioner'strialcounselalsotestifiedattheevidentiaryhearing.
