Fromthesparserecord,itappearsthatonNovember20,1995,WaverlypoliceofficerW.B.FraziersawtheDefendantdrivingavehiclewithoutproperregistrationplates.SeeTenn.CodeAnn.553102.Uponstoppingthevehicle,OfficerFrazierdiscoveredthatDefendantalsodidnotpossessavalidTennesseedriverslicense.SeeTenn.CodeAnn.5550301. ThejuryfoundtheDefendantguiltyofbothoffenses.Thetrialcourtimposedasuspendedsentenceof30daysforeachoffenseandfinedhimatotalof$100. TherecordonappealcontainsnomotionfornewtrialfiledbytheDefendant.Rule3(e)oftheTennesseeRulesofAppellateProcedurestatesinpart:0 8 [I]nallcasestriedbyajury,noissuepresentedforreviewshallbepredicateduponerrorintheadmissionorexclusionofevidence,juryinstructionsgrantedorrefused,misconductofjurors,partiesorcounsel,orotheractioncommittedoroccurringduringthetrialofthecase,orothergrounduponwhichanewtrialissought,unlessthesamewasspecificallystatedinamotionforanewtrial;otherwise,suchissueswillbetreatedaswaived.Thisruledoesnotencompassissueswhich,ifdecidedfavorablytotheaccused,wouldresultinthedismissaloftheprosecution.Statev.Keel,882S.W.2d410,41516(Tenn.Crim.App.1994).Sincethereliefrequested,ifgrantedintheinstantcase,wouldbedismissaloftheprosecution,thenthewaiverprovisioncontainedinRule3(e)isnotapplicable.Thus,theissuespresentedbyDefendantwouldnormallybeconsideredonthemerits. However,theDefendanthasnotincludedthetranscriptofthetrialoranypretrialhearingsaspartoftherecordonappeal.Itistheappellantsdutyto havepreparedatranscriptofsuchpartoftheevidenceorproceedingsasisnecessarytoconveyafair,accurateandcompleteaccountofwhattranspiredwithrespecttothoseissuesthatarethebasesofappeal.Tenn.R.App.P.24(b).Whennecessarypartsoftherecordarenotincludedonappeal,thecourtmustpresumethatthetrialcourtsrulingwascorrect.Statev.Oody,823S.W.2d554,559(Tenn.Crim.App.1991).Therefore,evenifreviewoftheissuespresentedisproperintheinstantcase,thisCourtmustdefertothefindingsofthetrialcourtsincenotranscriptisincludedintherecord. Furthermore,Defendantwasalsoconvictedatadifferenttrialforthesametypeofoffensesasintheinstantcase,butwhichoccurredonadifferentdate.TheidenticalissuespresentedinthecasesubjudicewerepresentedinthedirectappealbyDefendantfromtheotherconvictions,andwereresolvedbyanotherpanelofthisCourtagainstDefendant.Eveniftheissueswerenotwaivedbyfailuretofileacompleterecord,wewouldadoptthereasoningandanalysisofthepanelofthisCourtinStatev.RobertK.Booher,C.C.A.No.01C019604CC00131,HumphreysCounty(Tenn.Crim.App.,Nashville,filedAug.22,1997)infindingthattheissuespresentedinthecasesubjudicearewithoutmerit.
