àIn€February€1995,€the€defendant€and€his€wife,€Denise€Belcher,Ïlived€in€and€managed€an€apartment€complex€in€Maryville.€€The€defendant€alsoÏowned€a€tractor„trailer€truck€and€worked€as€a€truck€driver€through€Transis.€€TheÏBelchers€had€several€friends€in€their€apartment€complex,€including€Joan€Huiet,Ïwho€lived€across€the€hall€from€them,€and€David€Allen,€a€truck€driver€who€wasÍMs.€Huiet's€occasional€boyfriend.€€Larry€Wyatt,€a€frequent€visitor€to€theÏapartment€complex,€was€a€truck€driver€who€Slater€Belcher€described€as€his€bestÏfriend.€€Wyatt€was,€at€the€time€of€his€death,€engaged€in€an€affair€with€theÏdefendant's€wife.€€He€was€also€a€former€lover€of€Joan€Huiet,€although€the€twoÏcontinued€to€maintain€a€close€friendship.ÌÌà àà àAt€trial,€the€testimony€of€many€of€the€principal€witnesses€wasÏcontradictory€on€key€points.ÌÌà àà àPrior€to€February€26,€1995,€the€Belchers€were€experiencing€maritalÏdifficulties.€€According€to€Mrs.€Belcher,€the€marriage€had€reached€the€pointÏwhere€she€was€ready€either€for€the€defendant€to€leave€or€to€leave€herself.€€Mrs.ÏBelcher€knew€the€defendant€was€suspicious€of€her€relationship€with€Wyatt,€butÏso€far€as€she€knew,€he€had€no€definite€knowledge€of€it.€€Unknown€to€Mrs.ÏBelcher,€Allen€had€confirmed€the€defendant's€suspicions€about€the€affair€a€fewÏdays€before€February€26,€and€Huiet€had€likewise€confirmed€the€affair€onÏFebruary€25.€€Huiet€testified€the€defendant€was€anxious€over€the€situation€priorÏto€her€conversation€with€him.ÌÌà àà àDuring€the€day€of€February€25,€1995,€€the€Belchers€argued,Ïalthough€Mrs.€Belcher€testified€her€husband€did€not€then€accuse€her€of€havingÏan€affair€with€Larry€Wyatt.€€Sometime€in€the€afternoon€or€early€evening€hours,ÏMr.€Belcher€went€to€his€mother's€house€in€Powell€so€Mrs.€Belcher€could€thinkÍabout€what€the€two€needed€to€do€about€their€relationship.€ÌÌà àà àWithin€a€few€hours€of€the€defendant's€departure,€Larry€WyattÏarrived€at€the€building.€€Wyatt€agreed€to€take€Huiet€to€the€grocery€store.€€While€atÏthe€store,€Huiet€implored€Wyatt€to€come€clean€with€the€defendant€about€his€affairÏwith€Mrs.€Belcher.€€Hueit€informed€Wyatt€she€had€told€the€defendant€about€theÏaffair€between€Mrs.€Belcher€and€Wyatt€and€asked€him€to€warn€Mrs.€Belcher.€ÏHuiet€and€Wyatt€also€devised€a€warning€signal€whereby€Huiet€would€alert€WyattÏof€danger€by€telling€him€some€flags€she€was€supposed€to€pick€up€for€him€hadÏnot€come€in.ÌÌà àà àAfter€Wyatt€returned€from€the€grocery€store,€he€and€Mrs.€BelcherÏdecided€to€go€to€his€trailer€home€nearby.€€Before€Mrs.€Belcher€left€the€building,Ïshe€took€her€cordless€phone€to€Huiet€and€asked€Huiet€to€call€her€if€theÏdefendant€returned€home.€€ÌÌà àà àThe€defendant€later€returned€and€came€to€Huiet's€apartmentÏlooking€for€the€cordless€phone.€€Huiet€testified€this€occurred€around€11:00€orÏ11:30€p.m.€€According€to€Huiet,€the€defendant€was€upset€because€he€had€beenÏstopped€by€a€police€officer€on€the€way€home.€€He€asked€Huiet€whether€sheÏcould€get€in€touch€with€Mrs.€Belcher.