Whenviewedinthelightmostfavorabletothestate,seeCabbage,571S.W.2dat835,theproofattrialestablishedthatthedefendantenteredtheroomwherethetenyearoldvictimwasasleeponthecouch,removedherpanties,andcausedthevictimpainbytouchinghispenistohervagina.Althoughthevictimshymenaltissuewasnottornasaresultofthetouching,thevictimwasmissingpartofherhymenaltissue.Thevictimalsohadfibrousbandsonherlabiaminoraandadarkredareaontheleftsideofhervagina.Experttestimonyreflectedthatthesefindingsareconsistentwithsomething,suchasafingerortheheadofapenis,havingbeeninsertedandrubbedagainstthevictimoveraperiodoftime.Atestperformedonswabsfromthevictimsvaginalopeningrevealedthepresenceofasmallnumberofspermcells. Afterfullconsiderationoftherecord,thebriefs,andthelawgoverningtheissuepresented,weareoftheopinionthattheevidenceissufficienttosupportthedefendantsconvictionforrapeofachildandthatnoprecedentialvaluewouldbederivedfromtherenderingofafullopinion.ThereforeweconcludethatthejudgmentofthetrialcourtshouldbeaffirmedpursuanttoRule20,TennCt.Crim.App.R.       򀀀       JosephM.Tipton,JudgeCONCUR:򀀀DavidG.Hayes,Judge򀀀WilliamM.Barker,Judge
