à0  Ðaccept€a€sentence€on€another€count€with€a€Range€II€length€but€a€Range€I€release€eligibilityÐ Ð Ðguilty€plea.€€òòSeeóó€òòidóó.€€In€both€òòMahleróó€and€òòHicksóó,€the€defendant€pleaded€guilty€to€sentences€which€wereÐ `° Ð1983).€€The€cases€applying€this€rule€have€generally€dealt€with€a€sentence€in€which€the€number€ofÐ ð@ Ðyears€imposed€is€too€great€or€too€few€in€relation€to€the€prescribed€punishment€under€the€statute.€€òòSee,Ð à0 Ðe.g.óó,€òòMcConnellóó,€12€S.W.3d€at€797,€800€(number€of€years€greater€than€statute€allowed€for€Range€IÐ Ð  Ðoffender);€òòHamlinóó,€655€S.W.2d€at€201€(number€of€years€less€than€statute€mandated).€€In€òòMcConnellóó,Ð À! Ða€proceeding€under€the€1989€Sentencing€Act,€the€high€court€vacated€the€sentence€which,€accordingÐ °"  Ðto€the€€the€plea€agreement,€was€structured€under€the€1982€Sentencing€Act.€€The€court€held€that€35„Ð  #ð! Ðyear€sentences€each€for€second€degree€murder€and€robbery€with€a€deadly€weapon€were€ð ðoutside€theÐ $à" Ðtrial€courtððs€jurisdictionðð€€because€the€maximum€Range€I€sentences€under€the€1989€Act€were€25€yearsÐ €%Ð # Ðand€twelve€years,€respectively.Ð p&À!$ ÐÌà  àà ` àWe€find€it€difficult€to€reconcile€òòMcConnellóó€with€òòHicksóó.€€McConnellððs€sentences€didÐ P( #& Ðnot,€in€fact,€exceed€the€total€range€of€possible€sentences€within€the€applicable€offense€classes.€€UnderÐ @)$' Ðthe€1989€Act,€McConnellððs€conviction€of€second€degree€murder€is€a€Class€A€felony€and€hisÐ 0*€%( Ðconviction€of€robbery€via€a€deadly€weapon€is€a€Class€B€felony.€€òòSeeóó€Tenn.€Code€Ann.€ðððð€40„35„118,Ð  +p&) Є111(b)(1),€(2),€„112(a)(1),€(2)€(1997).€€Although€the€maximum€sentence€for€Range€I,€Class€A€is€25Ð ,`'* Ðyears,€the€maximum€sentence€òòfor€a€Class€Aóó€offense€is€60€years.€€òòSeeóó€Tenn.€Code€Ann.€ðððð€40„35„Ð ° Ð111(b)(1),€„112(c)(1)€(1997).€€Although€the€maximum€sentence€for€Range€I,€Class€B€is€twelve€years,Ð  ð Ðthe€maximum€sentence€òòfor€a€Class€Bóó€offense€is€30€years.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„111(b)(2),Ð à Є112(c)(2)€(1997).€€McConnellððs€sentences,€by€result,€would€have€passed€muster€under€òòHicksóó,€whichÐ €Ð Ðauthorized€plea„bargaining€with€respect€to€the€ð ðoffender€classification€[(range)]€or€releaseÐ pÀ Ðeligibility.ðð€€òòHicksóó,€945€S.W.2d€at€709.€€òòMcConnellóó€even€recognizes€that€the€elements€of€ð ðoffenderÐ ` ° Ðclassification€and€release€eligibilityðð€are€proper€issues€for€plea„bargaining€and€ð ðstill€are€properlyÐ P   Ðcharacterized€as€non„jurisdictional.ðð€€òòMcConnellóó,€12€S.W.3d€at€798.€€Nevertheless,€the€òòMcConnellóóÐ @  Ðcourt€did€not€sanction€a€òòHicksòòóóóó,€non„jurisdictional€result.€€Curiously,€it€said€that€parties€are€not€freeÐ 0 € Ðto€negotiate€beyond€the€ð ðother€limitsðð€imposed€by€the€1989€Act.€€òòIdóó.€at€799.€€The€court€neverÐ  p  Ðmentioned€that€McConnellððs€sentence€could€have€been€identically€structured€under€the€1989€Act€viaÐ `  Ða€ð ðnon„jurisdictionalðð€range€reclassification.׃)×Ý ƒ #ÃÝòòÚ  Ú8Ú  ÚóóÝ  Ý×  ×Ð P  ÐÌà  àà ` àThe€òòMcConnellóó€court€cited€òòHicksóó€with€approval.€€òòIdóó.€at€797„98.€€We,€therefore,Ð à0  Ðassume€that€the€high€court€views€the€two€cases€to€be€in€harmony.€€We€see€only€one€possibility€forÐ Ð  Ðharmonizing€them.€€That€is,€it€is€immaterial€if€the€resulting€sentence€is€supportable€as€an€offender„Ð À Ðclassification/release„eligibility€function€when€the€parties€expressed€their€agreement€in€extra„Ð ° Ðjurisdictional€terms.