X XOnApril27,2000,Mr.andMrs.Owensreturnedhomefromarevivalserviceattheir x  churcharoundtenoclockp.m.Theyenteredthebusinessthroughthefrontdoor,andthe ^  telephonewasringing.Mrs.Owensansweredthetelephone.Whileshewasonthetelephone, D  Mr.Owensmotionedtoherthathewasgoingtotheworkshoplocatedinthebackofthe *z  businesstodosomework.Uponenteringtheworkshop,Mr.Owensnoticedthataman,whohe ` lateridentifiedtobethedefendant,wasstandingnearthebackdoor,whichwasclosedand F locked.Mr.Owensrepeatedlyaskedthedefendantwhathewasdoingbutreceivednoverbal , response.Mr.Owensbeganshoutingforhiswifetocallthepolice.Accordingtohistestimony,  Mr.Owensobservedthedefendantforfourorfiveminutes.Allthelightswereon,andthe  defendantwasstandingapproximatelyfiftyfeetawayfromhim.Afterinstructinghiswifeto  callthepolice,Mr.Owenspretendedtoreachforaweapon,andthedefendantrespondedby t startingtounlockthebackdoor,whichwassecuredbyabaracrossitandtwodeadboltlocks. H  X XOfficerJasonShawtestifiedthathewasonpatrolintheareanearFayesCeramicsonthe  d nightofthebreakin.Shortlyaftertenoclockp.m.,OfficerShawnoticedawhitecarpulloutof  J aparkinglotafewblocksupfromthedirectionhewasdrivinghispolicecar.Thecars  0 taillightswerenoton,anditpulledontothestreetatahighrateofspeed.OfficerShaw    respondedbyacceleratingtocatchupwiththecar.Ashewasaccelerating,thedispatcher    radioedthattherewasabreakininprogressatFayesCeramics.OfficerShawimmediately   radioedandinformedthedispatcherthathewasfollowingapotentialsuspect.OfficerShaw x  thenproceededtopullthecaroverandorderthedrivertoexitthecar.Thedriverofthecarwas ^  thedefendant.Hewaswearingagreyjacketandlighttanpants,whichwerecoveredwithalight D  coloreddust.Healsohadonroundeyeglasses. *z   X XWhilethedefendantwasbeingdetainedbyOfficerShawonthesideoftheroad,another F officerdrovebywithMr.Owens.Astheofficerdroveby,heshoneaspotlightonthedefendant , topreventhimfromseeingMr.Owensinsidethepolicecar.Mr.Owenidentifiedthedefendant  asthemanwhobrokeintohisresidence.Thereafter,thedefendantwasplacedunderarrest.A  searchofhiscarrevealedahammerandscrewdriverunderthedriversseatandapairofbrown  workglovesbesidetheseat.Thegloveswerealsocoveredwithalightcoloreddust. t  X XThedefendantgaveanaudiotapedstatementatthepolicestationafterhisarrest.He @ deniedbreakingintothevictimshome.Hetoldpoliceofficersthathehadbeenplayinggolf &v earlierthatday.Healsoclaimedthathehadcartroubleandhadworkedonhiscarpriortobeing  \ stoppedbyOfficerShaw. B  X XOfficerJohnRamseytestifiedthatherespondedtoacallreportingabreakinatFayes  Ceramics.Uponarrival,hefoundsignsofforcedentrythroughthetransomoverthebackdoor.  Theentrancetothebackdoorwaslocatedinthealleybehindthebuilding.OfficerRamsey   introducedphotographsofthebackdoor,whichdepictedtheopeningthathadbeenforcedopen p!  abovethedoor.Coveringtheopeningwasaboardthatappearedtohavebeenpriedopen. X XAfterinspectingtheOwensresidence,OfficerRamseydroveMr.Owensbythelocation b wherethedefendantwasbeingdetainedbyOfficerShaw.Thedefendantwasstandingoutside H hiscarwithseveralpoliceofficers.OfficerRamseyilluminatedthedefendantwithhisspotlight . ~ astheydroveby,andMr.Owensimmediatelyidentifiedthedefendantasthemanhesawinside  d hisresidence.OfficerRamseyalsonoticedthatthedefendantwascoveredwithalightcolored  J dust.  