Ðby€a€previous€marriage.€€A.S.€put€the€infant€daughter€to€bed€for€the€evening€and€began€watchingÐ  $\" Ðtelevision€on€the€living€room€couch.€€She€testified€that€the€Defendant€came€into€the€living€room,Ð ø$H # Ðturned€on€the€radio,€and€began€slow„dancing€with€her.€€The€Defendant€was€wearing€only€a€pair€ofÐ ä%4!$ Ðshorts,€and€A.S.€noticed€that€he€had€an€erection€as€they€danced.€€The€Defendant€undressed€A.S.€andÐ Ð& "% Ðengaged€in€sexual€intercourse€with€her€on€a€blanket€on€the€floor.Ð ¼' #& Ðâ âÐ ¨(ø#' Ðà  àAlthough€A.S.€initially€told€no€one€about€the€incident€with€the€Defendant,€she€eventually€toldÐ ° Ðâ âa€school€friend,€who€then€told€a€teacher,€who€in€turn€told€a€Tennessee€Bureau€of€InvestigationÐ œì Ð(T.B.I.)€agent.€€The€T.B.I.€agent€proposed€that€A.S.€telephone€the€Defendant€and€record€theirÐ ˆØ Ðconversations,€during€which€A.S.€would€attempt€to€obtain€an€admission€from€the€DefendantÐ tÄ Ðregarding€his€sexual€activity€with€A.S.Ð `° ÐÌà  àThree€recordings€of€conversations€between€A.S.€and€the€Defendant€were€introduced€asÐ 8 ˆ Ðevidence€at€trial€and€played€for€the€jury.€€The€first€recording€occurred€in€February€1995,€and€althoughÐ $ t Ðno€specific€admission€was€made€by€the€Defendant€during€the€conversation,€the€jury€heard€theÐ  ` ÐDefendantððs€tone€of€voice€and€concern€that€ð ðthe€lawðð€could€be€listening.€€Two€more€tapedÐ ü L  Ðconversations€occurred€in€August€1995,€during€which€the€Defendant€discussed€explicit€sexualÐ è 8  Ðmatters€with€A.S.€€Both€of€the€conversations€that€were€taped€in€August€contained€statements€by€theÐ Ô$  ÐDefendant€that€could€reasonably€be€construed€by€a€jury€to€be€admissions€that€he€had€engaged€inÐ À  Ðsexual€intercourse€with€A.S.€at€some€prior€time.Ð ¬ü  ÐÌà  àThe€next€witness€for€the€State€was€Jennifer€Newby,€the€estranged€wife€of€the€Defendant.€€TheÐ „Ô  Ðmajority€of€Jennifer€Newbyððs€testimony€pertained€to€two€recorded€conversations€that€Jennifer€NewbyÐ pÀ Ðhad€with€the€victim,€A.S.€€In€the€first€of€these€conversations,€which€occurred€in€March€1996,€A.S.Ð \¬ Ðdenied€that€the€Defendant€had€raped€her.€€In€the€second€conversation,€which€occurred€in€AugustÐ H˜ Ð1996,€A.S.€confirmed€that€she€had€had€no€ð ðsexual€contactðð€with€the€Defendant.€€Both€conversationsÐ 4„ Ðwere€recorded€near€A.S.ððs€school,€because€of€Jennifer€Newbyððs€concern€that€any€contact€betweenÐ  p ÐJennifer€Newby€and€A.S.€would€be€met€with€disapproval€by€A.S.ððs€mother.€€The€tape€recordings€ofÐ  \ Ðboth€of€these€conversations€were€admitted€into€evidence,€and€the€jury€listened€to€them€during€theÐ øH Ðtrial.Ð ä4 ÐÌà  àJennifer€Newby€and€A.S.€both€testified€that€the€conversations€recorded€in€March€and€AugustÐ ¼  Ðof€1996€were€staged€and€that€A.S.€did€not€tell€the€truth€during€either€of€the€two€conversations.€Ð ¨ø ÐJennifer€Newby€and€A.S.€testified€that€they€discussed€what€A.S.€should€say€before€the€taping€began,Ð ”ä Ðand€A.S.€testified€that€she€cooperated€in€these€two€taped€conversations€because€she€was€afraid€of€theÐ €Ð ÐDefendant.€€Jennifer€Newby€also€testified€that€she€assisted€in€these€staged€tape„recordedÐ l¼ Ðconversations€because€she€was€afraid€of€the€Defendant.Ð X ¨ ÐÌà  àAt€trial,€Jennifer€Newby€testified€that€she€was€nineteen€years€old,€pregnant€and€unemployed.€Ð 0"€  ÐShe€testified€that€she€had€filed€for€a€divorce€from€the€Defendant€in€September€1996€but€that€they€laterÐ #l! Ðreconciled.€€However,€she€testified€that€she€filed€for€divorce€again€on€December€2,€1996.