€€Huiet€called€the€Wyatt€home€with€theÏdefendant€standing€at€her€side€and€confirmed€that€Mrs.€Belcher€was€there.€€ÌÌà àà àAlthough€Huiet's€testimony€is€inconsistent€on€the€sequence€ofÏevents,€at€some€point€in€the€evening,€she€went€across€the€hall€to€check€on€theÏdefendant€and€found€him€sitting€at€the€kitchen€table€with€bullets€and€a€gun.€€TheÏtwo€discussed€the€defendant's€suspicions€about€his€wife's€affair€with€his€bestÏfriend.€€The€defendant€was€very€upset€and€asked€Huiet€why€this€was€happeningÏand€what€was€wrong€with€him.€€He€took€the€bullets€and€threw€them€across€theÏroom,€stating€he€had€better€get€rid€of€them€before€he€blew€his€brains€out.€€HeÏalso€took€the€gun€and€placed€it€on€a€high€shelf€in€the€kitchen.€€Huiet€was€soÏconcerned€about€the€defendant€she€suggested€they€go€to€the€emergency€room.ÌÌà àà àWithin€approximately€45€minutes€of€Huiet's€first€phone€call€to€theÏWyatt€residence,€the€defendant€requested€she€make€a€second€phone€call€andÏtell€Wyatt€and€Mrs.€Belcher€he€was€on€his€way€home.€€Huiet€testified€theÏdefendant€wanted€to€get€his€wife€and€Wyatt€back€to€the€apartment€complex€soÏhe€could€talk€to€them.€€Before€she€made€the€phone€call,€Huiet€received€theÏdefendant's€solemn€word€on€his€children's€lives€and€his€Masonic€square€that€noÏharm€would€come€to€Wyatt€or€Mrs.€Belcher.€€While€talking€with€Wyatt,€sheÏrelayed€the€"secret€code"€that€his€flags€had€not€come€in.ÌÌà àà àAfter€making€the€call,€Huiet€went€into€her€apartment€to€take€aÏshower.€€She€heard€the€defendant's€Camaro€crank€up€and€leave.€€SheÏrecognized€the€car€by€its€distinctive€sound.€€Before€she€could€intercept€WyattÏand€Mrs.€Belcher,,€she€heard€voices€of€the€defendant€and€Mrs.€Belcher.€€SheÍcould€not€make€out€the€defendant's€words,€although€she€heard€Mrs.€BelcherÏsay,€"Nothing's€going€on"€or€"Oh,€nothing."€€Next,€she€heard€the€defendantÏcalling€Wyatt€out€of€hiding€and€accusing€him€of€behaving€cowardly€€The€nextÏthing€Huiet€knew,€her€door€popped€open€and€the€defendant€was€yelling€forÏAllen€to€help€him€carry€Wyatt's€body€to€the€car.€€Wyatt€was€lying€on€the€floor€justÏoutside€Huiet's€doorway.€€Huiet€testified€the€defendant€said,€"I€didn't€mean€toÏhurt€him."€€She€denied€making€a€previous€statement€that€the€defendant€said,€"IÏdidn't€mean€to€shoot€him.€€He€jumped€me."€€Huiet€claimed€she€had€not€heard€aÏgunshot€and€did€not€realize€the€seriousness€of€the€victim's€injury.€€Dressed€in€aÏnightgown,€Huiet€stepped€over€Wyatt's€body€in€her€doorway€and€ran€out€theÏback€door€to€the€apartment€building,€where€she€entered€a€taxi€cab€in€which€Mrs.ÏBelcher€was€seated.€€She€testified€Mrs.€Belcher€said,€"He€shot€him."€€She€andÏMrs.€Belcher€left€the€building€in€the€cab,€went€to€Allen's€ex„wife's€home,€whereÏHuiet€borrowed€some€clothing,€and€Allen's€ex„wife's€boyfriend€drove€them€backÏto€the€apartment€building.ÌÌà àà àDenise€Belcher€testified€that€after€receiving€the€second€call€fromÏHuiet,€she€and€Wyatt€agreed€to€go€back€to€the€apartment€building€so€she€couldÏ"face€the€music"€regarding€her€affair.€€When€they€arrived,€Mrs.