0  X XThedefendantsmotherandanofficeratthejailwherethedefendantwashousedafter    hisarresttestifiedforthedefense.OfficerPembertontestifiedthatafewweeksafterthe   defendantsarrest,hetransportedthedefendanttoadoctoronatleasttwooccasions.Officer x  Pembertonaccompaniedhimintotheexaminationroomwhereheobservedanopensoreonthe ^  defendantslegandabrasionsonhisfeet.OfficerPembertonalsoobservedthatthedefendant D  walkedwithalimpandfavoredonelegasaresultofhisinjuries. *z   X XThedefendantsmother,RuthBelcher,testifiedthatthedefendantwasinaseriouscar F accidentexactlyamonthbeforehisarrest.Asaresultofhisinjuries,hisabilitytowalkwas , impairedduringthetimethathewasarrested.Ms.Belcheralsotestifiedthatthecarthe  defendantwasdrivingwhenhewasarrestedhadpeelingpaint.Sheattemptedtocoverthe  peelingpaintbysprayingwhitespraypaintonthecar.Thespraypaintwasnotcarpaint,  however,andwouldruboffiftouchedleavingawhitedustonanythingthatcameincontact t withit.Sheverifiedthecaralsohadsomemechanicalproblems.Finally,Ms.Belcherindicated Z thatsheanddefensecounselhadtakenmeasurementsoftheopeningabovethebackdoorat @ FayesCeramics.Itwassevenfeetfromthegroundtothebottomoftheopening.Theopening, &v whichwasshapedliketheletter T,wasfifteeninchestall,thirtyfourincheswideatthetop,  \ andtwentysevenincheswideatthebottom. B   (  X  ANALYSIS     XThedefendantchallengesthesufficiencyoftheevidencetosupporthisconvictionfor   possessionofburglarytools,aClassAmisdemeanor.Inaddition,thedefendantallegesthathe p!  wasunfairlyprejudicedbytheadmissionofatapedstatementcontainingareferencetohis V"! parolestatusatthetimetheinstantoffensewascommittedandis,therefore,entitledtoanew <#" trial. Grace,493S.W.2dat476. x     ^    XXXXXX    M  Theindictmentintheinstantcaseallegesthatthedefendantcommitted theoffenseof D  possessionofburglarytoolsbyknowinglypossessingascrewdriverandahammerwiththe *z  intenttouseitorallowittobeusedtocommitburglary....TennesseeCodeAnnotated ` section39-14-701providesthat [a]personwhopossessesanytool,machineorimplementwith F intenttousethesame,orallowthesametobeused,tocommitanyburglary,commitsaClassA , misdemeanor.TheevidenceviewedinthelightmostfavorabletotheStateestablishedthatthe  defendantforciblyenteredthevictimsresidence/businessbycrawlingthroughanopening  directlyoverthebackdoor.Theopeningwassevenfeetfromthegroundandcoveredbya  board.Theproofestablishedthatthedefendantwouldhavehadtostandwithonefootontopof t athreeandonehalffootconcretepostlocatedabouttwofeettotherightoftheopeningandpry Z theboardopen.Therewasascreenbehindtheboard,whichwasalsotornopen.Thereafter,the @ defendantwouldhavehadtohoisthimselfupandintotheopeningandthendropdownintothe &v building.Inaddition,theevidenceestablishedthatthedefendantwasapprehendedinhiscara  \ fewmilesfromthevictimsbusiness/residence.Aninventorysearchofthecarrevealedthat B therewasahammer,ascrewdriver,andapairofglovesbesidetheseat.MN݌ ( Ќ    XXXX XX  X  XTheStateassertsthattheaforementionedevidencewassufficienttosupportthe  defendantsconvictionforpossessionofburglarytools.Specifically,theStatemaintainsthatthe   jurycouldclearlyinferfromsuchfactsthatthedefendant woretheglovesandusedthehammer p!  andscrewdrivertopryopentheboardedvent,tearthroughthewirescreenandenterthe V"! [victims]habitation.Wedisagree.Wefirstnotethattheglovesmaynotbeusedtoestablish <#" thecrimebecausetheywerenotallegedintheindictment;therefore,thedefendantwasnot "$r# providedhisconstitutionalrighttonoticethathewouldberequiredtodefendthechargebased %X $ uponhispossessionofthegloves.Thus,thedefendantsconvictionmustbesupportedby %>!