Ms.BrendaPruitttestifiedthatonJune3,1996,shewasinvolvedinatrafficaccidentwiththedefendantinLakeCounty,Tennessee.Thedefendantofferedheronehundreddollars($100)ifshewouldnotcallthepolicesincehedidnothaveavaliddriverslicense.Ms.Pruittrefusedthemoneyandtoldthedefendantshewasgoingtocallthepolice.Thedefendantimmediatelyleftthesceneoftheaccident,claimingheneededtogotohismothershouse.Asheleft,Ms.Pruittcopiedthedefendantslicenseplatenumber.Whenthepolicearrivedatthesceneoftheaccident,Ms.Pruitttoldtheofficerwhathappenedandgavehimadescriptionofthedefendant,adescriptionoftheredtruckhewasdriving,andthedefendantslicenseplatenumber.Aninvestigationintothelicenseplatenumberrevealedthatthetruckwasregisteredtothedefendant.BoththetruckandthedefendantmatchedMs.Pruittsdescriptions.Moreover,Ms.Pruittpositivelyidentifiedthedefendantattrial.  Oneofthedefendantssons,Eddie,testifiedthatthedefendanthadsoldthetruckinquestiontohimpriortoJune3,althoughhewasunsureofthedate.ϜAccordingtoEddiestestimony,whenheboughtthetruckfromthedefendant,hereplacedthedefendantslicenseplatewithatemporarytag,buthecouldnotexplainhowthelicenseplatenumberMs.Pruittcopiedtracedownershipofthetruckthathithertothedefendant.Thedefendant,hiswife,andanotherofhissons,Shane,alsotestifiedattrialthatthedefendanthadsoldhistrucktohissonpriortoJune3,butnoneofthemcouldagreeuponthedatethedefendantsupposedlysoldthetruck,norcouldtheyproduceanydocumentationevidencingthesaleortransferoftitle.Moreover,ShaneandEddietestifiedthatonJune3,thedefendanthadbeeninLawrenceburg,Tennessee,helpingthemroofahouse.EddietestifiedthatthetruckinquestionwaswiththeminLawrenceburg,butShanetestifiedthatthetruckwasnotattheworksiteonJune3.  Thedefendantfirstarguesthattheevidencepresentedattrialisinsufficienttofindhimguiltyofoperatingamotorvehicleafterhavingbeendeclaredamotorvehiclehabitualoffenderandhavinghisdriverslicenserevoked.ThisCourtwillnotdisturbaverdictofguiltforlackofsufficientevidenceunlessthedefendantillustrateshowthefactscontainedintherecordandanyinferenceswhichmaybedrawnfromthefactsareinsufficient,asamatteroflaw,forarationaltrieroffacttofindthedefendantguiltybeyondareasonabledoubt.Statev.Tuggle,639S.W.2d913,914(Tenn.1982).AguiltyverdictrenderedbythejuryandapprovedbythetrialjudgeaccreditsthetestimonyoftheStateswitnesses,andapresumptionofguiltreplacesthepresumptionofinnocence.Statev.Grace,493S.W.2d474,476(Tenn.1973).̀  AnypersonfoundtobeanhabitualoffenderundertheprovisionsofthispartwhothereafterisconvictedofoperatingamotorvehicleinthisstatewhilethejudgmentororderofthecourtprohibitingsuchoperationisineffectcommitsaClassEfelony.T.C.A.5510616(b).TheStateandthedefendantagreedtointroduceintoevidenceacopyofa1990orderdeclaringthedefendanttobeamotorvehiclehabitualoffenderandrevokinghisdriverslicenseasaresult.Thus,theonlyissueattrialwaswhetherthedefendantoperatedamotorvehicleinTennesseeonJune3,1996.Seeid.  Here,therewassufficientevidenceforthejurytoconcludethatthedefendantdroveamotorvehicleinTennesseeonJune3.Ms.PruittpositivelyidentifiedthedefendantasthemanwhowasdrivingtheredtruckthathithercarinLakeCounty,Tennessee,onJune3.Thelicenseplatenumbershereportedtothepolicewastracedtothedefendant.Althoughthedefendantsandhisfamilystestimonywas,forthemostpart,contradictorytothefindingofguilt,itwasalsoquiteinconsistent.Thejuryobviouslydiscreditedtheirtestimony,whichisitsprerogative.Statev.Cabbage,571S.W.2d832,835(Tenn.1978).Thisissuelacksmerit.  Thedefendantnextarguesthatthetrialcourterredindenyingalternativesentencing.Theburdenofshowingthatthesentenceisimproperisupontheappealingparty.T.C.A.4035401(d)SentencingCommissionComments.Whenadefendantcomplainsofhisorhersentence,wemustconductadenovoreviewwithapresumptionofcorrectness.T.C.A.4035401(d).Thispresumption,however, isconditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).  BecausethedefendantdoesnotfallwithintheparametersofT.C.A.𛀜4035102(5)andisastandardoffenderconvictedofaClassEfelony,he ispresumedtobeafavorablecandidateforalternativesentencingoptionsintheabsenceofevidencetothecontrary.T.C.A.4035102(6).Inthiscase,eventhoughthetrialjudgedidnotexpresslystatethathebeganwiththepresumptionthatthedefendantwasafavorablecandidateforalternativesentencing,hisfindingsmakeitclearthattheStateovercamethepresumptionbypresentingampleevidenceofthedefendantslongcriminalhistory,whichincludespriorconvictionsfordrivingwitharevokedlicenseanddrivingundertheinfluence;thedefendantsunwillingnesstocomplywiththeconditionsofhispriorreleaseinthecommunity;andthedefendantslackofpotentialforrehabilitation.Thus,weconcludethatasentenceoftwoyearsconfinementwasappropriateforthedefendant.See󛀜Statev.ToneyL.Moore,C.C.A.No.01C019609CC00392,WilliamsonCounty(Tenn.Crim.App.filedOctober16,1997,atNashville).