€Belcher€did€notÏsee€the€Camaro,€so€she€assumed€the€defendant€was€not€yet€home.€€She€andÏWyatt€went€inside€the€building.€€While€they€were€in€the€hallway€outside€herÏapartment,€she€heard€someone€walking€on€her€living€room€floor€and€knew€herÏhusband€was€home.€€She€looked€back€over€her€shoulder,€but€Wyatt€was€noÍlonger€behind€her.€€When€she€turned€around,€the€defendant€was€in€front€of€her.€ÏThe€defendant€was€dazed€and€angry,€and€he€demanded€to€know€where€sheÏhad€been.€€He€was€holding€a€stick,€later€determined€to€be€an€axe€handle,€in€hisÏhands.€€The€two€walked€into€their€apartment,€and€argued€about€Mrs.€Belcher'sÏwhereabouts€and€activities,€and€the€defendant€hit€Mrs.€Belcher€on€her€upperÏright€arm€with€the€stick.€€The€defendant€€€went€through€the€front€door€into€theÏhallway.€€Mrs.€Belcher€fled€the€apartment,€running€out€the€back€door€andÏjumping€into€a€taxi€cab€that€was€dropping€off€a€passenger€at€the€building.€€SheÏadmitted€telling€the€cab€driver€her€husband€was€going€to€hurt€someone.€€HuietÏcame€to€the€door€of€the€building€and€yelled€for€Mrs.€Belcher€to€come€back€in.€ÏMrs.€Belcher€refused,€and€Huiet€ran€out€to€the€taxi.€€Mrs.€Belcher€denied€tellingÏHuiet€that€the€defendant€shot€Wyatt,€although€she€admitted€telling€her€someoneÏwas€going€to€get€hurt.€€She€denied€hearing€a€gunshot€prior€to€leaving€theÏbuilding.ÌÌà àà àDavid€Allen,€a€convicted€felon€on€probation,€was€sleepingÏthroughout€the€evening€on€Huiet's€sofa.€€Both€he€and€Huiet€testified€he€is€a€veryÏsound€sleeper.€€Nevertheless,€Allen€testified€he€was€awakened€by€theÏdefendant€earlier€in€the€evening.€€The€defendant€had€a€stick€and€told€Allen€heÏwas€going€to€"talk€to"€Wyatt€with€it.€€Later,€Allen€was€again€awakened€by€theÏdefendant,€who€asked€him€for€help€moving€Wyatt's€body.€€Wyatt€was€at€this€timeÏlying€face€down€in€the€doorway€with€his€head€to€the€side€and€a€pool€of€blood€byÏhis€head.€€Allen€had€not€heard€any€of€the€preceding€events,€€and€did€not€realizeÍWyatt€was€dead.€€He€helped€the€defendant€carry€Wyatt's€body€outside€and€loadÏthe€body€into€the€back€seat€of€Wyatt's€Camaro.€€The€defendant€told€Allen€to€meetÏhim€at€Kay's€Ice€Cream,€which€was€a€few€blocks€away.€€Allen€went€inside€theÏbuilding€to€get€his€keys€and€some€clothing,€then€drove€to€Kay's.€€The€defendantÏwas€in€the€parking€lot€waiting€for€Allen€when€he€arrived.€€The€defendant€got€intoÏAllen's€car,€hit€the€dashboard€very€hard,€and€was€"hyper."€€According€to€Allen,Ïthe€defendant€had€been€nervous€and€stressed€out€earlier€in€the€day.€€TheÏdefendant€handed€Allen€a€baseball€cap€and€a€towel€and€asked€him€to€get€rid€ofÏthem.€€Allen€felt€a€gun€wrapped€up€in€the€towel€and€realized€the€gravity€of€theÏsituation.€€He€took€the€defendant€back€to€the€apartment€building,€then€went€to€aÏconvenience€store€and€threw€the€items€the€defendant€had€given€him€into€aÏdumpster.€€Allen€was€concerned€that€he€would€be€sent€back€to€prison€becauseÏof€his€involvement,€so€he€went€to€a€friend's€house€to€ask€him€what€to€do.€€WithinÏa€short€time,€Allen€alerted€law€enforcement€of€his€knowledge€of€the€crime.