L    Attherevocationhearing,JamieHurst,thedefendantscommunitycorrectionscaseofficer, $ t testifiedthatshortlyafterthedefendantbeganhiscommunitycorrectionssentence,hewasarrested  ` onSeptember24,2001,fortheftofpropertyunder$500,occurringonthatday.Shesaidthatthe  L  defendantpledguiltytothisoffenseandwasconvictedonSeptember26,2001.Shestatedthatshe  8  waspresentincourtwhenthedefendantenteredthisplea.Shestatedthatthedefendantssecond $  arrestoccurredonNovember9,2001,fortwocountsofattemptedforgeryofanamountover$500   occurringonSeptember13,2001.ShesaidthathepledguiltytotheseoffensesonNovember9.   Ms.Hurstsaidthathedidnotreporteitherofthesearreststoherasrequiredbythetermsofhis   communitycorrectionssentence.Sheacknowledgedthatthereasonthedefendantdidnotreportthe   arreststoherwasthathewasinjailfromthetimeoftheSeptember24arrest,butshestatedthat p individualsplacedinthecommunitycorrectionsprogramweretoldtohaveanotherpersonreport \ anarresttotheircaseofficer. H   Ms.Hursttestifiedthatthedefendanthadtoldherthathewasaddictedtocrackcocaine.She  p saidthatwhenshewasfirstassignedtothedefendantscase,hewasstillinjailandtoldherthathe  \ neededdrugtreatment.Shesaidthatafterhewasreleasedfromjailandputoncommunity H corrections,shetoldhimthatshehadfoundanavailablebedatalongterm,inpatientdrugtreatment 4 facilityinMemphis,Tennessee.Shesaidthatatthattime,thedefendanttoldherthatheneededto   bewithhisfamilyandthathewasgoingtoattempttoovercomehisdrugaddictiononhisown.She   saidthatsheaskedthedefendanttocontactherifhechangedhismindbutthatsheheardnothing  moreonthesubjectuntilthedefendanthadbeenincarceratedfollowinghisSeptember24arrest.  Shesaidatthattime,hetoldherthathewaswillingtoparticipateindrugtreatment.    Shestatedthatthedefendanthadtoldherthathewasworkingasaroofer.Shesaidthatonce X  thedefendantsfathercalledherandtoldherthatthedefendantwasonaroofingjob.Shesaidthat D! otherthanthistelephonecall,shehadnotbeenabletoverifythedefendantsemployment.Ms. 0"  Hursttestifiedthatatthetimetheviolationwarrantissued,thedefendanthadnotpaidanycourt #l! costsbutthatwhenshesawhiminjail,heproducedareceiptshowingthathehadmadehis$50 $X" payment. $D #   Thedefendanttestifiedthatheagreedtoasentenceabovehisrangeforthepresent &"% convictionsinordertobereleasedfromjail.Hesaidthathethoughthewouldabidebytheterms '#& ofhiscommunitycorrectionssentencebutthatheviolatedthembecauseofhisaddictiontocrack (#' cocaine.Hestatedthatafterbeingreleasedfromjailintocommunitycorrections,heworkedforhis )$( fatherdoingroofingforthirtytothirtyfivedaysuntilhewasarrestedandputinjail.Hesaidthat |*%) hisfathertoldMs.Hurstabouthisemploymentasaroofer.Shestatedthatwhileoncommunity h+&* corrections,hestolepropertyvaluedunder$500inordertosellittogetmoneywithwhichtobuy  drugs.Hesaidthathealsoforgedsomeoneelseschecks,cashedthechecks,andusedthemoney  tobuydrugs.Thedefendantsaidthathewanteddrugtreatmentandwaswillingtostayinalong  term,inpatientfacility.HestatedthathehadbeenintheDepartmentofCorrection(DOC)several t timesandbelievedthatdrugtreatmentwouldhelphimmorethanspendingtimeinprison.Hestated ` thathehadcompliedwithalloftheothertermsofhiscommunitycorrectionssentenceexceptfor L  hisnewarrests. 8    Oncrossexamination,thedefendantadmittedtoconvictionsforaggravatedassaultand  ` carryingadeadlyweapon,forwhichhereceivedsentencesoffouryearsandelevenmonths,twenty  L  ninedaysrespectivelyonJuly24,1989.Heacknowledgedthathewasconvictedofaggravated  8  burglaryandtheftofpropertyvaluedunder$500andthathereceivedsentencesoffouryearsand $  elevenmonths,twentyninedaysrespectivelyonAugust26,1992.Heagreedthathewasconvicted   forrobberyandpossessionofdrugparaphernalia,forwhichhereceivedsentencesofsixyearsand   elevenmonths,twentyninedaysonMarch16,1995.Hesaidthathewasplacedonprobationfor   someoftheseoffenses,thathisprobationwasrevoked,andthathewenttoprison.Hesaidthathe   alsohadadrugproblematthetimehecommittedtheseotheroffenses.Headmittedthatatonetime, p Ms.Hurstofferedtohelphimenteradrugtreatmentprogram.Hesaidthatheneverrefused \ treatmentbutthathesimplydidnotdecidetogoatthattime.HestatedthathetoldMs.Hurstthat H hewouldentertreatmentnow. 