TheappellantfiledamotiontodismissintheMcNairyCountyCircuitCourtbasedondoublejeopardyprovisions.Thetrialcourtdeniedthemotiontodismiss.Afterpleanegotiationsconcluded,theappellantenteredaguiltyplea   `  totheHMVOviolationbutreservedtherighttoappealacertifiedquestionoflawpursuanttoRule37(b)oftheTennesseeRulesofCriminalProcedure.TheappellantperfectedhisappealtothisCourt. TheissuebeforethisCourtissimple.UndertheprovisionsofStatev.Green,947S.W.2d186(Tenn.Crim.App.1997),cantheappellantbeconvictedofbothdrivingonarevokedlicenseandaviolationunderHMVO?Weconcludethathecannotbeconvictedofbothcrimes. InGreen,thisCourtfoundthatdrivingonarevokedlicenseisnotalesserincludedoffenseofviolatingthehabitualmotorvehiclelaw.WefurtherfoundthatundertheprovisionsofDuchacv.State,505S.W.2d237(Tenn.1973),thesetwooffensesarethe samefordoublejeopardypurposesundertheTennesseeConstitution.TheCourtfoundthatundertheprinciplesenunciatedinStatev.Denton,938S.W.2d373(Tenn.1996),doublejeopardyprincipleswereviolated;andadefendantcouldnotbeconvictedofbothdrivingonarevokedlicenseandaviolationofHMVO. TheAttorneyGeneralconcedesthisissue.Thestateagreesthatconvictingthisappellantofbothcrimesviolatesdoublejeopardyprovisions.
