I.FACTUALBACKGROUND    OnApril22,1994,AppellantwasstoppedataroadblockonHighway127inFranklinCounty,Tennessee.WhenapproachedbyaTennesseeHighwayPatrolofficer,Appellantreportedlyappearedtobeintoxicated. TheofficerinstructedAppellanttopullhiscarintoaparkinglot.Appellantwasthengivenaseriesoffieldsobrietytestsbytheofficer.Asaresultofthesetests,AppellantwasarrestedandchargedwithDUI.WhentheofficercheckedAppellantsidentificationinformationthecheckrevealedthatAppellantsdriverslicensewasrevoked;subsequentlyAppellantwaschargedwithdrivingonarevokedlicense. AppellantwasindictedbytheGrandJuryofFranklinCountyinafourcountindictment,whichchargedAppellantwithdrivingundertheinfluence,drivingundertheinfluence,thirdoffense,drivingonacanceled,suspended,orrevokedlicense,anddrivingonacanceled,suspended,orrevokedlicense,thirdoffense.Attrialonthesecharges,thejuryreturnedaverdictofnotguiltyonthecountinvolvingdrivingundertheinfluenceandguiltyonthecountinvolvingdrivingonacanceled,suspendedorrevokedlicense.Thefourthcountofdrivingonacanceled,suspendedorrevokedlicensethirdoffensewastriedbythejudge.Duringthebenchtrial,AppellantpointedouttothejudgethatthewaiverofattorneywhichappearedonthereversesideofthedrivingonarevokedlicensecitationdatedFebruary18,1991seemedirregular,becauseitdidnotlistanyoftheproceduralsafeguardsthataccompanyaconstitutionalwaiver.Thejudgeagreedastotheirregularappearanceofthewaiver,butstatedthatthecourtinwhichthematterwasheardwouldhavearecordofthatproceeding.Appellantwasfoundguiltyofdrivingonarevokedlicensethirdoffense.̀   II.ATTACKUPONANUNDERLYINGCONVICTION    AppellantallegesthatthetrialcourterredinrelyingontheFebruary1991guiltypleawhichdoesnotaffirmativelyestablishonthefaceofthepleathatthestatutoryandconstitutionalprotectionsrequiredforaneffectivepleawereeverundertaken.AppellantarguesthatbecausetherecorddoesnotestablishavalidwaiveroftheAppellantsrighttocounselatthepleaproceedinginFebruary1991,thisCourtshouldreverseanddismisshisconvictionfordrivingonarevokedlicense,thirdoffense. InStatev.Prince,781S.W.2d846,theSupremeCourtaddressedthisissueinholdingthatadefendantmustcollaterallyattackanyinfirmunderlyingconvictionsbeforeahecanattackasubsequentconvictionbasedonthosepriorconvictions. `   `  `   [I]tisincumbentuponadefendanttoestablishtheinvalidityofpriorguiltypleasbeforehecanprocedurallylaunchacollateralattackinasubsequenthabitualcriminalsentenceonthatbasis.Ifhehasnotpreviouslydonesoitmustbeestablishedatanappropriatehearingforthatpurposethathehasnotknowinglyandunderstandinglywaivedanygroundshemayhavewhichwouldunderminethevalidityofapriorguiltyplea.Thefactcannotbeestablishedonasilentrecord.Boykin,395U.S.[238,]at242,89S.Ct.[1709,]at1712.Thepetitionmustbefiledinthecourtwheretheearlierconvictiontookplacetoattacktheconstitutionalvalidityofthepriorconviction.Adefendantsuccessfulinsuchaproceedingmaythenexposetheenhancedsentenceonthesubsequentconvictiontoacollateralattackaswell.   `      Statev.Prince,781S.W.2d846,852(Tenn.1989). JustastheunderlyingconvictionsinPrincewerefaciallyvalid,theFebruary1991convictionAppellantseekstochallengeisfaciallyvalid.TheAppellantssignaturedoesindeedappearunderthewaiverofcounselportionofthedocument.Therefore,itisfaciallyvalid.SeeStatev.McClintock,732S.W.2d268(Tenn.1987);Statev.Cottrell,868S.W.2d673(Tenn.Crim.App.1992).ThisCourtisunabletodeterminethemeritofhisallegationregardingthe1991guiltypleauponthisrecord.Theappropriaterouteforoverturningapriorconvictionasaresultofaninvalidwaiveroftherighttocounselistofileapostconvictionproceedingwithinthestatuteoflimitations.
