Whenasentencingissueisappealed,thisCourtshallconductadenovoreviewwiththepresumptionthatthetrialcourtsfindingsarecorrect.Tenn.CodeAnn.4035401(d)(1990);Statev.Byrd,861S.W.2d377,379(Tenn.ϜCrim.App.1993).Thepresumptionofcorrectnessisconditioneduponanaffirmativeshowing,intherecord,thatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991). Inconductingadenovoreviewofadefendantssentence,includingthemannerinwhichheorsheistoservethesentence,thisCourtmustconsider:(1)theevidencereceivedatthesentencinghearing,(2)thepresentencereport,(3)theprinciplesofsentencingandargumentsastosentencingalternatives,(4)thenatureandcharacteristicsofthecriminalconduct,(5)anymitigatingandenhancementfactors,(6)anystatementsmadebythedefendantinhisorherownbehalf,and(7)thedefendantspotentialforrehabilitationortreatment.Tenn.CodeAnn.4035210&103(1990). TennesseeCodeAnnotated4035103(1)(A)(C)(1990)setsoutsentencingconsiderationswhichareguidelinesfordeterminingwhetherornotadefendantshouldbeincarcerated.Theseinclude(1)theneedtoprotectsocietybyrestrainingadefendanthavingalonghistoryofcriminalconduct,(2)theneedtoavoiddepreciatingtheseriousnessoftheoffense,and(3)theneedtodeterotherslikelytocommitsimilaroffenses.Inreviewingagrantordenialofprobation,thisCourtalsoconsiders(1)thecircumstancesoftheoffense,(2)thedefendantscriminalrecord,(3)his/hersocialhistory,(4)presentphysicalandmentalcondition,and(5)thedeterrenteffectofthesentence.Id.ThisCourthaspreviouslydeterminedthatanegativefindingofanyoneofthesefactorsissufficienttosupportadenialofprobation.Statev.Baron,659S.W.2d811,815(Tenn.Crim.App.1983).Probationmayalsobedeniedbaseduponthecircumstancessurroundingtheoffense.Statev.Hartley,818S.W.2d370,373(Tenn.Crim.App.1991).ThisstandardhasessentiallybeencodifiedatTenn.CodeAnn.4035103(1)(b)astheneedtoavoiddepreciatingtheseriousnessoftheoffense.Id.at375.̀ TheappellantBinghampledguiltytothreecountsofburglaryofamotorvehicle,aClassEfelony.Hewassentencedtoservetwoyearsoncommunitycorrectionsforeachcount.Thesesentenceswereorderedtorunconsecutively.Healsopledguiltytosixcountsoftheftofpropertyvaluedunder$500,aClassAmisdemeanor.Hewassentencedtothreeconsecutiveelevenmonthandtwentyninedaysentencestobeservedconcurrentlywiththreeelevenmonthandtwentyninedaysentences.Inthisappealhecontendsthatthetrialcourterroneouslyimposedconfinementandshouldhaveimposedconcurrentsentences.Wedisagree. Therecordrevealsthatthetrialjudgecorrectlyconsideredtheprinciplesofsentencing.Therefore,ourreviewisdenovowithapresumptionofcorrectness.Tenn.CodeAnn.4035401(d)(1990). Thetrialjudgefoundoneenhancementfactor 2   ׀andtwomitigatingfactors 3   ׀applicabletothisappellant.Theappellantsallegationthatheshouldhavereceivedanalternativesentenceismisguided.Thetrialjudgefoundthattheappellantwasasuitablecandidateforalternativesentencingandorderedpartoftheappellantssentencetobeservedoncommunitycorrections.Itiswellsettledthatcommunitycorrectionsisanalternativesentence.Statev.Taylor,744S.W.2d919,920(Tenn.Crim.App.1987).However,hedidnotcompletelyprobatetheappellantssentenceandorderedconsecutivesentencesbecauseoftheappellantshistoryofcriminalbehavior,his