ÌÌà àà àThe€defendant€did€not€testify€at€trial,€although€his€recordedÏstatement€was€played€for€the€jury.€€In€the€statement,€the€defendant€said€he€cameÏhome€from€his€mother's€house€and€parked€his€car€down€the€road€because€heÏwanted€to€sneak€up€to€the€apartment€building€to€see€with€his€own€eyes€whetherÏhis€wife€was€having€an€affair€with€his€best€friend.€€Neither€his€wife€nor€WyattÏwere€there,€although€the€two€arrived€sometime€later.€€The€defendant€repeatedlyÏinsisted€Wyatt's€shooting€had€been€an€accident.€€He€said€he€encountered€WyattÏin€the€hall.€€Wyatt€slapped€him,€and€he€went€into€his€kitchen€to€get€the€gun€toÏscare€Wyatt.€€He€intended€no€harm,€although€he€wanted€Wyatt€to€leave€theÏapartment€building.€€When€he€returned,€Wyatt€grabbed€the€defendant,€whichÏscared€him.€€The€defendant€claimed,€"I€didn't€mean€to."€€He€also€claimed€the€gunÏwas€not€supposed€to€have€been€loaded.€€Although€the€defendant€admittedÏbeing€upset€at€seeing€his€wife€and€best€friend€together€as€they€entered€theÏapartment€building,€he€denied€shooting€Wyatt€out€of€anger.€€The€defendantÏclaimed€he€attempted€to€help€Wyatt€by€first€looking€for€his€cordless€phone€to€callÏfor€help,€and€later€attempting€to€drive€him€to€UT€Medical€Center.€€The€defendantÏclaimed€he€abandoned€the€trip€to€the€hospital€when€he€realized€his€friend€wasÏnot€responsive.€€He€left€the€car€in€a€brightly€lit€parking€lot€and€walked€home€toÍcontinue€the€search€for€his€telephone€to€call€for€help.€€During€the€interrogation,Ïhe€mentioned€nothing€of€Allen's€involvement€in€the€disposal€of€evidenceÏfollowing€the€crime.ÌÌà àà àOne€of€the€few€areas€about€which€there€was€no€controversy€wasÏwhether€the€defendant€had€been€upset€prior€to€these€crimes.€€Allen€talked€withÏthe€defendant€the€previous€morning€and€observed€that,€although€the€defendantÏusually€had€a€neat€appearance,€he€looked€as€if€he€was€about€to€have€a€nervousÏbreakdown.ÌHuiet€made€similar€observations€about€the€defendant€being€agitated€and€upsetÏon€the€evening€of€February€25.€€Mrs.€Belcher€admitted€she€and€the€defendantÏargued€during€the€day,€and€he€was€apparently€agitated€enough€to€use€profanity.€ÏMrs.€Belcher€also€admitted€her€husband€and€Wyatt€had€quarreled€a€few€nightsÏearlier€when€Wyatt€had€knocked€on€Huiet's€door€looking€for€Mrs.€Belcher.× ƒ/ ××  ×ÌÌà àà àBrandi€Presley,€Denise€Belcher's€14€year€old€daughter€and€theÏstep„daughter€of€the€defendant,€testified€she€found€a€bag€containing€severalÏitems€of€the€defendant's€clothing€and€Wyatt's€jacket€behind€the€Belchers'Ïwaterbed.€€These€items€were€turned€over€to€the€police.ÌÌà àà àCharles€Sterling,€a€Maryville€resident€who€lives€near€theÍapartment€building,€testified€that€at€2:00€a.m.€on€February€26,€he€saw€someoneÏpark€a€car€near€his€home.€Then€a€shadowy€figure€walked€away€from€it.€€BecauseÏhe€had€experienced€trouble€with€vandalism,€he€photographed€the€vehicle.€ÏWhen€he€learned€of€the€crimes,€he€turned€the€negative€over€to€the€police.€€AnÏenlargement€of€the€negative€revealed€the€vehicle€to€have€a€license€tag€numberÏregistered€to€the€defendant.