% evidencethatthescrewdriverand/orhammerwereburglarytools. &$"&  X XWeacknowledgethatthejurycouldhavereasonablyinferredthatthedefendant used (#( thehammerandscrewdrivertopryopentheboardedvent,tearthroughthewirescreenandenter )$) the[victims]habitationbasedupontheevidencecitedbytheState.However,therecord l*%* containsotherevidencenotcitedbytheStatethatestablishedthatthedefendantdidnotusethe R+&+ hammerorthescrewdrivertogainentrytothevictimshome.Tobeginwith,thetoolswere 8,',5 7l} 7 0  7  recoveredfromthedefendantscar,nothisperson.Theevidenceestablishedthatthe  defendantscarwasparkedinaparkinglotaroundthecornerofthebuildingduringtheburglary  andthathehadtorundownanalleypasttwootherbusinessesinordertogettohiscar. |  X XThevictimtestifiedthatheobservedthedefendantinawelllightedroomforfourtofive H minutesanddescribedwhathewaswearingandhisapproximateheightandweight.Inaddition, . ~ thevictimtestifiedthatthedefendantdidnothaveanythinginhishandsduringthistime.  d Accordingtothevictim,thedefendantescapedfromthebuildingthroughthebackdoor.In  J ordertoopenthedoor,thedefendanthadtofirstremoveapipefashionedacrossthedoors  0 openingandthenunlocktwodeadbolts.Afterheexited,thevictimfollowedthedefendantashe    randownthealleyaroundthecornertohiscarandwatchedashedroveaway.Thedefendant    didnotstopandpickupanythingfromthegroundonhiswaytothecar.    X XTheinvestigatingpoliceofficer,OfficerRamsey,testifiedthathecouldnottellby ^  examiningtheboardandscreenwhatwasusedtoprythemopen.Hefurthertestifiedthatitwas D  possiblethattheintruderrippedthemopenwithhishands.Finally,therewasnootherevidence *z  presentedtosuggestthatthetoolswereusedtopryopentheboardandripthescreen. `  X Xm9)%`|0 !? `0*xE-&??L-=& mWeconcludethatthereisinsufficientevidencetoestablishthatthedefendantpossessed , thescrewdriverandhammerwithintenttousethemtocommitburglary.Baseduponallthe  evidencecontainedintherecord,viewedinthelightmostfavorabletotheState,thedefendant  didnotusethescrewdriverorhammertoforciblyenterthevictimshome.Tothecontrary,the  evidenceindicatesthatthetoolswereinthedefendantscarduringtheburglary.Furthermore,a t screwdriverandhammerareinnocenttoolsinandofthemselves.Therefore,possessionofthem Z byaburglarwithoutmoreisnotsufficienttoestablishthattheyareburglarytools.SeeStatev. @ Cox,644S.W.2d692(Tenn.Crim.App.1982)(findingevidencesufficientwheredefendants &v accomplicehadtwoscrewdriversandapairofpliersinhispocketandatireironwasfoundon  \ groundnearthedefendant);Statev.Rice,973S.W.2d639(Tenn.Crim.App.1997)(finding B sufficientevidencewheredefendanthadapairofpliers,ascrewdriverandaflashlightonhis ( personandadmittedthathehadthetoolswithhimsothathecouldstealaheadlight);Statev.  