First,wenotethatseveralpanelsofthisCourthavedeclinedtofollowtheholdinginHill. 4   ׀OurSupremeCourthasgrantedpermissiontoappealandiscurrentlyreviewingthatdecision.It,therefore,doesnothaveprecedentialvaluewiththisCourt.̀ Itiswellestablishedthatchallengestothesufficiencyofanindictmentcannotbetestedinahabeascorpusproceeding.Underwoodv.Bomar,335F.2d783,788(6thCir.1964);Brownv.State,445S.W.2d669,674(Tenn.Crim.App.1969);Haggardv.State,475S.W.2d186,187(Tenn.Crim.App.1971).Itis,however,equallywellestablishedthatanexceptiontothegeneralpropositioncanbemadeiftheindictmentissofatallydefectivethattheconvictingcourtlackedjurisdictiontorenderjudgment.Myersv.State,462S.W.2d265,267(Tenn.Crim.App.1970). Intheinstantcasetheappellantcontendsthathisindictmentfailedtoallegetherequisitemensreaforaggravatedrapeandis,therefore,fatallydefective.Wefindthattheallegeddefect,evenundertheappellantsinterpretation,wouldnothavedeprivedthetrialcourtofjurisdiction.Therefore,thisissueisnotproperforhabeascorpusreview. Moreover,eveniftheindictmentforrapeweresodefectiveastodeprivethecourtofjurisdictionontherapeconviction,thishabeascorpuspetitionerremainslawfullyconfinedontherobberyconvictions.Thelattersentencesdonotexpireforseveralmoreyears.Thus,thepetitionerwouldnotbeentitledtoimmediaterelease.  _____________________________________  GaryR.Wade,Judge
