àDonna€Beavers,€a€friend€of€the€victim,€testified€that€she€met€the€victim€inÏSeptember€1988€at€the€bank€where€they€worked€together€and€that€they€saw€each€otherÏsocially€several€times€each€week.€€She€said€the€victim€had€dated€the€defendant€beforeÏshe€and€the€victim€were€friends,€and€the€victim€started€dating€the€defendant€again€in€theÏbeginning€of€1989.€€She€said€she€and€the€victim€and€two€men€decided€to€go€out€onÏAugust€19,€1989.€€She€said€they€went€to€a€softball€party€then€to€Patrickððs,€a€local€bar.€ÏShe€said€the€victim€had€made€plans€to€meet€the€defendant€at€Patrickððs.€€She€testifiedÏthat€when€they€arrived€at€the€bar,€the€defendant€was€there€and€he€and€the€victim€gotÏinto€an€argument.€€She€said€the€defendant€threw€a€drink€on€the€victim€then€reached€forÏthe€victimððs€drink€and€punched€a€man€who€tried€to€intervene.€€She€said€both€men€wereÏtaken€out€of€the€bar.€€She€said€when€Patrickððs€closed,€the€victim€drove€them€homeÏbecause€she€had€not€had€much€to€drink,€and€at€4:00€a.m.€they€dropped€the€victim€off€atÏher€apartment.€Ð àBeavers€testified€that€the€victim€told€her€the€defendant€pointed€a€gun€atÏher€forehead€in€the€parking€lot€of€Patrickððs€in€July€1988.€€She€said€the€victim,€whoÏappeared€very€excited,€told€her€about€the€incident€when€Beavers€arrived€at€the€victimððsÏcar€just€after€the€incident€occurred.€€She€said€neither€she€nor€the€victim€reported€theÏincident€to€the€police.€€She€admitted€that€in€the€past,€other€incidents€had€caused€theÏvictim€to€seek€restraining€orders€on€the€defendant,€and€she€did€not€know€why€the€victimÏdid€not€report€that€particular€incident€to€the€police.€€Beavers€testified€that€theÏrelationship€between€the€victim€and€the€defendant€was€stormy€but€that€on€August€18,Ï1989,€the€victim€told€her€she€and€the€defendant€had€decided€they€were€going€to€beÏfriends€and€date€other€people.€€She€said€this€decision€seemed€to€relieve€the€victim.€€SheÏsaid€she€had€never€seen€a€gun€in€the€victimððs€apartment.ÌÌà àThe€defendant€testified€that€he€graduated€with€honors€from€ñ!ñœñ!ñtheñ!ñ›ñ!ñ€UniversityÏof€Tennessee€and€that€he€had€attended€one€year€of€law€school€ñ!ñœñ!ñin€1980„81.ñ!ñ›ñ!ñ€€He€said€hisÏsources€of€income€before€the€shooting€included€selling€real€estate,€cocaine,€andÏmarijuana,€and€his€primary€source€of€income€during€the€time€he€dated€the€victim€wasÏselling€cocaine.€€He€said€he€heavily€used€cocaine,€using€a€minimum€of€one€gram€perÏday€and€sometimes€as€much€as€one€eighth€to€one€quarter€of€an€ounce.€€He€explainedÏthat€the€combination€of€alcohol€and€cocaine€caused€him€to€lose€his€sense€of€judgment,Ïand€he€testified€about€several€incidents€when€he€was€high€on€cocaine€and€his€impairedÏjudgment€caused€him€to€do€irrational€things,€such€as€confronting€a€mugger€who€had€aÏknife.ÌÌà Ðtheir€relationship.€€The€defendant€stated€their€relationship€was€going€well€in€April€1989,Ïbut€they€broke€up€in€July€because€they€began€having€problems.€€He€said€he€neverÏpointed€a€gun€at€the€victim.€€He€said€on€August€18,€1989,€he€and€the€victim€reconciledÏand€came€to€an€agreement€to€act€civilly€toward€each€other€and€to€date€other€people.