Šcharged€with€such€an€offense.€€óóIt€may€sound€strange,€but€I€believe€her€father€isŠ $X" Špushing€this€so€hard€because€he€wants€my€sister€but€she€donššt€want€him€and€I€gotŠ ō$D # Šcaught€in€the€middle€of€it.Šą%0!$Š Š  ŠĢ(Emphasis€added.)€€Clearly,€although€Defendant€admitted€once€that€what€he€did€was€wrong,€it€seemsŠ ø'#& Šhe€is€not€entirely€convinced€of€this€fact.€€It€also€appears€that€he€considers€ņņhimselfóó€to€be€a€victim.€€HeŠ ¤(ō#' Šstated€that€Foster€was€somehow€behind€the€charges€against€him€for€reasons€unrelated€to€him€and€thatŠ )ą$( Šhe€merely€š šgot€caught€in€the€middle€of€it.šš€€In€light€of€the€above,€we€find€Defendantššs€potential€forŠ |*Ģ%) Šrehabilitation€to€be€quite€poor.€€Because€he€generally€denies€responsibility€for€his€conduct€or€that€heŠ h+ø&* Šcommitted€any€wrongdoing,€we€also€conclude€that€the€risk€that€Defendant€may€commit€another€crimeŠ ° Šduring€a€period€of€probation€is€unacceptably€high.€€ņņSeeóó€Tenn.€Code€Ann.€šš€40„35„103(5).€€Š œģ ŠĢą  ąIn€addition,€we€agree€that€Defendantššs€testimony€was€untruthful€and€that€he€displayed€aŠ tÄ Šdisturbing€lack€of€candor€with€regard€to€the€crime.€€A€defendantššs€lack€of€candor,€credibility,€andŠ `° Šwillingness€to€accept€responsibility€for€his€crime€are€relevant€considerations€in€determining€aŠ L œ Šdefendantššs€potential€for€rehabilitation,€and€its€lack€thereof€is€a€proper€consideration€in€determiningŠ 8 ˆ Šwhether€probation€or€confinement€is€appropriateņņóó.€€ņņState€v.€Zeoliaóó,€928€S.W.2d€457,€463€(Tenn.€Crim.Š $ t ŠApp.€1996);€ņņState€v.€Dowdyóó,€894€S.W.2d€301,€306€(Tenn.€Crim.€App.€1994);€ņņState€v.€Andersonóó,€857Š  ` ŠS.W.2d€571,€574€(Tenn.€Crim.€App.€1992);€ņņState€v.€Bryantóó,€775€S.W.2d€1,€6€(Tenn.€Crim.€App.Š ü L  Š1988)€(š šAny€lack€of€candor€on€the€part€of€the€defendant€is€an€important€factor€in€the€overallŠ č 8  Šconsideration€of€the€issue€of€probation.šš).€€As€noted€in€the€facts,€Defendant€testified€that€he€had€notŠ Ō$  Šused€marijuana€during€the€six€or€seven€months€prior€to€the€date€of€the€sentencing€hearing€(July€31,Š Ą  Š2001),€which€contradicted€his€admission€to€the€probation€officer€on€May€10,€2001,€that€he€had€usedŠ ¬ü  Šdrugs€in€the€six€weeks€prior€to€that€day.€€The€record€further€reflects€that,€when€asked€why€DefendantŠ ˜č  Šunbuttoned€the€victimššs€pants,€he€replied,€š šI€donššt€know.šš€€Finding€Defendantššs€statement€notŠ „Ō  Šcredible,€the€trial€court€remarked,€š šThere€[wa]s€but€one€reason€to€unbutton€that€young€ladyššs€pants,Š pĄ Šand€thatššs€a€sexual€motive.šš€€Based€on€the€above,€we€find€that€Defendantššs€lack€of€candor€providedŠ \¬ Šan€additional€basis€for€denying€probation.€€ņņSeeóó€ņņState€v.€Dykesóó,€803€S.W.2d€250,€259-60€(Tenn.€Crim.Š H˜ ŠApp.1990),€ņņoverruled€on€other€groundsóó€(ņņState€v.€Hooperóó,€29€S.W.3d€1€(Tenn.€2001)).Š 4„ ŠĢą  ąIn€sum,€we€find€that€Defendantššs€inability€to€accept€responsibility€for€his€criminal€conduct,Š  \ Šhis€lack€of€remorse,€and€his€failure€to€accept€that€what€he€did€was€wrong€demonstrate€that€hisŠ ųH Špotential€for€rehabilitation€is€poor.€€We€also€agree€that€Defendantššs€testimony€revealed€a€lack€ofŠ ä4 Šcandor€and€truthfulness.€€Accordingly,€Defendant€has€failed€to€show€that€the€trial€courtššs€denial€ofŠ Š  Šprobation€was€improper€or€that€probation€will€be€in€the€best€interest€of€the€defendant€and€the€public.Š ¼  ŠĢņ ņŌ‡XOXXXOŌą@’ ’ ģąII.€€Alternative€Sentencing€Other€Than€Probationó 󀈩 ”ä ŠĢą  ąDefendant€also€argues€that€the€trial€court€erred€by€notŌ#†XOXXXO—r#Ō€ordering€that€he€serve€his€sentence€inŠ pĄ Ša€community€corrections€program€or€granting€him€some€other€type€of€alternative€sentence.Ō‡XOXXXOŌŠ \ ¬ ŠŌ#†XOXXXO t#ŌĢą  ąAs€previously€noted,€a€Range€II€standard€offender€convicted€of€a€Class€C€felony,€DefendantŠ 4"„  Šis€not€presumed€a€favorable€candidate€for€alternative€sentencing€options.€€Tenn.€Code€Ann.€ššŠ  #p!