Morgan,929S.W.2d380(Tenn.Crim.App.1996)(findingsufficientevidencewherethree  flashlights,threepairsofwirecutters,twopairsofpliers,onescrewdriver,threetiretoolsand   variousothertoolswerefoundindefendantscarandevidenceintroducedthatpaintononeof p!  opaquetiretoolsmatchedpaintfromdoorthatwasforciblyopenedduringarecentburglary). V"! Becausethereisnoevidencefromwhichajurycouldreasonablyfindthatthedefendantusedthe <#" toolstocommittheburglaryofthevictimshomenorotherevidencethatthedefendanthadthe "$r# otherwiseinnocuoustoolsinhiscarwiththeintenttocommitburglary,thedefendants %X $ convictionforpossessionofburglarytoolsmustbereversedanddismissed. %>!%  X  ErroneousAdmissionofPrejudicialInformation ' #'  X   (#( Thedefendantallegesthathewasunfairlyprejudicedbytheadmissionofataped )$) statementthatcontainedinformationabouthisparolestatus.Atthetimeofhisarrest,the l*%* defendantwasonprobation/paroleforanoffensehecommittedinFlorida.Hetoldinvestigators R+&+ abouthisprobationstatusduringthetapedinterviewconductedafterhisarrest.Theaudiotapeof 8,',0* 8l} 8 0  8  thisinterviewwasadmittedasevidenceattrial,playedtothejury,andmadeavailabletothejury  duringtheirdeliberations.Accordingtotherecord,theStateandthedefendantbelievedthatall  referencestothedefendantspriorcriminalhistoryhadbeenredactedfromthetapebeforeitwas | playedtothejury.However,thequestion Doesyourprobationofficerknowyoureuphere? b remainedontheaudiotapedstatement.Thedefendantrequestedamistrialafterthetapewas H played,whichwasdeniedbythetrialcourt. . ~  X XAccordingtotherecord,thequalityofthetapewaspoor.Asaresult,itwasvery  J difficulttodiscernwhatwasbeingsaid.Althoughthedefenseattorneyheardthechallenged  0 statement,neitherthetrialjudgenortheprosecutorheardthestatement.Indenyingthe    defendantsmotionforamistrial,thetrialjudgefoundthatthejurydidnothearthestatement,    pointingoutthathedidnothearitandhewaspositionedclosertothetapethanthejury.   Assumingthatthejurydidnothearthechallengedstatement,thetrialcourtfoundthatitwould x  bebetterto leaveitaloneratherthaninstructthejuryonit.ThetrialcourtinstructedtheState ^  toredactthechallengedportionofthetapebeforeitwassubmittedtothejuryfordeliberation. D  Thetrialcourtfurtherassumedthatifanyofthejurorsheardthestatementwhenitwasplayedat *z  trial,heorshewouldknowwhyithadbeenremovedanddisregardthestatementduringtheir ` deliberationofthedefendantsguilt. F  X XBothpartiesagreethatinformationaboutthedefendantsprobationorparolestatusin  Floridawaserroneouslyadmitted.However,violationofanevidentiaryruledoesnot  necessarilymandatereversalofthecasebutissubjecttoharmlesserroranalysis.Statev.  Martin,964S.W.2d564,568(Tenn.1998).Therefore,sucherrordoesnotrequirereversal t unlessit affirmativelyappear(s)tohaveaffectedtheresultofthetrialonthemerits.Tenn.R. Z Crim.P.52(a).Baseduponourreviewoftherecord,weconcludethattheprejudicialeffectof @ theevidencethatthedefendantwasonprobationinFloridawasslight.First,itishighlyunlikely &v thatanyofjurorsheardthestatement.Neitherthetrialjudgenortheprosecutorheardthe  \ statementwhenthetapewasplayedatthetrial.Itwasonlyafterthetapewasplayedin B chambersthatthetrialjudgeandprosecutorwereabletodiscerntheobscurereferencetothe ( defendantsprobationstatusonthetape.Furthermore,thestatementwasredactedpriortobeing  submittedtothejuryfordeliberation.We,therefore,concludethatthereferencetothe  defendantsprobationstatuswasnotprejudicialconsideringthecircumstancessurroundingits   admissionandtheoverwhelmingevidenceofthedefendantsguilt.Thisissueiswithoutmerit. p!
