Ðrelease€eligibility€of€thirty€percent€(30%),€and€would€receive€a€sentence€of€four€years€incarcerationÐ  \ Ðon€each€count.€€Furthermore,€the€agreement€provided€that€the€sentences€on€counts€one€through€fiveÐ øH Ðwould€run€consecutively;€the€sentences€on€counts€six€through€sixteen€would€run€concurrently€withÐ ä4 Ðwhat€happened€when€these€hundred€and€forty€thousand€(140,000)Ð $X" Ðpills€were€released€into€the€community€to€individuals,€whether€theyÐ ô$D # Ðbe€suffering€from€pain,€as€explained€by€[the€appellant]€in€hisÐ à%0!$ Ðstatement€to€the€Probation€Officer,€you€do€have€a€hundred€and€fortyÐ Ì&"% Ð[thousand€(140,000)]€pills€going€out€of€control€into€the€communityÐ ¸'#& Ðwithout€the€supervision€of€the€Tennessee€Department€of€Health€or€theÐ ¤(ô#' Ð.€.€.€Board€of€Pharmacy.€€So€that€does€create€a€substantial€danger€toÐ )à$( Ðthe€community€because€we€donððt€know€what€these€people€ð!ð€theyÐ |*Ì%) Ðmight€have€taken€them,€which€could€have€been€a€detriment€to€them,Ð h+¸&* Ðthey€may€have,€in€order€to€obtain€income,€sold€them€to€other€people,Ð ° Ðcould€have,€you€know,€the€potentialities€are€endless€of€where€theseÐ œì Ðpills€could€have€gone€because€they€clearly€went€out€of€control€of€theÐ ˆØ Ðdrugstore€and€the€licensed€pharmacist€when€they€got€out.€€So€theÐ tÄ Ðnature€of€this€offense€appears€to€be€in€the€extreme.Ð`°` x` x ÐIn€sum,€over€the€course€of€three€years,€the€appellant€dispensed€an€extraordinary€amount€of€pillsÐ L œ Ðthrough€a€large€number€of€falsified€prescriptions.€€òòSeeóó€òòState€v.€James€Randolph€Bradfordóó,€No.Ð 8 ˆ Ð01C01„9004„CC„00101,€1991€Tenn.€Crim.€App.€LEXIS€296,€at€**5„6€(Nashville,€Apr.€18,€1991).Ð $ t ÐThe€trial€court€found€that€the€appellant€was€remorseful€and€that€he€had€enrolled€in€a€rehabilitationÐ  ` Ðprogram€to€fight€his€substance€addiction;€however,€the€court€nevertheless€found€that€the€appellantÐ ü L  Ðhad€a€ð ðsustained€intent€to€violate€the€law.ðð€€This€finding€is€supported€by€the€appellantððs€distributionÐ è 8  Ðof€140,000€pills€to€sixteen€individuals€over€a€three€year€period.€€Again,€we€note€that€the€trial€courtÐ Ô$  Ðgave€careful€consideration€to€the€appellantððs€sentencing.€€We€agree€with€the€trial€court€that€theÐ À  Ðcircumstances€underlying€the€appellantððs€convictions€were€of€an€excessive€or€exaggerated€degree.€Ð ¬ü  ÐòòSeeóó€òòState€v.€Charles€Chesteenóó,€No.€E1999„00910„CCA„R3„CD,€2000€Tenn.€Crim.€App.€LEXIS€455,Ð ˜è  Ðat€**31„32€(Knoxville,€June€8,€2000).€€Accordingly,€we€conclude€that€the€trial€court€did€not€err€inÐ „Ô  Ðdenying€the€appellant€full€probation.Ð pÀ ÐÌà  àà ` àThe€appellant€also€contends€that€the€trial€court€erred€in€enhancing€the€appellantððsÐ H˜ Ðsentence€ð ðbased€upon€the€presence€of€the€facts€and€elements€of€the€offenses€charged.ðð€€The€appellantÐ 4„ Ðand€the€State€entered€into€a€plea€agreement€which€was€approved€by€the€trial€court.€€The€agreementÐ  p Ðspecifically€provided€the€sentence€the€appellant€was€to€receive€for€each€conviction.€€Thus,€the€recordÐ  \ Ðdoes€not€reflect€that€the€trial€court€€ð ðenhancedðð€any€sentence€based€upon€facts€which€were€elementsÐ øH Ðof€the€charged€offenses.€€Ð ä4 ÐÌà  àà ` àFinally,€the€appellant€alleges€that€the€trial€court€improperly€balanced€the€enhancementÐ ¼  Ðand€mitigating€factors.€€However,€Ð ¨ø Ðà8  àà8` Ð Ð àÔ‡X^ XXX^ Ô[t]he€appellant's€sentence€is€not€determined€by€the€mathematicalÐ ”ä Ðprocess€of€adding€the€sum€total€of€enhancing€factors€present€thenÐ €Ð Ðsubtracting€from€this€figure€the€mitigating€factors€present€for€a€netÐ l¼ Ðnumber€of€years.€Rather,€the€weight€to€be€afforded€an€existing€factorÐ X ¨ Ðis€left€to€the€trial€court's€discretion€so€long€as€the€court€complies€withÐ D!” Ðthe€purposes€and€principles€of€the€1989€Sentencing€Ô% ‡ ÔÔ#†X^ XXX^ Ã{#ÔÔ%†Ó}ÔÔ‡X^ XXX^ ÔAct€and€itsÐ 0"€  Ðfindings€are€adequately€supported€by€the€record.Ô#†X^ XXX^ ~#Ô€€Ð#l!` x` x ÐòòBoggsóó,€932€S.W.2d€at€475„€476.€€We€conclude€that€the€trial€court€did€not€err€in€its€application€of€theÐ $X" Ðenhancement€or€mitigating€factors.€€Ð ô$D # ÐÌà@MM"ìàòòò òIII.€€ConclusionóóˆÐ Ì&"% Ðó óà0  àà0` (#(#àBased€upon€the€foregoing,€we€affirm€the€judgment€of€the€trial€court.€€à Ð àà @Ð àи'#&` (#` (# ÐÌÌÌà  àà ` àà ¸ àà  àà h àà À àà  à___________________________________€Ð h+¸&* Ðà  àà ` àà ¸ àà  àà h àà À àà  àNORMA€McGEE€OGLE,€JUDGE
