àAccording€to€Michelle€Lewis,€the€victim's€thirteen€year€oldÏstepdaughter,€the€victim€jumped€back€with€his€hands€up€just€as€theÏdefendant€fired.€The€victim€then€ran€behind€a€tree,€drew€his€weapon,Ïand€fired€two€shots.€When€the€defendant€got€inside€his€car,€the€victimÏreturned€to€his€residence€.€.€.Ð ðmutualððÏfighting€ñ¶ñœñ¶ñprior€to€the€victim€being€shot.ñ¶ñ›ñ¶ññ¶ññ¶ñ€€An€instruction€on€mutual€combat€ñ¶ñœñ¶ñwasñ¶ñ›ñ¶ññ¶ññ¶ñÏñ¶ñœñ¶ññ­ñhave›€been›Ïinappropriateñ­ññ®ñunnecessaryñ®ñ.ñ¶ñ›ñ¶ñ€€Therefore,€counsel€was€not€deficient€for€failing€to€request€such€anÏinstruction.Ìà àNevertheless,€petitioner€was€not€prejudiced€by€the€failure€to€request€anÏinstruction€on€mutual€combat.€€At€the€time€the€offense€was€committed,€a€homicideÏcommitted€during€mutual€combat€was€voluntary€manslaughter,€òòCooper€v.€Stateóó,€356Ð àDuring€the€sentencing€hearing,€the€trial€court€noted€defendantððs€lengthyÏcriminal€history€in€addition€to€his€conviction€for€voluntary€manslaughter.€€The€trialÏcourt€also€recognized€that€defendant€had€a€previous€probation€revocation.€€Both€ofÏthese€are€appropriate€enhancement€factors€under€the€1982€Sentencing€Act.€€Tenn.ÏCode€Ann.€ðð€40„35„111(1),€(8)€(1982).€€The€trial€court€then€enhanced€petitionerððsÏsentence€from€the€minimum€thirty„five€(35)€years€to€fifty€(50)€years.Ìà
