Althoughacknowledginghispostconvictionpetitionwastimebarredunderthethreeyearstatuteoflimitationsineffectwhenhisconvictionbecamefinal,AppellantarguesthattheenactmentonMay10,1995,ofthenewoneyearstatuteoflimitationsforpostconvictionpetitionscreatesanewoneyearperiodinwhichhemayfileforpostconvictionrelief.OurStateSupremeCourthasonlyrecentlyresolvedthisissueadverselytoAppellantsposition.Carterv.State,MonroeCo.,No.03S019612CR00117(Tenn.S.Ct.September8,1997,atKnoxville).Thusthepetitionforpostconvictionreliefwasproperlydismissed. Inaddition,followingtherevocationofhisprobationonJune10,1995,AppellantmovedthetrialcourtpursuanttoTenn.R.Crim.P.35toreducehissentence.Appellantofferednoevidenceastowhyhisagreedtosentenceshouldbereduced,hemerelystatedhefeltitwastooharsh.Themotionforsentencereductionwasdenied.Underthecircumstancesweseenoreasontodisturbthisdiscretionarydecisionofthetrialjudge.