ÌÌà àThe€defendant€said€his€friend,€Les€Rawding,€gave€him€a€gun€to€use€forÏprotection€from€the€jealous€boyfriend€of€one€of€the€defendantððs€female€friends.€€He€saidÏthe€gun€was€usually€unloaded.€€He€said€he€did€not€like€ñ!ñœñ!ñto€have€theñ!ñ›ñ!ñ€gun€in€his€home,€andÏit€was€never€in€his€car.ÌÌà àThe€defendant€testified€that€on€the€night€of€August€19,€1989,€he€met€LesÏÔ_ÔRawdingÔ_Ô€at€the€Boardwalk€Caf,€and€he€started€drinking,€doing€cocaine€and€smokingÏmarijuana.€€He€said€he€left€to€meet€the€victim€at€Patrickððs€about€midnight€and€when€theÏvictim€arrived,€she€was€angry€because€she€had€intercepted€a€message€from€anotherÏfemale€on€his€answering€machine.€€The€defendant€said€he€and€the€victim€fought,€then€aÏman€ñ!ñœñ!ñsteppedñ!ñ›ñ!ñ€between€them,€and€the€defendant€hit€the€man.€€He€said€the€bouncer€threwÏhim€and€the€other€man€out€of€Patrickððs,€but€he€got€into€another€fight€in€the€parking€lotÏwith€a€different€man.€€He€ñ!ñœñ!ñsaid€thatñ!ñ›ñ!ñ€when€he€left€Patrickððs€at€about€12:30€ñ!ñœñ!ña.m.,ñ!ñ›ñ!ñ€he€wasÏintoxicated,€and€he€went€to€other€bars€to€continue€drinking.ÌÌà Ðthe€trial€court€did€not€instruct€the€jury€that€the€defendant€must€be€completely€free€fromÏexcitement€and€passion,€but€rather€that€the€defendant€must€be€sufficiently€free€fromÏexcitement€or€passion.€€This€instruction€is€consistent€with€the€essence€of€what€theÏdefendant€requested,€it€is€a€more€accurate€statement€of€the€current€law,€and€it€is€lessÏconfusing€than€the€instruction€proposed€by€the€defendant.ÌÌÓ  Óò òC.€€SECOND€DEGREE€MURDERó óÐ œ.”', ÐÓ  Óà ¸ àFinally,€the€defendant€argues€that€the€trial€court€did€not€provide€a€sufficientÏinstruction€relative€to€second€degree€murder.€€He€contends€that€the€trial€courtððsÏinstructions€do€not€explain€the€law€applicable€to€a€killing€done€in€anger€or€passion€that€isÏinsufficient€to€reduce€the€killing€to€voluntary€manslaughter.€€We€conclude€that€this€issueÏis€also€without€merit.€€After€explaining€the€elements€of€second€degree€murder,€the€trialÐ ¤7œ06 Ðcourt€instructed€the€jury,€ð ðIf€one€person€upon€a€sudden€impulse€of€passion€withoutÏadequate€provocation€and€disconnected€with€any€previously€formed€design€to€kill,€killsÏanother€willfully€and€maliciously,€such€killing€is€unlawful€and€is€murder€in€the€secondÏdegree.ðð€€The€trial€court€went€on€to€distinguish€second€degree€murder€from€voluntaryÏmanslaughter€ñ!ñœñ!ñstating,ñ!ñ›ñ!ññ!ññ!ñ€ð ðKilling€upon€a€sudden€heat€of€passion€without€maliceÏdistinguishes€voluntary€manslaughter€from€murder€in€the€second€degree.ðð€€Essentially,Ïthe€defendant€argues€that€the€trial€court€should€have€instructed€the€jury€that€if€the€intentÏto€kill€is€formed€in€passion€and€executed€without€time€for€the€passion€to€cool,€it€isÏmurder€in€the€second€degree.€€The€trial€court€may€not€have€used€the€exact€wording€theÏdefendant€requested,€but€the€substance€of€the€trial€courtððs€instruction€encompasses€theÏdefendantððs€request.€€We€conclude€the€trial€court€did€not€err€by€denying€the€defendantððsÏspecial€requests.Ìò
