Ð$437.30,€and€that€the€replacement€cost€of€the€radio€was€$119.35.Ð $X" ÐÌà  àRandy€Simmons,€an€employee€of€Car€City,€testified€that€he€went€with€Ms.€Goins€to€theÐ à%0!$ ÐDefendantððs€residence€to€pick€up€the€truck.€€He€testified€that€there€was€no€battery€on€the€truck,€so€heÐ Ì&"% Ðput€a€battery€on€it.€€According€to€Mr.€Simmons,€when€he€installed€the€battery,€the€Defendant€cameÐ ¸'#& Ðaround€him€and€jerked€the€coil€wire€off€the€truck.€€The€Defendant€told€Mr.€Simmons€that€he€wasÐ ¤(ô#' Ðgoing€to€take€his€tag€off€the€truck.€€Mr.€Simmons€then€heard€ð ðsomething€like€scratch€marksðð€as€theÐ )à$( ÐDefendant€was€walking€around€the€vehicle€and€ð ðscratching€the€side€of€the€truck.ðð€€Mr.€SimmonsÐ |*Ì%) Ðtestified€that€the€Defendant€pitched€the€coil€wire€back€over€the€truck,€and€Mr.€Simmons€then€put€theÐ h+¸&* Ðcoil€wire€back€on€the€truck€and€left.€€Mr.€Simmons€noticed€the€missing€passenger„side€rearviewÐ ° Ðmirror€and€the€missing€radio,€and€he€also€noticed€that€the€windshield€was€cracked.Ð œì ÐÌà  àScott€Kanavos,€a€nephew€by€marriage€of€Billie€Goins,€testified€that€he€attempted€to€help€hisÐ tÄ Ðaunt€and€the€Defendant€resolve€ð ðthe€whole€thing.ðð€€He€drove€the€Defendant€from€General€SessionsÐ `° ÐCourt€to€the€Defendantððs€residence€to€enable€the€Defendant€to€turn€the€truck€over€to€Ms.€Goins.€Ð L œ ÐAlthough€Mr.€Kanavos€was€some€distance€from€the€truck€and€the€other€persons€present€during€theÐ 8 ˆ Ðrepossession,€his€testimony€generally€corroborated€the€testimony€of€Ms.€Goins€and€Mr.€Simmons.Ð $ t ÐÌà  àThe€Defendant€testified€that€he€bought€the€truck€on€November€5,€1998.€€According€to€theÐ ü L  ÐDefendant,€at€the€time€of€the€purchase€the€truck€had€mechanical€problems€and€ð ðwouldnððt€hardly€run.ðð€Ð è 8  ÐThe€Defendant€testified€that€Car€City€had€repossessed€his€wifeððs€vehicle€for€failure€to€makeÐ Ô$  Ðpayments.€€His€wife€had€left€her€purse€in€the€vehicle€at€the€time€of€the€repossession,€and€theÐ À  ÐDefendant€testified€that€Ms.€Goins€told€him€that€she€would€not€give€him€his€wifeððs€purse€until€heÐ ¬ü  Ðgave€her€the€truck.€€The€Defendant€testified€that€he€and€his€wife,€accompanied€by€a€police€officer,Ð ˜è  Ðwent€to€Car€City€and€obtained€his€wifeððs€purse.€€At€that€time,€Ms.€Goins€told€the€Defendant€to€bringÐ „Ô  Ðin€the€truck€by€10:00€the€next€morning.€€The€Defendant€informed€Ms.€Goins€that€he€did€not€have€aÐ pÀ Ðdriverððs€license€and€that€he€would€not€drive€the€truck€to€Car€City€and€risk€getting€caught€drivingÐ \¬ Ðwithout€a€license.€€He€did€advise€Ms.€Goins€that€she€was€ð ðmore€than€welcomeðð€to€come€and€get€theÐ H˜ Ðtruck.€€Although€the€exact€time€frame€is€not€clear€from€the€Defendantððs€testimony,€it€appears€thatÐ 4„ Ðshortly€after€this€discussion,€Ms.€Goins€obtained€the€general€sessions€warrant€against€the€DefendantÐ  p Ðfor€hindering€a€secured€creditor.€€Ð  \ ÐÌà  àThe€Defendantððs€wife€paid€$500.00€on€the€bond€to€obtain€the€Defendantððs€release€on€theÐ ä4 Ðgeneral€sessions€warrant.€€On€the€General€Sessions€Court€date,€a€dispute€arose€between€Ms.€GoinsÐ Ð  Ðand€the€Defendant€over€the€payment€of€court€costs€for€the€general€sessions€warrant.€€However,€withÐ ¼  Ðthat€dispute€unresolved,€the€Defendant€rode€with€Scott€Kanavos€to€the€Defendantððs€home€to€facilitateÐ ¨ø Ðthe€repossession€of€the€truck€by€Car€City.€€Ð ”ä ÐÌà  àThe€Defendant€claimed€that€at€the€time€he€purchased€the€truck,€the€truckððs€windshield€hadÐ l¼ Ða€crack€ð ðgoing€all€the€way€across€the€bottom,€stretching€all€the€way€from€the€driverððs€side€to€theÐ X ¨ Ðpassengerððs€side€across€the€bottom.ðð€€The€Defendant€agreed€that€Car€City€had€the€right€to€repossessÐ D!” Ðthe€truck.€€The€Defendant€testified€that€he€had€told€Ms.€Goins€that€he€planned€to€take€the€battery€offÐ 0"€  Ðthe€truck€because€ð ðthere€was€no€battery€on€it€when€I€purchased€it€and€I€put€my€battery€in€it€and€IððmÐ #l!
