XXX? g#    Inpostconvictionreliefproceedingsthepetitionerhastheburdenofprovingtheallegationsinhispetitionbyclearandconvincingevidence.T.C.A.4030210(f).Furthermore,thefactualfindingsofthetrialcourtinhearings areconclusiveonappealunlesstheevidencepreponderatesagainstthejudgment.Statev.Buford,666S.W.2d 2T). 473,475(Tenn.Crim.App.1983).  Thepetitioner'sclaimthathistrialattorneydidnotsufficientlyinvestigate 8.4 hiscaseisbasedontrialcounsel'sfailuretointerviewcertain  State  witnesses.Noneofthesewitnessestestifiedatthepostconvictionhearing,however.Thus,wehavenoproofofhowthesewitnesses'testimonycouldhavebeenmadelessharmfultothepetitionerhadtheybeenpreviouslyinterviewedbytrialcounsel.Inotherwords,thepetitionerhasfailedtoprovehowhewasprejudicedbyhislawyer'shandlingofthesewitnesses.Thisissueiswithoutmerit.  Withrespecttocounsel'svoirdireofthejury,  the  recordcontainsnoproofwhatsoeverofhowthejurorwhoallegedlyknewthepetitionerwrongfullyinfluencedthejurywithhis priorknowledge.Noprejudicehavingbeenshownfromtrialcounsel'sfailuretoremovethisjuror,thisissueiswithoutmerit.  Astothepetitioner'sstatementtothepolice,headmittedatthepostconvictionhearingthathehadnotinformedhislawyerofanycircumstancessurroundingthestatementwhichwouldhavesupporteditsexclusion.Accordingly,hislawyerdidnotactincompetentlybynotchallengingthestatement'sadmissibility. Wefirstnotethat,becausetheStatedidnotseekthedeathpenalty,thelifesentenceimposedforthefirstdegreemurderconvictionwasstatutorilyrequired.See $ T.C.A.3913204(1991).Moreover,thesentencefortheaggravatedrobberywastheminimumforthatcrime    H   #  6       andwasrunconcurrently;obviously,trialcounselcouldnothave  \ improvedonthis.Apparently,then,thepetitionerisconvincedthatheshouldhavereceivedashorterand/orconcurrentsentenceontheaggravatedassaultoffense.        #  7        T$   Inconsideringthepetitioner'ssentencesondirectappeal,thisCourtexaminedtherecordattrialandheldthat therecordjustifiesthetrialcourt'sdeterminationunderT.C.A.4035115(b)(4)thatthedefendantisadangerousoffender +$"& (Oa  (Oa   whosebehaviorindicateslittleornoregardforhumanlifeandnohesitationaboutcommittingacrimeinwhichtherisktohumanlifeishighforthepurposesoforderingtheaggravatedassaultsentencetoberunconsecutively.Statev.ScottieDewayneBurke,   No.03C019208CR00265,HamiltonCounty(Tenn.Crim.App.filedJune10,1993,atKnoxville).Thepetitionerpresentednoproofatthehearingbelowwhichdemonstratedthathisattorneycouldhavepreventedthisclassification.Accordingly,hiscomplaintabouttheconsecutivesentenceontheassaultconvictioniswithoutmerit.  Astothelengthofthesentenceontheassaultoffense,thetrialcourtenhancedtherangetothemaximumtimeofsixyearsafterfindingthattheassaulthadbeencommittedwhilethepetitionerwasonprobation.SeeT.C.A.4035114(13)(c).
