TheappellantisatwentytwoyearoldelectricalengineeringstudentattheUniversityofMemphis.InMayof1995,theappellantandseveralfriendswenttoafestivalknownas MemphisinMay.Astheywereleavingthefestival,theappellantsfriend,ChrisBelue,stoppedtousetherestroom.Theappellantandhisotherfriendswalkedontowardtheircar.TheythenheardBelue holleringforthemtocomeback.Thevictim,TimothyEvans,hadBeluebythewrist.EvanssawthatBeluehadenteredavehiclewithouttheownersconsent.ApparentlyEvanswasavolunteeratthefestivalandintendedtotakeBeluetothepoliceforquestioning.BeluetoldEvansandtheappellantthatagirlhadgivenhimpermissiontogetcigarettesoutofawhitecar.TheappellanttoldEvanstoletgoofBelue.Evansrefused,sayingthathewastakingBeluetothepolice.TheappellantbrokeEvansgriponBelueswrist.TheappellantclaimsthatEvanspulled somethingoutofhispocket.Theappellantclaimsthathisfriendswhowereseveralfeetbehindhimstated Watchout.Hesgotsomething.TheappellantlaterlearnedthatEvanspulledoutscissors.TheappellantkickedatEvanshandtwiceandswungathimtwice.HeactuallyhitEvansinthehipasheswungatEvanshand.Evansleftandnotifiedthepolice.Theappellanttestifiedthatheandhisfriendswalkedtowardtheircartoleave.Severalminuteslater,thepolicearrestedtheappellant.Theappellanttestifiedthathedidnotgotothepolicetoresolvetheissuebecausehewastiredandhadtogetupearlythenextmorningtogotowork.TheappellanttestifiedthathethoughtthatEvanswaspickingonBelue.TheappellantdidnotbelievethatBeluehaddoneanythingwrong. Thecourtalsoconsideredthepresentencingreport.Evansandthepolicegaveaslightlydifferentaccountoftheeventsthantheappellant.Evansstatedtothepolicethattheappellantmadetwoaggressiveattemptstocuthimwithasixinchhuntingknife.Evansstatedthatiftheappellantsfriendshadnotintervened,he,Evanswouldhavebeenmurdered.Evansstatedthattheappellant reekedofalcohol.FromtherecorditappearsthatthepolicereportindicatesthattheappellantpulledaknifeonEvansandthreatenedhim.ThereportalsoindicatesthatthepolicehadtochasetheappellantandBelue.  `  pYTheappellantdeniedthathehadasixinchhuntingknife,butadmittedthathedidhaveasmallpocketknife.HedeniedpullinganykindofknifeonEvans.HedeniedthathemadethethreateningstatementstoEvans.Hedeniedthatthepolicechasedhim.  AssaultisaclassAmisdemeanorpunishablebyuptoelevenmonths,twentyninedaysinjail.Tenn.CodeAnn.3913101(b)(1990),4035111(e)(1)(1989).Thecourtdeniedtheappellantsapplicationforasuspendedsentence.Hesentencedtheappellanttoservethirtydays.Thecourtallowedtheappellanttoservethetimeonweekendsornonconsecutivedayswhentheappellantwasnotinschool.Thecourtfoundthattheappellantlackedcredibility.Thecourtdidnotbelievethattheappellantwastellingthewholestoryabouttheoffenseinquestion.Thecourtfoundthattheappellanthadahistoryofcriminalconvictionsinvolvingassaultandahistoryofcriminalbehavior.Theappellantwasconvictedofassaultin1993.HewasarrestedfororconvictedofbatteryorassaultandbatteryinArkansas.Hewasarrestedforpublicintoxicationanddisorderlyconductin1993.Atthetimeoftheoffense,theappellantwasoutonbondforpossessionofacontrolledsubstance.Thetrialcourtalsofoundthatsuspendingtheappellantssentencewoulddepreciatetheseriousnessoftheoffense.Fromtherecord,itappearsthatthecourtwasconcernedabouttheappellantscockyattitudeandinabilitytoappreciatetheseriousnessoftheoffense.Pastattemptsatrehabilitatingtheappellantwithmeasureslessrestrictivethanincarcerationhavefailed.Thecourttookintoconsiderationthattheappellantwasinschoolandwasgainfullyemployed. Whenanappellantchallengesthemannerofserviceofasentence,thisCourtreviewstheevidencedenovowithapresumptionthatthedeterminationsofthetrialcourtarecorrect.Tenn.CodeAnn.4035401(d)(1990).Thepresumptionofcorrectnessisconditioneduponanaffirmativeshowingthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991). Misdemeanorsentencesmustbespecificandinaccordancewiththeprinciples,purposesandgoalsoftheCriminalSentencingReformActof1989.Statev.Palmer,902S.W.2d391,394(Tenn.1995).Thetrialjudgeshallfixapercentageofthesentencethatthedefendantshallserve;afterservice,thedefendantiseligibleforrehabilitativeprograms.Tenn.CodeAnn.4035302(b)&(d)(Supp.1994);Palmer,902S.W.2dat394.Alternatively,thecourtcangrantprobationimmediately,orafteraperiodofsplitorcontinuousconfinement.Tenn.CodeAnn.4035302(e)(1)&(2). Weaffirmthejudgmentofthetrialcourt.Theevidenceamplysupportsthecourtsdenialoftheappellantspetition.Theappellantslackofcredibility,hispriorhistoryofcriminalbehavior,andthefailureofpastrehabilitationaresupportedbytheevidence.Theyareappropriatefactorsuponwhichtodenyprobation.
