àWilliam€Bradley,€the€Defendant,€appeals€as€of€right€from€his€conviction€forÏharassment.€€In€December€1995,€Defendant€was€charged€with€harassment.€€He€wasÏtried€and€convicted€in€General€Sessions€Court,€but€appealed€to€the€Criminal€CourtÏof€Davidson€County€for€a€trial€òòdeóó€òònovoóó.€€After€waiving€his€right€to€a€trial€by€jury,Ð ö–  ÐDefendant€pled€not€guilty.€€The€trial€court€found€the€Defendant€guilty€and€sentencedÏhim€to€eleven€(11)€months,€twenty„nine€(29)€days.€€Defendant€was€to€serve€hisÏsentence€on€unsupervised€probation€pursuant€to€the€provisions€of€Tennessee€CodeÏAnnotated€section€40„35„313.€€In€his€appeal,€Defendant€argues€the€evidence€wasÏinsufficient€to€convict€the€Defendant€of€harassment€and€that€hearsay€evidence€wasÏimproperly€admitted.€€We€affirm€the€conviction€and€sentence,€but€remand€to€the€trialÏcourt€for€a€withdrawal€of€the€judgment€of€guilty€and€entry€of€an€order€in€complianceÏwith€Tennessee€Code€Annotated€section€40„35„313.ÌÌà àDavid€Beard€testified€that€he€is€the€manager€of€a€mattress€store€in€BellevueÏMall€in€Nashville.€€Beard€identified€the€Defendant€as€a€customer€of€the€store€whoÏpurchased€a€Tempera€Pedic€mattress€on€June€25,€1996.€€The€Defendant€drove€toÏLexington,€Kentucky,€to€pick€up€the€mattress.€€Beardððs€store€has€a€sixty€(60)€dayÐ ¶9V01 Ðreturn€policy€with€no€questions€asked€and€the€sale€price€returned€to€the€customer.€ÏOn€November€30,€1996,€the€Defendant€called€Beard€and€asked€for€a€refund€for€theÏmattress€due€to€his€dissatisfaction.€€Beard€explained€that€no€money€would€beÏrefunded€as€the€sixty€(60)€day€period€had€expired.€€Defendant€was€upset€and€calledÏseveral€more€times€the€next€week€refusing€to€accept€Beardððs€explanation€of€theÏstoreððs€return€policy.€€Defendant€then€called€Beardððs€supervisor.€€Finally,€BeardÏadvised€Defendant€that€he€could€not€help€him€and€to€stop€calling€his€store.ÌÌà ` àDefendant€and€his€wife,€Susan€Ramey,€continued€to€repeatedly€call€the€store,Ïoften€calling€back€immediately€after€the€prior€telephone€call.€€Defendant€believed€thatÏthis€mattress€was€purchased€under€a€six€(6)€month€same€as€cash€policy.€€During€oneÏcontinuing€phone€conversation,€Defendant€threatened€Beard€that€he€would€ð ðkick€hisÏass.ðð€€Beard€stated€that€he€was€ð ðshook€upðð€and€upset€after€this€telephone€call.€€BeardÏwas€then€advised€by€his€supervisors€that€Defendant€had€also€made€threatening€andÏabusive€calls€to€them.€€On€cross„examination€Beard€admitted€that€he€had€exchangedÏmattresses€with€Defendant,€and€that€this€new€mattress€has€a€ten€(10)€yearÏguarantee.ÌÌà ` àThe€Defendant€testified€that€he€did€not€make€the€telephone€call€threatening€toÏð ðkick€[Mr.€Beardððs]€ass,ðð€but€that€George€Wesley€White€made€that€telephone€call.€€AÏcopy€of€Defendantððs€telephone€bill€was€entered€as€an€exhibit€which€indicated€multipleÏcalls€to€Beardððs€Bellevue€mattress€store.€€On€cross„examination,€Defendant€admittedÏthat€White€was€calling€upon€his€behalf€when€he€threatened€Beard.€€DefendantÏremembered€calling€on€approximately€three€(3)€occasions€requesting€his€moneyÐ  :À00 Ðback€and€looking€for€a€replacement€mattress.