€€Mr.€Sterling€noticed€the€car€was€gone€when€he€leftÏat€5:00€a.m.€€Kelly€Sterling,€the€wife€of€Charles€Sterling,€confirmed€the€time€theÏcar€arrived.€ÌÌà àà àVictoria€O'Hara,€a€tenant€of€the€apartment€building,€testified€sheÏawoke€at€2:14€a.m.€on€the€morning€of€February€26€when€she€heard€a€gunshot.€ÏShe€looked€at€her€clock,€then€went€back€to€sleep.€€A€day€or€two€later,€she€foundÏa€watch€by€the€dumpster€which€she€turned€over€to€the€police.€€The€watch€wasÏidentified€by€Wyatt's€son€as€belonging€to€his€father.€ÌÌà àà àSeveral€law€enforcement€officers€from€the€Blount€County€Sheriff'sÏDepartment€and€the€Maryville€Police€Department€testified€regarding€theirÏinvestigation€of€this€case.€€Significantly,€Maryville€Detective€David€Graves€foundÏa€blood€smear€on€a€wall€in€the€Belcher€apartment.€€Testing€by€the€TBI€lab€laterÏdetermined€the€blood€was€the€same€type€as€that€of€Wyatt.€€However,€GravesÏadmitted€the€defendant's€blood€had€not€been€typed€to€determine€whether€heÏmight€be€the€source€of€the€blood€found€in€his€apartment.€€Graves€further€testifiedÏthat€substances€found€on€the€steps€and€gravel€outside€the€building,€the€towelÍrecovered€from€the€convenience€store€dumpster,€and€the€defendant's€clothingÏfound€behind€the€waterbed€were€human€blood.€€The€samples€could€not€beÏtyped,€however,€due€to€their€age€by€the€time€they€reached€the€TBI€lab.€€HairsÏfound€on€the€baseball€cap€recovered€from€the€convenience€store€dumpster€wasÏscientifically€determined€to€match€Wyatt's€hair.€€ÌÌà àà àRaymond€Finney,€M.D.,€the€Blount€County€Medical€Examiner,Ïperformed€an€autopsy€of€Wyatt's€body.€€He€determined€that€Wyatt's€deathÏresulted€from€a€gunshot.€€Based€on€the€lack€of€injury€to€the€body€from€hot€gases,Ïpowder€burns€or€gun€barrel€contact,€Dr.€Finney€opined€the€wound€was€notÏinflicted€at€close€range.ÌÌà àà àGerald€Wilkes,€an€agent€with€the€FBI,€testified€the€.22€caliberÏweapon€recovered€from€the€dumpster€was€a€single€action€revolver,€a€weaponÏthat€would€have€to€be€cocked€and€then€the€trigger€depressed€separately€forÏeach€firing.€€He€performed€tests€on€the€weapon€and€determined€it€was€theÏweapon€used€to€shoot€Wyatt.€€He€further€determined€there€would€be€residueÏburns,€called€stippling€or€tattooing,€on€Wyatt's€body€or€clothing€if€the€weaponÏwas€fired€from€a€distance€of€five€feet€or€less.€€Chemical€processing€andÏmicroscopic€examination€of€Wyatt's€shirt€revealed€no€evidence€of€stippling€orÏtattooing.ÌÌà àà àFinally,€the€parties€stipulated€that€if€Blount€County€Sheriff's€DeputyÍJ.R.€Johnson€testified,€he€would€say€that€he€stopped€the€defendant€driving€aÏCamaro€on€Alcoa€Highway€traveling€toward€Maryville€at€11:56€p.m.ÌÌà@ àò òIó óÌà àà àThe€first€issue€we€are€called€upon€to€consider€is€whether€theÏdefendant€has€been€denied€his€constitutional€rights€through€trial€counsel'sÏfailure€to€pursue€pretrial€motions€on€his€behalf,€including€a€motion€to€suppressÏhis€pretrial€statement€to€the€police.€€Essentially,€this€is€an€allegation€of€ineffectiveÏassistance€of€counsel.