Basedonourreviewofthebriefsandtheentirerecordinthiscause,weconcludethatthisisanappropriatecaseforaffirmanceunderRule20,TennesseeCourtofCriminalAppealsRules.  Whenanappealchallengesthelength,range,ormannerofserviceofasentence,thisCourtconductsadenovoreviewwithapresumptionthatthedeterminationofthetrialcourtwascorrect.T.C.A.4035401(d).However,thispresumptionofcorrectnessis"conditionedupontheaffirmativeshowingthatthetrialcourtintherecordconsideredthesentencingprinciplesandallrelevantfactsandcircumstances."Statev.Ashby,823S.W.2d166,169(Tenn.1991).Intheeventthattherecordfailstodemonstratesuchconsideration,reviewofthesentenceispurelydenovo.Id.Ifappellatereviewreflectsthatthetrialcourtproperlyconsideredallrelevantfactorsanditsfindingsoffactareadequatelysupportedbytherecord,thisCourtmustaffirmthesentence.Statev.Fletcher,805S.W.2d785,789(Tenn.Crim.App.1991).Inconductingareview,thisCourtmustconsidertheevidence,thepresentencereport,thesentencingprinciples,theargumentsofcounsel,thenatureandcharacteroftheoffense,mitigatingandenhancementfactors,anystatementsmadebythedefendant,andthepotentialforrehabilitationortreatment.Statev.Holland,860S.W.2d53,60(Tenn.Crim.App.1993).Thedefendantbearstheburdenofshowingtheimproprietyofthesentenceimposed.Statev.Gregory,862S.W.2d574,578(Tenn.Crim.App.1993).  Amisdemeanantisnotentitledtothepresumptionofaminimumsentence.Statev.Creasy,885S.W.2d829(Tenn.Crim.App.1994).Further,misdemeanorsentencesdonotcontainrangesofpunishments,andamisdemeanordefendantmaybesentencedtothemaximumtermprovidedfortheoffenseaslongasthesentenceimposedisconsistentwiththepurposesofthesentencingact.Statev.Palmer,902S.W.2d391,393(Tenn.1995).Ourstatutorysystempertainingtomisdemeanorsentencingisdesignedtoprovidetrialcourtswithcontinuingjurisdictionandagreatdealofflexibility.Statev.Boyd,925S.W.2d237,244(Tenn.Crim.App.1995).  Inthepresentcase,thetrialcourtheldaseparatesentencinghearingforwhichapresentencereportwasordered.Theappellantscriminalrecordconsistsofthreepublicintoxicationconvictionsin19901991andthreeDUIconvictionsin19941996.Theappellantwasalsoconvictedofrapein1976,however,thetrialcourtfoundthattheconvictionwastoooldtoberelevantforsentencingpurposes.Indeterminingthesentence,thetrialcourtconsideredtheappellantspreviouscriminalhistoryandthefactthatallpriorrelevantoffensesinvolvedtheuseofalcohol.ItalsoconsideredthattheappellanthadbeengivenabreakonthethreepriorDUIconvictionsinthathewasallowedtopleadguiltytoafirstoffenseineachinstance.Asmitigatingcircumstances,thetrialcourtnotedthattheappellanthadvoluntarilyandsuccessfullycompletedanalcoholtreatmentprograminMay1997.Thetrialcourtfurtherconsideredaspositivefactorsthattheappellantwasgainfullyemployedandhadasupportivefamily.Basedonourreview,wefindthattheappellanthasnotovercomethepresumptionthatthesentencesimposedbythetrialcourtarecorrect.  Theappellantalsoarguesthatthetrialcourterredbyfailingtoremitthemandatoryfinesbecauseheisindigent.SeeT.C.A.5510403(b)(2)andT.C.A.3917428(d)(1).Thedecisionofwhethertograntawaiverofmandatoryfinesbasedonafindingofindigencyrestswithinthetrialcourtsdiscretion,andthatdecisioncannotbereversedintheabsenceofevidenceintherecordwhichindicatesanabuseofthatdiscretionwhichhasdonegreatinjusticeandinjurytothepartycomplaining.Statev.Black,897S.W.2d680,684(Tenn.1995).Whilethetrialcourtfoundtheappellanttobeindigentinthiscaseforpurposesofappointingcounsel,italsofoundthattheappellantcouldpay$25aweektopartiallyreimbursethestatesexpenseindoingso.Thepresentencereportshowsthattheappellantwillberesponsibleformedicalbillsifnotcoveredbyinsurance,however,therewasalsoproofthattheappellantisgainfullyemployedandthathisemployerwouldallowhimtoreturntoworkafteraperiodofincarceration,includingacommitmenttoprovidetransportationiftheappellantisgivenworkrelease.Basedontherecord,wecannotfindthatthetrialcourtabuseditsdiscretionindecliningtoremitthemandatoryfines.̀  Finally,thestatearguesthatthetrialcourterredbyfailingtorevoketheappellantsdrivingprivilegeuponhisconvictionforDUI,thirdoffense.SeeT.C.A.5510403(a)(1).Becausethejudgmentclearlystatesasaspecialconditionthattheappellantslicenseisrevokedforaperiodofthreeyears,thisissueismoot.