sorryemploymentandsocialhistory,andtheneedtoavoiddepreciatingtheseriousnessoftheoffense.Wefindthattheevidencesupportsthetrialcourtsfindings.Theappellanthasfailedtoovercomethepresumptionofcorrectness.Hissentenceisaffirmed. TheappellantBakerpledguiltytotwocountsofburglaryofamotorvehicle.Hewassentencedtotwoyearsoncommunitycorrectionsforeachcount.Thesesentenceswereorderedtorunconsecutively.Bakeralsopledguiltytothreecountsoftheftofpropertyvaluedunder$500.Hereceivedtwoconsecutiveelevenmonthandtwentyninedaysentencestobeservedconcurrentlytooneelevenmonthtwentyninedaysentence.Theappellantcontendsthattheconfinementwasinappropriateandthatheshouldhavebeenclassifiedasanespeciallymitigatedoffender. Therecordrevealsthatthetrialjudgecorrectlyconsideredtheprinciplesofsentencing.Therefore,ourreviewisdenovowithapresumptionofcorrectness.Tenn.CodeAnn.4035401(d)(1990). InsentencingBakerthetrialcourtfoundoneenhancementfactor 4   ׀andtwomitigatingfactors 5   ׀applicable.Thetrialjudgerejectedtheappellantsargumentthatheshouldbeclassifiedasanespeciallymitigatedoffenderfindingthathehadpreviouslypledguiltytotwofelonycharges.Thetrialjudgedidfindthattheappellantshouldreceiveanalternativesentence.Hesplitthesentencebetweenconfinementandcommunitycorrections.Indecliningtocompletelyprobatetheappellantssentencesandinorderingconsecutiveterms,thetrialjudgefoundthattheappellanthadcontradictedhimselfthroughoutthesentencinghearing.Furthermore,hehadmisrepresentedfactsorliedinhispresentencereport.Itiswellsettledthatanappellantslackofcandormayserveasthesolebasisfordenyingprobation.Statev.Dykes,803ϜS.W.2d250(Tenn.Crim.App.1990);Statev.Jenkins,733S.W.2d528(Tenn.ϜCrim.App.1987).Baseduponhispriorhistoryofcriminalbehavior,hislackofcandor,andtheneedtoavoiddepreciatingtheseriousnessoftheoffense,thetrialcourtorderedconsecutiveconfinement.Wefindthattheevidencesupportsthetrialcourtsfindings.Theappellanthasfailedtoovercomethepresumptionofcorrectness.Hissentenceisaffirmed. TheappellantPattersonpledguiltytotwocountsofburglaryofamotorvehicle.Hereceivedtwoconsecutiveyearsoncommunitycorrectionsforeachcount.Healsopledguiltytotwocountsoftheftofpropertyvaluedunder$500.Hereceivedtwoconsecutiveelevenmonthandtwentyninedaysentencesfortheseconvictions.Theconvictionsoncommunitycorrectionswereorderedtorunconsecutivelytothetheftconvictions. Pattersoncontendsthatthetrialcourterroneouslyappliednonstatutoryenhancementfactorsandsentencedhimabovetheminimumoftherangeforhisconvictions.Furthermore,hearguesthathissentencesshouldhavebeenorderedtorunconcurrentlytooneanother.Wedisagree. Thereexistsatleastoneenhancerandtwomitigators 6   ׀applicabletothisappellant.Theappellanthadaprevioushistoryofcriminalbehaviorandhadotherchargespendinginothercounties.Also,thetrialcourtfoundthattheappellanthadfailedtoshowupattheinitialsentencinghearingresultinginacapiasbeingissuedforhisarrest.ThisCourtfinds,asdidthetrialcourt,thatthisillustratestheappellantscavalierattitudeanddiluteshisseriousnessconcerningtheseriouscrimeshecommitted.Consequently,thetrialjudgefeltthathemuststrictlysentencetheappellanttodeterhimandothersfromfuturecriminalconductandtoavoiddepreciatingtheseriousnessoftheoffense.Wefindthattheevidencesupportsthetrialcourt'sfindings.Theappellanthasfailedtoovercomethepresumptionofcorrectness.Hissentenceisaffirmed.