€€We€note,€however,€the€defendant€failed€to€raise€thisÏissue€in€any€of€his€three€motions€for€a€new€trial.€€Therefore,€the€issue€is€waived.€ÏTenn.€R.€App.€P.€3(e);€òòState€v.€Karl€Christopher€Davisóó,€No.€01C01„9202„CC„00062,€slip€op.€at€5€(Tenn.€Crim.€App.,€Nashville,€Mar.€17,€1993).Ìà àMoreover,€as€we€have€repeatedly€noted€in€the€past,€the€practice€ofÏraising€ineffective€assistance€of€counsel€claims€on€direct€appeal€without€anÏevidentiary€hearing€having€been€conducted€on€the€issue€is€"fraught€with€peril."€ÏòòSee,€e.g.óó,€òòState€v.€Andersonóó,€835€S.W.2d€600€(Tenn.€Crim.€App.€1992).€€In€thisÏcase,€the€defendant€failed€to€raise€the€issue€in€his€motions€for€new€trial€andÏsubmitted€no€proof€regarding€counsel's€performance.€The€trial€court€€had€œno›Ïopportunity€to€make€findings€of€fact€on€this€issue.€€As€such,€it€is€inappropriate€forÏus€to€consider€the€issue.€€Nevertheless,€our€abstention€from€considering€theÏissue€does€not€deprive€the€defendant€of€an€opportunity€to€have€this€issueÏreviewed€in€an€appropriate€post„conviction€proceeding€if€he€so€desires.€ÌÌà@ àNext,€the€defendant€alleges€his€due€process€rights€were€violatedÏbecause€the€state€failed€to€disclose€the€identity€of€a€witness€and€her€allegedlyÏexculpatory€statement,€contrary€to€the€requirements€of€òòBrady€v.€Marylandóó,€373ÏU.S.€83,€83€S.€Ct.€1194€(1963).€€At€the€hearing€on€the€motion€for€new€trial,ÏElizabeth€Ostler€testified€she€lived€in€the€apartment€building€where€the€crimesÏoccurred.€€She€heard€a€loud€bang€between€1:30€and€2:00€a.m.€on€February€26.€ÏShe€reported€this€to€Det.€Graves€later€that€morning€while€he€was€processing€theÏcrime€scene.€€She€also€called€him€a€couple€of€weeks€later€and€reiterated€theÏinformation.€€Greg€Ostler€confirmed€his€wife€spoke€with€Det.€Ostler€on€FebruaryÏ26.€€Detective€Graves€had€no€notes€or€independent€recollection€of€speakingÏwith€Mrs.€Ostler.€€He€admitted€he€had€a€phone€message€from€Mrs.€Ostler€butÏcould€not€recall€whether€he€spoke€with€her.€€The€defendant€contends€Mrs.ÏOstler's€statement€is€exculpatory€because€it€contains€evidence€the€gunshot€wasÏfired€earlier€in€time€than€shown€at€trial,€potentially€inculpating€Mrs.€Belcher€asÏthe€shooter.€€The€state€counters€that€the€sequence€of€events,€rather€than€theÏtime€of€the€gunshot€itself€is€determinative€in€this€case,€and€the€Ostler€evidence€isÏonly€marginally€material€and€not€subject€to€òòBradyóó€disclosure.ÌÌà àAssuming€the€Ostlers'€testimony€is€accepted€as€credible,€we€fail€toÏsee€how€this€evidence€is€material.€€As€the€trial€court€found€and€the€state€posits,Ïthe€sequence€of€events,€not€the€actual€time€they€occurred,€is€pertinent€in€thisÏcase.€€Additionally,€the€record€is€devoid€of€any€evidence€the€defense€requestedÏòòBradyóó€material.× ƒ0 ××  ×€€In€the€absence€of€a€request€for€exculpatory€material,€there€hasÏbeen€a€òòBradyóó€violation€only€if€the€evidence€in€question€is€obviously€exculpatoryÏin€nature.€€Mrs.€Ostler's€alleged€statement€to€Det.€Graves€fails€to€meet€thisÏstandard.€€Mrs.