Thedefendantwasapassengerinacarstoppedbythepolice.Becauseoneoftheofficersnotedthatthedriverseyeswerebloodshot,thedriverwasadministeredthreefieldsobrietytests,eachofwhichhepassed.Theofficeraskedthedriverwhyhiseyeswerebloodshot.Thedriverrespondedthathehadbeenworkingallnight.Theofficeraskedthedriverifhehadbeenusingdrugs.Thedriverrespondedthathehadnotbeenusingdrugs,andheinvitedtheofficertosearchhisvehicle.  Theofficeraskedthedefendanttoexitthevehiclesoitcouldbesearched.Theofficerthenwatchedasthedefendantremovedhiswalletfromhisbackpocketandplaceditinsidethepassengersidedoorhandle.Whensearchingthevehicle,theofficernoticedthatthedefendantswalletwasbulgingandhadaglassineobjectstickingoutofit.Theofficeropenedthewalletandfoundtwoseparateandequalpouchesofmarijuanaweighing5.7gramsandeightrocksofcrackcocaineweighing.9grams.Inawrittenstatement,thedefendantadmittedthatthedrugsbelongedtohim,notthedriver.Apagerandthreehundreddollarsandfiftysevencents($300.57)incash,fiftydollars($50.00)ofwhichwashiddeninthedefendantsshoe,wasfoundonthedefendantsperson.Nodrugparaphernaliawasfoundonthedriver,onthedefendant,orinthevehicle.Moreover,theofficersearchingthevehicledetectednoodorofalcoholordrugs.  Attrial,thedefendanttestifiedthatheandthedriverhadpurchasedthedrugsfortheirownuse.Thatevening,heandthedriverhadbeenrollingthemarijuanawiththecocaineandsmokingitwiththewindowsrolledup.Hecouldnotexplainwhythevehicledidnotsmellofmarijuanaorotherdrugs.Toexplaintheabsenceofparaphernalia,thedefendanttestifiedthathehadusedthelastofhisrollingpapersandthrowntheemptypackageoutofthewindow,whilethedriverhadbeenusingacrackpipethathehidinhispants.Thedefendantalsostatedthathehadsomuchcashonhimthateveningbecausehehadjustbeenpaid.  Thedefendantadmittedattrialthathewasinpossessionofthemarijuanaandcocaine.Hischallenge,however,istowhethertheevidencewassufficienttoestablishthatheintendedtosellthecocaine.WeagreewiththetrialcourtsconclusionthattheStatesufficientlyprovedintent.  Itmaybeinferredfromtheamountofacontrolledsubstance...alongwithotherrelevantfactssurroundingthearrest,thatthecontrolledsubstanceorsubstanceswerepossessedwiththepurposeofsellingorotherwisedispensing.T.C.A.3917419.Possessionofapagerandalargeamountofcashsimultaneouslywithalargeamountofacontrolledsubstancemaybesufficientcircumstancesfromwhichthefactfindercouldinferthatthedefendantintendedtosellthecontrolledsubstance.E.g.,Statev.RonaldMitchell,C.C.A.No.02C019702CC00070,LauderdaleCounty(Tenn.Crim.App.filedSeptember15,1997,atJackson);Statev.RobertLeeMoore,C.C.A.No.02C019502CC00038,MadisonCounty(Tenn.Crim.App.filedOctober4,1995,atJackson).  Here,theproofestablishedthatthedefendantwascarryingeightrocksofcrackcocainethatweighed.9grams,apager,andthreehundreddollarsandfiftysevencents($300.57)incash,someofwhichwashiddeninhisshoe.Thecocainewasnotfoundinthedefendantspocket,butratherinhiswallet,asiftosuggest,asthetrialcourtsurmised,thatthedrugswerebeingheldforresale.Althoughthedefendantclaimedtohaveboughtthecocaineforpersonalconsumptionthatevening,hecouldnotexplainwhythevehicledidnotsmelllikesmoke,eventhoughearlierthatevening,hehadsupposedlysmokedthedrugsinthevehiclewiththewindowsclosed.Giventhis,sufficientevidenceintherecordexiststosupportafindingofintent.Thisissueiswithoutmerit.       _______________________________       JOHNH.PEAY,JudgeCONCUR:______________________________PAULG.SUMMERS,Judge______________________________THOMAST.WOODALL,Judge
