Afterareviewoftherecordandapplicablelaw,wefindnomerittothepetitionersappealandthusaffirmthejudgmentofthecourtbelow.  Thepetitionersconvictionsforespeciallyaggravatedrobberyandseconddegreemurder  #  1      ׀stemfromtherobberyofMoyersMarketonJuly19,1992.Thepetitioner "b enteredthestoreandshowedtheclerkapistolhehadinhiswaistband.Thepetitionerthentoldtheclerkthathewantedmoney.Itwasatthispointthatanotheremployee,DonaldR.Brown,emergedfromthebackroomofthestoreandconfrontedthepetitioner.Althoughtherecordisnotentirelyclear,itappearsastruggleensuedandthepetitionershotandkilledMr.Brown.Thepetitionerthentookmoneyfromthestoreandleftthepremises.  Thepetitionercontendsthathewasdeniedeffectiveassistanceofcounselwhenhisattorneyallowedhimtopleadguiltytoespeciallyaggravatedrobberywhichwas 2). essentiallyincidentaltotheseconddegreemurderchargeandwasthusbarredbydueprocessanddoublejeopardy.Inreviewingthepetitionersclaimofineffectiveassistanceofcounsel,thisCourtmustdeterminewhethertheadvicegivenorservicesrenderedbytheattorneyarewithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Toprevailonaclaimof 0 ineffectivecounsel,apetitioner mustshowthatcounselsrepresentationfellbelowanobjectivestandardofreasonablenessandthatthisperformanceprejudicedthedefense.Theremustbeareasonableprobabilitythatbutforcounselserrortheresultoftheproceedingwouldhavebeendifferent.Stricklandv.Washington,466U.S.668,68788, ` 692,694,(1984);Bestv.State,708S.W.2d421,422(Tenn.Crim.App.1985). ,   Becausethepetitionerinthiscasepledguilty,hewouldhavetodemonstrateareasonableprobabilitythat,butforcounselserrors,hewouldnothavepledguiltyandwouldhaveinsistedongoingtotrial.SeeHillv.Lockhart,474U.S.52,  \ 59,(1985);Bankstonv.State,815S.W.2d213,215(Tenn.Crim.App.1991). "(   ThepetitionerclaimsthatsincehisconvictionsforespeciallyaggravatedrobberyandseconddegreemurderviolatedueprocessandtheDoubleJeopardyClause,hisattorneyshouldnothaveallowedhimtopleadguilty.Thepetitionerfurthercontendsthathisattorneysallowanceofhisguiltypleaconstitutedineffectiveassistanceofcounsel.Wedisagree.  In1932,theUnitedStatesSupremeCourtheldthatindeterminingwhethermultipleconvictionsviolatedoublejeopardy, [t]heapplicableruleisthat,wherethesameactortransactionconstitutesaviolationoftwodistinctstatutoryprovisions,thetesttobeappliedtodeterminewhethertherearetwooffensesoronlyoneiswhethereachprovisionrequiresproofofanadditionalfactwhichtheotherdoesnot.Blockburgerv. 8.4 U.S.,284U.S.299,304,(1932).ThisCourthasfurtherheldthatinorderfortwo `  offensestobeviewedasthesameoffenseunderthistest, itisnecessarythattheelementsofoneoftheoffensesmustnecessarilybeprovenwheneveraviolationoftheotheroffensehasbeenproven.Statev.Jackson,No.03C019206CR00222,Hamilton d County(Tenn.Crim.App.filedJuly29,1993,atKnoxville).  Inlightoftheforegoing,itisnecessarytosetouttheelementsoftheoffensesforwhichthepetitionerwasconvicted.Especiallyaggravatedrobberyisarobberyaccomplishedwithadeadlyweaponandthatresultsinseriousbodilyinjurytothevictim.T.C.A.3913403(1991).Incontrast,seconddegreemurderisaknowingkillingofanother.T.C.A.3913210(1991). Unquestionably,neitherrobberynortheuseofadeadlyweaponisnecessarilyprovenbyprovingtheelementsneededforfirstdegreeorseconddegreemurder.Statev.Jackson,No.03C019206CR00222,  HamiltonCounty(Tenn.Crim.App.filedJuly29,1993,atKnoxville).Inaddition,aknowingkillingofanotherisnotnecessarilyprovenbyprovingtheelementsneededforespeciallyaggravatedrobbery.Assuch,undertheprinciplessetoutabove,thesetwooffensesareseparateanddoublejeopardyisnotviolatedwhenadefendantisconvictedofboth.  However,thepetitionerfurthercontendsthattheespeciallyaggravatedrobberywasessentiallyincidentaltotheseconddegreemurderchargeandthereforebarredbydueprocessundertheprinciplessetoutinStatev.Anthony,817S.W.2d299 /%* (Tenn.1991).Wedisagree.ThetestsetoutinAnthonytodeterminewhetherornot 0', multipleconvictionsviolatedueprocesswaswhetheranoffensewasessentiallyincidentaltotheaccompanyingfelony.817S.W.2dat306.  ItisclearthatthepetitionersrobberyofthemaarketMr.Brownwasnotessentially 8.4 incidentaltohismurder.Eitheroffensecanbecommittedwithoutcommittingtheother.Obviously,neitheroffenseisnecessarilyincidentaltotheother.Assuch,thepetitionersconvictionsdidnotviolatedueprocess.
