AsthesergeantpulledhissquadcarintotheparkinglotinfrontofBerts,heobservedan    individualrunfrombehindthestoreandjumpintothewagonspassengerseat.Thewagons   headlightscameonandthecarexitedtheparkinglot.Thesergeantfollowedthecarand x  reportedthelicenseplatenumber.Thesergeantactivatedhisemergencylightsandsiren,at ^  whichtimedefendantsvehicleledtheofficeronatentotwelvemilepursuitthrough D  residentialsectionsofthecityatspeedsbetween30and40milesperhouroverthespeedlimit. *z  Defendantsvehicledidnotstopatanystopsignsorstoplights,andthepursuitendedina ` wreck.#o݌ F Ќ   XX   , DefendantwastakenintocustodyandMirandized.Hetoldthesergeantthathewasonly  urinatingnexttoBertsandclaimedthathehadonly hitchedaridewiththemandrivingthe  wagon.Whenaskedforhisname,defendantgavethenameofhisbrothertothepolice.Upon  effectinganarrestofdefendant,officersfoundacarjackandahammerbetweenthetwofront t seatsofthestationwagoninwhichdefendantwasapassenger.Additionally,thesearchof Z defendantyieldedarecentlybrokenscrewdriveranda crackpipeinthepocketofacoat @ claimedbydefendant.Duringaninvestigationofthesceneoftheattemptedburglary,Sergeant &v TaylorobservedrecentdamagedonetothereardoorofBerts.Thesergeanttestifiedthatthe  \ doorwasrustedwhereithadweathered.However,hetestifiedthathesawaplacewheretherust B hadbeenknockedoffandthemetalwasmadeshiny.Inhisopinion,thiswascausedbytheuse ( ofatooltoprythedooropen.Healsonotedasmallpieceofmetalthatmatchedthemissing  partfromdefendantsscrewdriver.Additionally,thesergeantfoundnoevidencethatsomeone  hadurinatednearBertsonthatevening.HetestifiedthatinthesamevicinityasBerts,there   areatleastthreetwentyfourhourbusinesseswithpublicrestrooms. p! Thesergeantalsotestifiedthathefoundabrokenscrewdriverinthecoatpocketthat t defendantadmittedheowned.Uponinvestigatingthesceneofthecrime,thesergeant Z discoveredasmallpieceofmetalinthedooratBerts.Thesergeanttestifiedthatthissmall @ pieceofmetalwasconsistentwiththesmallpieceofmetalmissingfromthedefendants &v screwdriver.Thoughtherecordcontainsnoforensicevidence,thereistheuncontroverted  \ testimonyofSergeantTaylorthatthebrokenpieceofmetalfoundatthecrimescenefitthe B brokenscrewdriverfoundindefendantscoatpocket.Wefindthattheevidenceissufficientto ( upholdtheconvictiononthechargeofattemptedburglary.