€€Under€this€view,€McConnellððs€sentence€was€flawed€òòbecauseóó€the€parties€couched€Ð  ð Ðthe€computation€as€an€illegal€function€of€the€1982€Act,€and€Boydððs€sentence€would€be€invalidÐ à Ðbecause€the€parties€below€couched€their€agreement€in€terms€of€Code€section€40„35„501(i),€which€isÐ €Ð Ðinapplicable€to€especially€aggravated€sexual€exploitation€of€a€minor.Ð pÀ ÐÌà  àà ` àFrankly,€this€distinction€we€draw€seems€illusory,€but€òòMcConnellóó€is€the€later€case€andÐ P  Ðmust€be€considered€controlling.€€Boydððs€acceptance€of€a€sentence€to€be€served€at€100€percent€couldÐ @ Ðarguably€be€viewed€as€a€waiver€of€òòanyóó€release€eligibility€date,€as€opposed€to€a€joinder€of€especiallyÐ 0€ Ðaggravated€sexual€exploitation€of€a€minor€to€Code€section€40„35„501(i),€and€thereby€it€would€beÐ  p Ðsupportable€as€a€plea€bargain€with€respect€to€the€non„jurisdictional€matter€of€release€eligibility.€Ð ` ÐHowever,€the€parties€did€not€articulate€this€approach.€€Under€òòMcConnellóó,€the€ð ðno€release€eligibilityððÐ P Ðfor€the€offenses€enumerated€in€section€40„35„501(i)(2)€is€beyond€the€ð ðouter€limits€within€which€theÐ ð@ ÐState€and€a€defendant€are€free€to€negotiate.ðð€€òòMcConnellóó,€12€S.W.3d€at€799.Ð à0 ÐÌà  àà ` àAt€any€rate,€applying€òòMcConnellóó€to€invalidate€the€sentence€in€the€present€case€isÐ À! Ðsupported€by€the€language€of€Code€section€40„35„501.€€A€felony€sentence€ð ðto€the€department€ofÐ °"  Ðcorrection€or€to€a€local€jail€or€workhouse€òòshallóó€be€served€according€to€this€chapter.ðð€€Tenn.€CodeÐ  #ð! ÐAnn.€ðð€40„35„501(a)€(1997)€(emphasis€added).€€That€section€then€mandates€that€ð ð[r]elease€eligibility€Ð $à" Ðfor€each€defendant€sentenced€as€a€career€offender[,€Range€III€maximum,]€òòshall€occur€after€serviceÐ €%Ð # Ð(emphasis€added).€€Under€these€statutory€mandates,€Boyd€was€not€free€to€waive€the€establishmentÐ `'°"% Ðof€a€release€eligibility€date,€and€the€parties€were€not€free€to€extend€the€date€beyond€the€maximumÐ ° Ðprovided€by€statute.Ð  ð ÐÌà  àà ` àIn€the€present€case,€even€though€the€petitionerððs€eight„year€sentence€is€within€the€eightÐ €Ð Ðto€30€year€range€for€a€Class€B€felony,€òòseeóó€Tenn.€Code€Ann.€ðð€40„35„111(b)(2)€(1997),€and€indeedÐ pÀ Ðis€within€the€eight€to€twelve€year€range€for€a€Range€I€offender,׃$×Ý ƒ #ÃÝòòÚ  Ú9Ú  ÚóóÝ  Ý×  ×€òòseeóó€Tenn.€Code€Ann.€ðð€40„35„Ð ` ° Ð112(a)(2)€(1997),€the€100€percent€service€requirement€is€contrary€to€the€general€rule€that€sentencesÐ P   Ðshall€be€served€within€a€range€of€twenty€to€60€percent€before€parole€eligibility.€€òòSeeóó€Tenn.€Code€Ann.Ð @  Ððð€40„35„501(b)€„€(f)€(Supp.€1999).€€No€provision€of€the€Code€enumerates€especially€aggravatedÐ 0 € Ðsexual€exploitation€of€a€minor€as€an€offense€to€which€the€general€rule€does€not€apply.€€Ð  p  ÐÌà  àà ` àWe€therefore€conclude€that€the€petitionerððs€sentence€is€invalid,€notwithstanding€theÐ P  Ðplea€agreement.׃/è×Ý ƒ #ÃÝòòÚ  Ú10Ú  ÚóóÝ  Ý×  ×Ð ð@  Ðà  àà ` àÌà  àà ` àIn€the€wake€of€our€holding€that€the€petitionerððs€sentence€is€illegal,€the€question€whichÐ Ð  Ðarises€is€that€of€the€proper€remedy.׃+H ×Ý ƒ #ÃÝòòÚ  Ú11Ú  ÚóóÝ  Ý×  ×€€The€defendant€claims€that€he€does€not€desire€for€his€pleaÐ À Ðagreement€to€be€set€aside€and€advocates€that€we€modify€his€sentence€to€30€percent€service.€€The€state,Ð ° Ðon€the€other€hand,€argues€that€we€should€set€aside€the€conviction€and€either€remand€to€the€trial€courtÐ  ð Ðfor€further€proceedings€or€remand€with€instructions€for€the€court€to€proceed€in€accord€with€TennesseeÐ à ÐRule€of€Criminal€Procedure€11(e)(4).