In1995,theappellantpledguiltytopossessionofcocainewiththeintenttosell,possessionofmarijuanawiththeintenttosell,andpossessionofadeadlyweapon,towit:ahandgrenade.Thetrialcourtsentencedtheappellanttoten(10)yearsoneachcountandorderedthesentencestobeservedconcurrentlyinacommunitybasedalternativetoprison( CAPP). 0   ׀ Afterservingapproximatelysevenmonthsinthecommunitycorrectionsprogram,theappellantwasarrestedpursuanttoaCAPPviolationwarrant.ThetrialcourtconductedanevidentiaryhearingandreceivedtestimonyfromwitnessesincludingappellantsCAPPsupervisor,KatherineHancock.Ms.HancocktestifiedthattheappellantcompliedwiththeconditionsofhissentenceuntilaroundMay1996.Shestatedthatatthatpoint,hebeganmissingbothhiscurfewandhisweeklymeetingswithsupervisorsandsupportgroups.Moreover,Ms.Hancocktestifiedthattheappellanthadfailedtopayanymoneytowardshiscourtcosts. Throughadditionaltestimony,theStatealsosoughttoprovethattheappellantwasinvolvedinarobberyandshootingonJune25,1996.TheincidentoccurredduringtheearlymorninghoursattheWalterTaylorHousingProjectinKnoxville,Tennessee.Accordingtoeyewitnesstestimony,severalblackmalessurroundedandassaultedthevictim,RyanSimmons,inanearbyparkinglot.Onewitness,JenniferSmith,testifiedthatsheheardtwogunshotsandobservedtheappellantdraggingthevictimsbodybehindadumpster.Ms.Smith,however,didnotseetheshootingandwasunabletoidentifytheappellantasthegunman. DetectiveTerryClowersoftheKnoxvillePoliceDepartmenttestifiedthattheappellantwasarrestedandquestionedabouttheshootingafewhoursafterpolicearrivedonthescene.Theappellantadmittedthathewasatthehousingprojectwhentheshootingoccurred;however,hestatedthathemerelyhappenedupontheinjuredvictimandpulledhimbehindadumpsterforsafety.HefurtherindicatedtoDetectiveClowersthathewasworkingatthehousingprojectthateveningasabarber.DetectiveClowersinterviewedotherwitnesseswhoplacedtheappellantatthescenebeforeandaftertheshooting.However,therewasnoevidencethatappellantwasinvolvedinthecrimeandhewasnevercharged. Althoughappellantdisputedhisinvolvementintheshooting,heconcededthathehadfailedtocomplywithcertainconditionsofhiscommunitycorrectionssentence.ThetrialcourtdeterminedthatappellantwasinmaterialviolationofCAPPbaseduponhiscurfewviolationsandhisfailuretoattendweeklymeetings. 1   ׀Thejudgenotedthathehadwarnedappellantatanearlierhearingthatnoncomplianceinthecommunitycorrectionsprogramwouldresultinacustodialsentence. 2   ׀Accordingly,thetrialjudgerevokedcommunitycorrectionsandorderedtheappellanttoservetheremainderofhissentenceintheTennesseeDepartmentofCorrection. Atrialjudgemayrevokeacommunitycorrectionssentenceuponfindingthatthedefendanthasviolatedtheconditionsofhissentencebyapreponderanceoftheevidence.SeeTenn.CodeAnn.4035311(d)(Supp.1995).Thejudgmentofthetrialcourtinthatregardwillnotbeoverturnedonappealabsentanabuseofdiscretion.SeeStatev.Harkins,811S.W.2d79,82(Tenn.1991);Statev.Williamson,619S.W.2d145,146(Tenn.Crim.App.1981),perm.app.denied(Tenn.1981). Inthiscase,weconcludethattheevidenceofappellantsCAPPviolationswassufficientforthetrialjudgetomakeaconscientiousandintelligentjudgment.TheappellanthasconcededthathemissedweeklymeetingswithhisCAPPgroups,heviolatedhiscurfew,andhefailedtopaycourtcosts.Assuch,therevocationofhiscommunitycorrectionssentencewasproper.