€€Defendant€described€his€frustrationÏin€the€inability€to€resolve€the€matter€and€felt€shunned€by€Beard.€€After€calling€theÏcorporate€offices€for€assistance,€Defendant€was€instructed€to€call€the€Bellevue€storeÏand€Beard€was€often€not€available€when€Defendant€called.€€In€his€estimation,ÏDefendant€telephoned€Dave€Fall€with€Tempera€Pedic€mattresses€asking€for€a€refundÏon€seven€(7)€to€ten€(10)€occasions.€€ÌÌà ` àSusan€Ramey€testified€that€she€was€present€when€Defendant€telephoned€theÏstore€and€never€heard€Defendant€threaten€Beard.€€Ramey€also€telephoned€Beard€atÏleast€two€(2)€or€three€(3)€times.€€Ramey€was€aware€that€White€called€and€threatenedÏto€ð ðkick€[Mr.€Beardððs]€ass,ðð€and€that€these€calls€were€made€at€Defendantððs€request.€ÏRamey€was€not€present€when€the€threatening€telephone€call€was€made€as€she€worksÏoutside€the€home€at€Baptist€Hospital.€ÌÌà ` àAn€attorney€in€Waverly,€Tennessee,€testified€that€he€has€known€Defendant€allÏhis€life.€€Based€upon€Defendantððs€reputation,€the€attorney€testified€that€he€wouldÏafford€Defendant€ð ðfull€faith€and€credit€on€his€oath€as€a€witnessðð€and€that€he€is€notÏaware€of€any€violent€tendencies€of€the€Defendant.ÌÌà ` Ðà ` àA€person€commits€the€offense€of€harassment€when€he€intentionally:€(1)Ïâ âthreatens,€by€telephone€or€in€writing,€to€take€action€known€to€be€unlawful€against€anyÏperson,€and€by€this€action€knowingly€annoys€or€alarms€the€recipient;€or€(2)€placesÏone€(1)€or€more€telephone€calls€anonymously,€or€at€an€inconvenient€hour,€or€in€anÏoffensively€repetitious€manner,€or€without€a€legitimate€purpose€of€communication,Ïand€by€this€action€knowingly€annoys€or€alarms€the€recipient.€€Tenn.€Code€Ann.€ðð€39„¼17„308(a)(1)€and€(2).€€A€violation€of€this€offense€is€a€Class€A€misdemeanor.€€Tenn.ÏCode€Ann.€ðð€39„17„308(b).€€Testimony€demonstrated€that€Defendant€repeatedlyÏcalled€Beard,€even€after€being€instructed€to€stop€calling€and€that€nothing€more€couldÏbe€done€to€assist€the€Defendant.€€Beard€testified€that€Defendant€threatened€that€heÏwould€ð ðkick€his€ass,ðð€which€upset€Beard€and€ð ðshook€him€up.ðð€€While€DefendantððsÏtestimony€conflicts€with€that€of€Beardððs€as€to€who€issued€the€threats,€the€trial€courtÏresolved€all€factual€issues€raised€by€the€evidence.€€òòPappasóó,€754€S.W.2d€at€623.€€ThisÐ À!` Ðcourt€will€not€reweigh€or€reevaluate€the€evidence.€€òòCabbageóó,€571€S.W.2d€at€835.€Ð È#h ÐNotwithstanding€the€threatening€nature€of€the€telephone€calls,€Defendantððs€testimonyÏthat€he€repeatedly€called€Beard,€who€was€knowingly€alarmed€and€asked€DefendantÏto€stop€calling,€is€sufficient€for€a€reasonable€trier€of€fact€to€have€found€beyond€aÏreasonable€doubt€all€the€elements€necessary€to€convict€the€Defendant€ofÏharassment.€€This€issue€is€without€merit.ÌÌà ` àDefendant€also€contends€that€hearsay€testimony€of€others€who€told€Beard€thatÏDefendant€had€made€harassing€telephone€calls€to€them€was€inadmissible.€€BeardÏtestified€that€his€supervisors€advised€him€that€Defendant€had€also€made€abusive€andÏâ âthreatening€telephone€calls€to€them.€€There€is€no€record€that€Defendant€objected€toÐ 8¸..