€€TheÐ $X" ÐDefendant€filed€a€complaint€for€divorce€against€Jennifer€Newby€on€December€27,€1996,€in€whichÐ ô$D # Ðhe€disputed€the€paternity€of€Jennifer€Newbyððs€unborn€child.€€Jennifer€Newby€testified€that€she€hadÐ à%0!$ Ðtold€the€Defendant€she€was€going€to€play€ð ðhard€ballðð€upon€learning€that€the€Defendant€disputedÐ Ì&"% Ðpaternity€of€her€unborn€child.Ð ¸'#& ÐÌà  àThe€final€witness€for€the€State€was€James€Newby,€Jenniferððs€father.€€Newby€testified€that€heÐ )à$( Ðâ âhad€heard€the€Defendant€admit€to€and€brag€about€having€sex€with€A.S.€€He€also€stated€that€theÐ |*Ì%) ÐDefendant€claimed€he€would€never€be€caught€because€he€was€smarter€than€the€law€enforcementÐ ° Ðauthorities.Ð œì Ðâ âÌà  àAdditional€evidence€was€presented€as€part€of€the€Stateððs€case€in€the€form€of€a€stipulation€thatÐ tÄ ÐA.S.€was€examined€by€a€doctor€on€February€17,€1995,€approximately€three€months€after€the€offense.Ð `° ÐAt€the€time€of€the€examination,€A.S.€was€eleven€years€old.€€The€doctor€who€examined€A.S.Ð L œ Ðdetermined€that€A.S.ððs€hymen€was€not€intact.Ð 8 ˆ ÐÌà  àThe€defense€proof€consisted€of€testimony€by€the€Defendant€and€four€witnesses.€€TheÐ  ` ÐDefendantððs€friend,€Greg€Buckner,€testified€that€he€was€present€with€the€Defendant€when€each€of€theÐ ü L  Ðthree€recorded€conversations€between€the€Defendant€and€A.S.€occurred.€€Buckner€confirmed€that€theÐ è 8  ÐDefendant€was€abusing€drugs€and€would€become€hyperactive€and€vulgar€when€under€the€influenceÐ Ô$  Ðof€ð ðcrank.ðð€€Buckner€believed€that€the€Defendant€was€clowning€around€and€playing€to€a€crowd€ofÐ À  Ðpeople€who€were€also€present€when€he€was€having€the€three€recorded€conversations€with€the€victim.€Ð ¬ü  ÐThe€other€three€defense€witnesses,€Randy€Deakins,€Delanie€Deakins€and€Wanda€Deakins,€wereÐ ˜è  Ðacquaintances€of€Jennifer€Newby.€€They€all€testified€to€the€effect€that€Jennifer€Newby€was€excitedÐ „Ô  Ðand€happy€to€have€obtained€the€tape„recorded€conversations€of€A.S.€in€which€A.S.€purportedlyÐ pÀ Ðdenied€that€the€rape€or€sexual€contact€had€occurred.Ð \¬ ÐÌà  àThe€Defendant€testified€that€he€had€never€engaged€in€sexual€intercourse€or€sexual€relationsÐ 4„ Ðwith€A.S.€€He€testified€that€he€did€not€meet€A.S.€until€just€before€Christmas€1994,€after€the€timeÐ  p Ðframe€in€which€the€alleged€rape€happened.€€According€to€the€Defendant,€he€was€high€on€ð ðcrankððÐ  \ Ðduring€the€tape„recorded€conversations€with€A.S.€€He€testified€that€being€under€the€influence€ofÐ øH Ðð ðcrankðð€made€him€hyperactive€and€more€likely€to€use€the€type€of€vulgar€language€that€is€heard€onÐ ä4 Ðthe€tape€recordings.€€He€stated€that€other€individuals€were€present€during€these€conversationsÐ Ð  Ðlistening€to€his€end€of€the€conversation,€and€he€maintained€that€much€of€the€time€he€was€simplyÐ ¼  Ðputting€on€a€show€for€these€individuals.€€He€also€testified€that€he€believed€that€the€conversations€wereÐ ¨ø Ðin€fact€being€recorded.Ð ”ä ÐÌà  àIn€July€1999,€the€trial€court€conducted€a€hearing€on€the€Defendantððs€motion€for€new€trial,€atÐ l¼ Ðwhich€several€witnesses€testified.€€Along€with€other€grounds,€the€Defendant€alleged€that€his€mother,Ð X ¨ ÐBarbara€Bowers,€had€received€a€letter€from€A.S.€stating€that€ð ðnothing€happenedðð€between€theÐ D!” ÐDefendant€and€A.S.€€Barbara€Bowers€testified€at€the€hearing€on€the€Defendantððs€motion€for€a€newÐ 0"€  Ðtrial€that€on€August€23,€1997,€she€received€a€letter€stating€the€following:Ð #l!