€Ostler's€testimony€sheds€no€light€on€the€critical€sequence€ofÏevents;€she€merely€places€a€time€on€one€of€the€events.€€The€trial€witnesses'€andÏMrs.€Ostler's€estimates€of€the€time€when€the€events€occurred€varied€by€as€muchÏas€approximately€two€hours.€€None€of€the€witnesses€who€estimated€the€time€Mrs.ÏBelcher€and€Huiet€left€the€apartment€building€were€able€to€give€a€preciseÏanswer.€€Because€of€the€uncertainty€of€that€evidence,€Mrs.€Ostler's€statementÏcannot€be€viewed€as€contradicting€the€evidence€actually€œpresented›€and€doesÏnot€indicate€that€Mrs.€Belcher€or€Huiet€could€be€the€killer€because€they€were€stillÏin€the€apartment€building€when€Wyatt€was€shot.× ƒ1 ××  ×€€There€has€been€no€òòBradyóóÏviolation.ÌÌà@ àò òIIIó óÌà àà àThe€defendant€next€claims€he€was€denied€a€fair€trial€becauseÏduring€voir€dire€the€jury€foreperson€concealed€material€information€regardingÏher€knowledge€of€the€case.€€The€state€argues€there€was€no€intentional€failure€toÏdisclose,€nor€was€there€any€concealment€or€misrepresentation€of€informationÏbearing€on€impartiality.€ÌÌà àThe€evidence€regarding€the€juror€in€question,€Debbie€Mills,€wasÏdeveloped€at€the€hearing€on€the€motion€for€new€trial.€€Mrs.€Mills€is€married€to€aÏtruck€driver,€Russell€Mills,€who€works€for€Transis.€€The€defendant€also€worked€forÏthis€company.€€€Mr.€Mills€previously€worked€at€Service€Way,€another€truckingÏcompany,€for€a€brief€time€with€Larry€Wyatt.€€The€defendant€also€worked€forÏService€Way,€although€he€left€before€Mr.€Mills€was€hired.€€On€the€evening€beforeÏjury€selection€began,€the€Millses€ate€dinner€at€a€Shoney's€restaurant€with€RobertÏand€Angie€Hubbard.€€Mr.€Hubbard€is€the€owner€of€Hubbard€Trucking.€€HubbardÏTrucking€leases€its€services€to€Transis.€€The€Hubbards€knew€the€defendant.€ÏDuring€dinner,€Mrs.€Mills€mentioned€that€she€had€been€summoned€for€jury€dutyÏthe€following€day.€€Mr.€Hubbard€mentioned€that€the€defendant's€trial€wasÏscheduled€to€start€the€next€day.€€Mrs.€Hubbard€claims€Mr.€Mills€responded€byÏsaying,€"Yeah,€you€know€Slater€Belcher,"€to€his€wife,€while€the€Millses€deny€this.€ÏMrs.€Mills€claims€the€defendant's€name€meant€nothing€to€her.€€According€to€Mrs.ÏHubbard,€Mrs.€Mills€also€said€she€had€always€wanted€to€serve€on€a€jury€in€aÏmurder€trial.€€ÌÌà àà àMr.€Mills€also€testified€he€heard€some€rumors€at€work€about€oneÍtruck€driver€shooting€another.€€He€told€his€wife€about€these€rumors,€although€heÏdid€not€know€the€names€of€those€involved.€€Mrs.€Mills€recalled€her€husbandÏtelling€her€one€trucker€from€Service€Way€"supposedly"€shot€another€trucker€fromÏService€Way.× ƒ2 ××  ×€€She€testified€she€was€unaware€a€fatality€resulted,€and€she€hadÏnot€followed€the€case€in€the€newspaper.€€ÌÌà àà àMrs.€Mills€testified€she€gave€truthful€answers€to€all€of€the€questionsÏposed€during€voir€dire.€€She€further€testified€she€based€her€verdict€on€theÏevidence€she€heard€in€the€courtroom.ÌÌà àà àIn€resolving€this€issue€against€the€defendant,€the€lower€courtÏobviously€accredited€the€testimony€of€Mr.€and€Mrs.€Mills€over€that€of€Mrs.