FACTS    Defendantpledguiltytopossessionofcocaineover0.5gramswithintenttosellandagreedtoanineyearsentence;however,hepetitionedforalternativesentencing.Atthesentencinghearing,defendanttestifiedregardingthecircumstancesoftheoffense.In1992,hereturnedtoTennesseefromIllinoisanddidnothaveajob.Inlessthanthreemonths,hewasinvolvedwiththe wrongcrowdandbegansellingdrugs.OnoraboutNovember9,1994,theShelbyCountyPoliceDepartmentraideddefendantshomeandfoundovertwentysix(26)gramsofcocaineand$7,800incash.Defendantswifeanddaughterresidedwithhimatthetimeofthearrest. Defendanttestifiedthatsubsequenttohisarrest,hehadgainedemploymentwithBrewerLandscaping,gottenmarried,andhadanotherchild.Althoughhiswifeisemployed,defendantstatedthathisincomeisnecessarytosustainhisfamily. Defendantstestimonyalsorevealedhehadonepriordrugrelatedconvictionforpossessionofmarijuana.Hewassentencedtoeleven(11)monthsandtwentynine(29)daysandreceivedprobation. Thestatedidnotofferanyproof. Basedonthetestimony,thetrialcourtfoundthatdefendantdidnotappreciatetheseriousnessoftheoffenseandfurtherstressedtheneedfordeterrenceindenyingdefendantspetitionforalternativesentencing.   I.   TheCommunityCorrectionsActestablishesaprogramofcommunitybasedalternativestoincarcerationforcertaineligibleoffenders.SeeTenn.CodeAnn.4036103.AdefendantiseligibleforparticipationinacommunitycorrectionsprogramifthedefendantsatisfiesseveralminimumeligibilitycriteriasetforthatTenn.CodeAnn.4036106(a)(1)(7).TheActdoesnotprovidethatalloffenderswhomeettheserequirementsareentitledtosuchrelief.Statev.Grandberry,803S.W.2d706,707(Tenn.Crim.App.1990).Indeed,Tenn.CodeAnn.4036106(d)providesthattheeligibilitycriteriashallbeinterpretedasminimumstandardstoguidethecourt'sdeterminationofeligibilityofoffendersundertheAct. UndertheCriminalSentencingReformActof1989,trialjudgesareencouragedtousealternativestoincarceration.AnespeciallymitigatedorstandardoffenderconvictedofaClassC,DorEfelonyispresumedtobeafavorablecandidateforalternativesentencingoptionsintheabsenceofevidencetothecontrary.Tenn.CodeAnn.4035102(6).Obviously,ClassAandBfelonshavenosuchpresumption. Indeterminingifincarcerationisappropriate,atrialcourtmayconsidertheneedtoprotectsocietybyrestrainingadefendanthavingalonghistoryofcriminalconduct,theneedtoavoiddepreciatingtheseriousnessoftheoffense,whetherconfinementisparticularlyappropriatetoeffectivelydeterotherslikelytocommitsimilaroffenses,andwhetherlessrestrictivemeasureshaveoftenorrecentlybeenunsuccessfullyappliedtothedefendant.Tenn.CodeAnn.4035103(1);seealsoStatev.Ashby,823S.W.2d166,169(Tenn.1991). AcourtmayalsoconsiderthemitigatingandenhancingfactorssetforthinTenn.CodeAnn.4035113and114astheyarerelevanttothe4035103considerations.Tenn.CodeAnn.4035210(b)(5);Statev.Boston,938S.W.2d435,438(Tenn.Crim.App.1996).Additionally,acourtshouldconsiderthedefendantspotentialorlackofpotentialforrehabilitationwhendeterminingifanalternativesentencewouldbeappropriate.Tenn.CodeAnn.4035103(5);Statev.Boston,938S.W.2dat438.   II.    ThedefendantinthiscasewasconvictedofaClassBfelonyandisnotaffordedapresumptioninfavorofalternativesentencing.HeisalsoineligibleforprobationunderTenn.CodeAnn.4035303(a)sincehissentencewasovereightyears.Theproofshowedthatdefendanthadapriordrugrelatedoffense.Hisprioralternativesentenceforpossessionofdrugsdidnotdeterhimfromfurtherillegaldrugactivity.Theinstantdrugconvictioninvolvedovertwentysix(26)gramsofcocaine,andthepolicefoundover$7,800incashatthedefendantshome.Obviously,thedefendantwasinvolvedinsubstantialdrugsales. Thetrialjudgeexpressedconcernwithdefendantsattitudetowardtheseriousnessoftheoffenseandtheamountofcocaineandcashmoneyinvolved.Hedeterminedthatincarcerationwasnecessarytoavoiddepreciatingtheseriousnessoftheoffenseandtoserveasadeterrent.SeeStatev.Dykes,803S.W.2d250,260(Tenn.Crim.App.1990).Thetrialjudgeproperlyconsideredappropriatesentencingprinciples,andhisfindingsareentitledtoapresumptionofcorrectness.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Thetrialcourtdidnoterrindenyingalternativesentencing.
