Afterreview,weaffirm.@ BACKGROUND  Therecordbeforeusestablishesthat,onApril27,1993,theappellantenteredguiltypleastotheSeptember5,1991,murderofSamuelR.ScottandtheMarch24,1992,murderofCoreyC.Strickland.Thevictim,Scott,wasshotseventimeswhileattemptingtofleefromtheappellant.Threewitnessesobservedtheshooting.Thesecondvictim,Strickland,wasmurderedbytheappellantduringthecourseofarobbery.Again,eyewitnesseswerepresentatthemurderscene. TheappellantspetitionforpostconvictionreliefwasfiledonFebruary8,1994.@ ANALYSIS  Whenaclaimofineffectiveassistanceofcounselisraised,theappellantbearstheburdenofshowingthat(a)theservicesrenderedbytrialcounselweredeficientand(b)thedeficientperformancewasprejudicial.Stricklandv.Washington,466U.S.668,687,104S.Ct.2052,2064(1984);Cooperv.State,849S.W.2d744,746(Tenn.1993).Withrespecttodeficientperformance,thecourtmustdecidewhetherornotcounselsperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Whenadefendantmakesaclaimofineffectivecounselwithinthecontextofaguiltyplea,thedefendantmustdemonstrateareasonableprobabilitythat,butforcounselsdeficiency,thedefendantwouldnothavepleadedguiltyandwouldhaveinsistedongoingtotrial.Hillv.Lockhart,474U.S.52,59,106S.Ct.366,370(1985);Manningv.State,833S.W.2d635,637(Tenn.Crim.App.1994). Inhispetition,theappellantclaimsthathistwopleastofirstdegreemurderwereinvoluntarybecausehistrialcounselmisledhimastothelengthofsentencesthatwouldbeimposed.Specifically,inhispetitionhealleges:8 Duringthepleanegotiationsonthetwomurdercounts,thepetitionerwasadvisedbyhisattorneythattheprosecutionwaswillingtosettlethecase(s)forathirtysix(36)yearsentenceinexchangeforthepetitionersguiltyplea.Unknowntothepetitioner,this36yearsentencewasinfactalifetermthatofferedthepetitionernoopportunitiesforareleaseconsiderationuntilhehadservedatleastthirtysixyearsintheTennesseeDepartmentofcorrections.(sic) Theappellantdidnottestifyatthepostconvictionhearing.Theappellantsfather,FredrickBrown,Sr.,andhisgrandmother,LouiseMinafee,testifiedonbehalfoftheappellant.Alsotestifyingwasappellantstrialcounsel,JerrySummers.Thepostconvictioncourtssummarizationoftherespectivewitnessestestimonyisasfollows:8 Mr.Brown,Sr.testifiedthathewasundertheimpressionthatpetitionerwasgettingthirtysixyearsatthirtypercent(30%).Healsotestifiedthatthepetitionertoldhimhewasgettingtwo(2)lifesentences.Healsotestifiedthattherewasconversationwiththepetitioneraboutthirtysix(36)andsixty(60)years.Ms.Minafeetestifiedthatshetalkedtopetitioneraboutpleadingguiltytothirtysixyears.NeitherMr.Brown,Sr.norMs.Minafeewaspresentincourtwhenthepetitionerenteredhispleaofguilty.8 Attorney,JerrySummers,testifiedthathehadmetwiththepetitionerandthepetitionersfather.Heneverspecificallyrepresentedtothepetitionerexactlyhowmuchtimehewouldservebecauseofthechangesinthelaw,theovercrowdingofthepenitentiary,andotherfactors.Hedidtestifythathethoughtthepetitionerwould flattenoutthesentenceinthirtysix(36)years,anditmightbelessthanthat.ItwasMr.Summersunderstandingthatalifesentencemeantthirtysix(36)years.Hefurthertestifiedthatinhisyearsasanattorney,hehadneverpleadanyonetofirstdegreemurderbefore,butthefactthatthereweretwo(2)murdercasesagainstthepetitionerwasastrongincentiveforthepetitionertoplead. Thetranscriptoftheguiltypleahearingclearlyreflectsthat,atleastonfourspecificoccasions,appellantwasinformedthathewouldbepleadingtotwoconcurrentlifesentences.Thoseinstancesoccurredduring(1)thedistrictattorneygeneralsrecommendationofpunishment,(2)thetrialcourtsadvisementofthepenaltiesprovidedbylaw,(3)thestatementbytrialcounselbeforesentencing,and(4)theimpositionofsentencesbythetrialjudge. Wedonotviewtheappellantsresponses,whichwereenteredunderoathatthepleahearing,ashollowexpressionswhichmaylaterbecasuallydisregardedandheldfornaught.Indeed,weconclude,asobservedbythepostconvictioncourt,that thetranscriptoftheoriginalplearemovesanyambiguityastothepetitionerspleaofguilty. Thetrialcourt,attheguiltypleahearing,andthepostconvictioncourtfoundthattheappellantsguiltypleaswereknowinglyandvoluntarilyentered.Onappeal,thiscourtisboundbythepostconvictioncourtsfindingsoffactunlesstheevidenceintherecordpreponderatesagainstthosefindings.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978).Therecordisclearthattheappellantwasrepeatedlyadvisedthathewouldbereceivingsentencesoflifeimprisonmentforeachofthemurderstowhichhepledguilty. Afterreviewoftherecord,weconcludethattheevidencedoesnotpreponderateagainstthepostconvictioncourtsfindings.
