Habeascorpusreliefisavailableonlywhenaconvictingcourtiswithoutjurisdictionorauthoritytosentenceadefendantorwhenthatdefendantstermofimprisonmentorrestrainthasexpired.Archerv.State,851S.W.2d157,164(Tenn.1993). TheDefendantvigorouslyassertsthatthetrialcourtwaswithoutjurisdictiontosentencehimbecausehisconvictionwasvoidduetothefactthattheindictmentdidnotcontainthesignatureofthedistrictattorneygeneral. 2   כDuringthependencyofthisappeal,theStatesupplementedtherecordwithcertifiedcopiesoftheindictmentatissue.Althoughthethreecountindictmentdoesnotcontainthedistrictattorneyssignatureattheendofeachcount,theindictmentdoescontainthesignatureofthedistrictattorneyattheendofthelastcountoftheindictment.Thecountswereconsecutivelynumberedanditisquitelogicaltoreasonthatthedistrictattorneyssignaturewasintendedtocoverallthecountscontainedintheindictment.InStatev.Lockett,oursupremecourtexplained, Itisnotessentialthatthesignatureoftheofficershouldbeplacedattheendoftheindictment.Itissufficientifitappearonsomeotherpartofthepaper,provideditappearbeyonddoubtthattheattestationrelatestotheindictmentandeverypartthereof,andidentifiesthesameastheactandaccusationofthegovernment,donethroughitsswornofficer.50Tenn.(3Heisk.)27475(1871);seealsoSteveCarrollv.HowardCarlton,Warden,C.C.A.No.03C019611CR00420,JohnsonCounty(Tenn.Crim.App.,Knoxville,Jan.21,1998).Wecannotconcludethattheindictmentwasdefective.