4   Thetrialcourtfoundthatthedefendanthadviolatedhiscommunitycorrectionssentenceby  \ hisconductunbecominggoodcitizenshipandhissubsequentconvictionsonSeptember26,2001, H andNovember9,2001.Itrevokedthedefendantscommunitycorrectionssentenceandorderedhim 4 toserveasixyearsentenceintheDOC.Itstatedthatitwouldrecommenddrugtreatmentandthe   SpecialNeedsUnitforthedefendantwhileincarcerated.     Althoughthedefendantadmitsthatheviolatedthetermsofhiscommunitycorrections  sentence,hecontendsthatthetrialcourtsdispositionofthecasewasimproper.Hearguesthatin  lightofhisaddictiontocrackcocaineandhiswillingnesstosubmittolongtermdrugtreatment,the l trialcourtshouldhaveimposedanalternativetocontinuousconfinementsuchaslongtermdrug X  treatment,shockincarcerationfollowedbydrugtreatment,additionalconditionsforhiscommunity D! correctionssentence,oratermofprobationfollowingdrugtreatment.Thestatecontendsthatthe 0"  trialcourtdidnoterrinrevokingthedefendantscommunitycorrectionssentencebecause #l! overwhelmingevidenceexistedthatheviolateditsterms.Weagreewiththestate. $X"   Trialcourtshavetheauthoritytorevokeacommunitycorrectionssentenceuponfindingby %0!$ apreponderanceoftheevidencethatthedefendanthasviolatedtheconditionsofthesentence.State &"% v.Harkins,811S.W.2d79,82(Tenn.1991);seeTenn.CodeAnn.40-35-311.Iftheevidenceof '#& aviolationissufficienttoenablethetrialcourttomakeaconscientiousandintelligentjudgment (#' regardingrevocation,thatjudgmentwillnotbedisturbedonappeal.Id.Attherevocationhearing )$( inthepresentcase,thedefendantadmittedthathehadviolatedthetermsofhiscommunity |*%) correctionssentencebyacquiringhissubsequentarrestsandconvictions.TheevidencefromMs. h+&* Hurst,whowaspresentwhenthedefendantpledguiltytotheSeptember24offenses,andthe  defendantismorethansufficienttoallowthetrialcourttoexerciseitsdiscretionintelligentlyand  conscientiouslyinrevokingthedefendantscommunitycorrectionssentence.    Thedefendantalsocontendsthatthetrialcourtsimpositionofhisoriginalsentenceofsix ` yearsincontinuousconfinementasaRangeIIIoffenderwasexcessiveinlightofthecircumstances L  surroundinghisviolations.Heassertsthatthetrialcourthadtheauthoritytoreducehissentence 8  underTenn.CodeAnn.4036106(e)(4)andmaintainsthatanappropriatesentencewouldhave $ t beenfouryearsasaRangeIIoffender.Hearguesthatthetrialcourtshouldhaveconsideredhis  ` potentialforrehabilitationasreflectedinthecircumstancesofthenewoffensesastheyrelatedtohis  L  drugaddiction,hisdemonstratedneedfordrugtreatment,hisstatusasanonviolentoffender,and  8  thefactthathisconductneithercausednorthreatenedseriousbodilyinjury.Hearguesthathe $  shouldhavebeenallowedtocontinueworkingtoprovideforhisfamilyandcontributetosociety.   ThestatepointsoutthatthedefendantpledguiltyandagreedtoasentenceofsixyearsatRangeIII.   Itcontendsthatthisfactalongwiththedefendantspreviousinabilitytocomplywithasentence   involvingreleaseintothecommunityrevealthatthetrialcourtdidnoterrinimposingtheoriginal,   agreedsentence.Weagreewiththestate. p   Thedefendantagreedtobesentencedasacareeroffender.Thefactthathefailedhis H communitycorrectionsobligationsdidnotchangetheagreement.Thedefendantadmittedthathe 4 violatedthetermsofhiscommunitycorrectionssentencebyacquiringnewarrestsandconvictions.  p Evenconsideringthesentencingprinciples,wearenotimpressedbythedefendantsclaimsof  \ amenabilitytorehabilitation.Thedefendanttestifiedthathewasaddictedtodrugsduringhis H commissionofnumerouscrimesbeforethoseinthepresentcase.Despitethislongtermaddiction, 4 thedefendantchosenottopursuedrugtreatmentwhenhiscaseofficerattemptedtoarrangeit.This   incombinationwiththedefendantsinabilitytoabidebythetermsofearliersentencesinvolving   releaseintothecommunityrevealthatthetrialcourtdidnotabuseitsdiscretioninimposingthe  originalsentence.    Basedupontheforegoingandtherecordasawhole,weaffirmthejudgmentofthetrialcourt l revokingthedefendantscommunitycorrectionssentenceandimposinghisoriginalsentence.
