AtthetimePetitionerpledguiltytotheoffensein1991therewasathreeyearstatuteoflimitationsforfilingapetitionforpostconvictionrelief.Tenn.CodeAnn.4030102(repealed1995).UnderthePostConvictionProcedureActineffectatthetimethepresentpetitionwasfiledinthetrialcourt,TennesseeCodeAnnotatedsection4030202(c)(Supp.1996)providedinpertinentpartthat [i]fapriorpetitionhasbeenfiledwhichwasresolvedonthemeritsbyacourtofcompetentjurisdiction,anysecondorsubsequentpetition[forpostconvictionrelief]shallbesummarilydismissed.̀  Thetrialcourtinthecasesubjudicedismissedthepetitionwithoutappointmentofcounseloranevidentiaryhearingbaseduponthefactthatitwasfiledoutsidetheapplicablestatuteoflimitations,andthatapreviouspostconvictionreliefpetitionhadbeenpreviouslydeterminedonthemerits.SeeArnoldCarterv.State,____S.W.2d____,No.03S019612CR00117,MonroeCounty(Tenn.,atKnoxville,Sept.8,1997).