Ð €Ð Ðâ âÐ pÀ Ðà  àà ` àFirst,€we€consider€the€defendantððs€argument€that€we€should€merely€modify€his€eight„Ð ° Ðâ âyear€sentence€to€30€percent€service.€€Plea€agreements€are€often€called€ð ðplea€bargains,ðð€and€this€termÐ  ð Ðis€indicative€of€the€nature€of€such€agreements.€€As€a€general€proposition,€a€plea€agreement€is€aÐ à Ðbargained„for€exchange€between€the€state€and€the€defendant.€€In€exchange€for€the€defendantððs€pleaÐ €Ð Ðof€guilty,€the€state€often€agrees€to€drop€additional€charges,€to€reduce€the€charge€to€which€theÐ pÀ Ðdefendant€is€to€plead€guilty,€and/or€to€agree€to€a€sentencing€structure€that€is€more€favorable€than€theÐ ` ° Ðdefendant€might€otherwise€expect.€€òòSee€generallyóó€€Tenn.€R.€Crim.€P.€11(e)(1)€(concessions€whichÐ P   Ðmay€be€made€in€plea€bargaining);€òòState€v.€Pettusóó,€986€S.W.2d€540,€543€(Tenn.€1999)€(nature€of€pleaÐ @  Ðbargaining€is€ð ðgive€and€takeðð€in€order€to€reach€resolution€of€pending€charge(s)).€€In€exchange€for€theÐ 0 € Ðstateððs€concession(s),€the€defendant€may€agree€to€accept€a€conviction€and/or€sentence€which€isÐ  p  Ðdifferent€than€that€which€he€might€have€received€had€the€charge(s)€proceeded€to€trial.€€In€the€presentÐ `  Ðcase,€the€defendantððs€bargain€with€the€state€resulted€in€the€more€serious€aggravated€rape€charge€beingÐ P  Ðdismissed€in€exchange€for€the€defendantððs€guilty€plea€and€acceptance€of€an€increased€punishmentÐ ð@  Ðfor€the€less„serious€charge€of€especially€aggravated€sexual€exploitation€of€a€minor.€€Thus,€it€isÐ à0  Ðapparent€that€the€plea€agreement€benefitted€both€the€state€and€the€defendant.€€To€modify€theÐ Ð  Ðdefendantððs€sentence€to€30€percent€service€would€deprive€the€state€of€the€great€majority€of€its€bargainÐ À Ðand€would€confer€an€unjust€benefit€on€the€defendant.€€òòóóThus,€we€reject€this€alternative.׃,×Ý ƒ #ÃÝòòÚ  Ú12Ú  ÚóóÝ  Ý×  ×Ð ° ÐÌà  àà ` à€In€choosing€the€proper€disposition,€we€are€guided€by€the€procedure€that€should€haveÐ à Ðoccurred€in€the€trial€court.€€Upon€presentation€of€the€plea€agreement,€the€trial€court€should€haveÐ €Ð Ðrecognized€that€the€proposed€sentence€was€illegal.€€Thus,€the€court€should€have€rejected€theÐ pÀ Ðagreement€for€the€reasons€we€have€explained€above.€€The€court€would€then€be€obligated€to€adviseÐ `° Ðthe€defendant€of€€his€right€to€withdraw€the€plea€and€that€if€he€should€chose€not€to€withdraw€his€guiltyÐ P  Ðplea,€the€disposition€of€his€case€may€be€less€favorable€than€that€for€which€the€agreement€called.Ð @ ÐTenn.€R.€Crim.€P.€11(e)(4).€€In€the€present€case,€if€the€defendant€maintains€his€guilty€plea€toÐ 0€ Ðespecially€aggravated€sexual€exploitation€of€a€minor€count,€the€court€could€then€sentence€him€to€anyÐ  p Ðacceptable€alternative€under€the€Criminal€Sentencing€Reform€Act€of€1989.€€Because€the€court€willÐ ` Ðhave€rejected€the€proposed€agreement,€the€state€would€not€be€required€to€move€for€dismissal€of€theÐ P Ðaggravated€rape€count€as€required€under€the€terms€of€the€proposed€agreement.€€òòSee€generallyóó€Tenn.Ð ð@ ÐR.€Crim.€P.€11(e)(1)(A)€(state€may€move€for€dismissal€of€other€charges€as€part€of€plea€agreement).€Ð à0 ÐThe€defendant€would€then€face€further€prosecution€for€the€aggravated€rape€count,€which€could€beÐ Ð  Ðdisposed€of€by€another€plea€agreement€or€trial.€€On€the€other€hand,€if€the€defendant€chooses€toÐ Ðwithdraw€his€plea,€he€would€be€free€to€enter€into€a€different€plea€agreement€with€the€state€as€to€theÐ °"  Ðtwo€charges€against€him,€or€he€could€go€to€trial€on€the€charges€stated€in€the€indictment.€€òòSeeóó€Tenn.Ð  #ð!
