OnApril15,1997,theappellantpledguiltytodrivingundertheinfluenceandwassentencedto11monthsand29days,allofwhichwassuspendedafterserviceof60daysinjailwithworkrelease.Theappellantsdriverslicensewassuspendedforaperiodoftwoyears,andhewasalsoorderedtopayrestitutionandcourtcosts.OnMay20,1997,aprobationviolationwarrantwasfiled,allegingfailuretopaycostsandrestitutionasorderedbythetrialcourtanddrivingwhileonworkreleasewithoutavalidlicense.Afterahearing,thetrialcourtrevokedtheappellantsprobationandimposedhisoriginalsentence.ThetrialcourtfurtherorderedthattheappellantbegivencreditforjailtimefromMay24,1996,toMay25,1996,andfromApril15,1997,toJune13,1997.  Attherevocationhearing,theappellantsprobationofficertestifiedthattheviolationwarrantwassignedonMay20,1997,allegingthattheappellantviolatedaconditionofprobationbyfailingtopaycostsandrestitutionasorderedbytheCourtandbylosingworkreleaseprivilegesfordrivingonworkreleasewithoutavalidlicense.Adeputysherifftestifiedthathewatchedastheappellantleftthejailonemorning.Thedeputysheriffsawtheappellantwalktotheparkinglot,getinatruck,anddrivetotheedgeoftheparkinglot.Whentwoofthewheelswereonthestreet,thedeputysheriffstoppedtheappellantandtoldhimtogetoutofthetruck.Thejailadministratortestifiedthattheappellantwasremovedfromworkreleasebecausehehaddrivenwithoutavalidlicensewhileonworkrelease.Theappellantpresentedthetestimonyoftwowitnesseswhoreceivedtelephonecallsfromtheappellantonthesamedaythedeputysheriffsawhimdrivingthetruck.Bothwitnessestestifiedthattheappellanthadcalledregardingaridetowork.Basedontheproof,thetrialcourtrevokedtheappellantsprobation.  Therevocationofprobationiscommittedtothesounddiscretionofthetrialcourt.Statev.Mitchell,810S.W.2d733,735(Tenn.Crim.App.1991).Ifthetrialcourtfindsbyapreponderanceoftheevidencethataprobationviolationhasoccurred,ithastherighttorevokeprobationandcausetheprobationertocommencetheexecutionofjudgmentasoriginallyentered.T.C.A.4035310,311(d).ThisCourtwillnotfindthatatrialcourthasabuseditsdiscretionunlesstherecordcontainsnosubstantialevidencetosupportthetrialcourt'sconclusionthattheprobationshouldberevoked.Statev.Harkins,811S.W.2d79,82(Tenn.Crim.App.1981).Theevidenceattherevocationhearingneedonlyshowthatthetrialcourtexercisedaconscientiousandintelligentjudgmentinmakingthedecisiontorevokeprobation.Statev.Leach,914S.W.2d104,106(Tenn.Crim.App.1995).  Basedontherecordbeforeus,thetrialcourtwasjustifiedinrevokingtheappellantsprobation,andtheproofthattheappellantviolatedtheconditionsofhisreleasewassufficienttoallowthetrialcourttomakeaconscientiousandintelligentdecision.Finally,itappearsfromareviewofthetrialcourtsorder,thattheappellantwasgivencreditforjailtimeserved.Accordingly,baseduponareadingoftheentirerecord,thebriefsoftheparties,andtheapplicablelaw,thisCourtfindsthatthejudgmentofthetrialcourtshouldbeaffirmedpursuanttoRule20,TennesseeCourtofCriminalAppealsRules.