ÏHubbard,€which€was€its€prerogative€to€do€as€the€finder€of€fact.€€Thereby,€theÏcourt€accepted€the€state's€evidence€as€rebutting€the€presumption€of€bias.€€In€thisÏcase,€we€are€required€to€give€the€findings€of€fact€made€by€the€trial€court€theÏweight€of€a€jury€verdict.€€òòSeeóó€òòState€v.€Burginóó,€668€S.W.2d€668€(Tenn.€Crim.€App.Ï1984).€€We€cannot€reverse€the€holding€unless€the€evidence€clearlyÍpreponderates€against€the€trial€court's€conclusion€that€the€juror€acted€withoutÏbias€and€performed€her€duties€with€impartiality.€€In€this€case,€the€evidence€doesÏnot€preponderate€against€the€conclusion€of€the€trial€court.€€Having€accepted€theÏMillses€as€credible,€the€court€reached€the€correct€conclusion.€€This€issue€isÏwithout€merit.ÌÌà@ àOn€February€26,€1995,€the€definition€of€first€degree€murder€wasÏ"[a]n€intentional,€premeditated€and€deliberate€killing€of€another."€€Tenn.€CodeÏAnn.€ðð€œ39„13„202›€(1991)€(amended€1995).€€In€this€case,€the€state€presentedÏcircumstantial€evidence€which,€if€accepted€by€the€trier€of€fact,€sufficientlyÏsupports€the€defendant's€conviction€of€first€degree€murder€of€Larry€Wyatt.€€PriorÏto€Wyatt's€death,€the€defendant€expressed€his€intent€to€"talk€to"€Wyatt€with€anÏaxe€handle.€€He€lured€Wyatt€to€the€apartment€building.€€While€waiting€for€WyattÏto€arrive,€the€defendant€hid€his€car€down€the€street.€€The€jury€could€logically€inferÏthe€defendant€was€laying€a€trap€for€Wyatt.€€According€to€the€defendant'sÏstatement,€he€was€upset€over€his€wife's€affair€with€Wyatt.€€After€Wyatt€arrived,ÏWyatt€hit€the€defendant.€€Belcher€did€not€respond€immediately,€but€retreated€toÏhis€apartment,€got€a€gun,€and€shot€Wyatt€from€a€distance€of€at€least€five€feet.€ÏThe€evidence€strongly€supports€the€conclusion€the€defendant€and€the€victimÏwere€alone€at€the€time€of€the€shooting.€€The€officers€who€interrogated€theÏdefendant€repeatedly€referred€to€the€defendant€having€shot€Wyatt,€and€in€theÏcourse€of€giving€a€full€statement,€the€defendant€never€denied€he€was€theÏshooter.€€The€defendant€admitted,€"I€didn't€mean€to,"€and€repeatedly€stated,€"ItÏwas€an€accident."€€He€made€a€similar€statement€to€Huiet€immediately€after€theÏcrime.€€A€rational€trier€of€fact€could€easily€interpret€these€statements€asÏconfessions€of€guilt.€€ÌÌà àWhile€the€defendant€interprets€the€evidence€much€differently,€weÏmust€adhere€to€a€review€in€the€light€most€favorable€to€the€state.€€Moreover,€weÍare€constrained€not€to€consider€the€defendant's€wife's€testimony€at€the€hearingÏon€the€motion€for€new€trial€in€our€review€of€this€issue,€as€the€defendant€wouldÏhave€us€do.€€At€that€hearing,€Mrs.€Belcher€testified€she€knew€her€husband€hadÏnot€shot€Wyatt€and€then€asserted€her€Fifth€Amendment€privilege€when€askedÏhow€she€knew€this.€€We€are€limited€to€consideration€of€the€evidence€presentedÏto€the€jury.€€If€the€defendant€has€new€evidence€that€was€not€available€at€trial,€heÏmay€apply€to€the€trial€court€for€a€Writ€of€Error€Coram€Nobis.€€òòSee€generallyóó€Tenn.ÏCode€Ann.€ðððð€27„7„101€to€„108€(1980).€ÌÌ2.à0
